Liferay Licensing and Support Control Number TAC-19-52527 Page 2 of 6 Control Number TAC-19-52527 JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY 1. Contracting Activity: Department of Veterans Affairs (VA) Office of Procurement, Acquisition and Logistics Technology Acquisition Center 23 Christopher Way Eatontown, New Jersey 07724 2. Description of Action: The proposed action is for a firm-fixed-price delivery order issued under the National Aeronautics and Space Administration (NASA) Solutions for Enterprise-Wide Procurement (SEWP) V Governmentwide Acquisition Contract (GWAC), for the renewal of brand name Liferay Digital Experience Platform (DXP) Enterprise Subscription Platinum Level Software licenses and maintenance support. 3. Description of the Supplies or Services: VA Office of Information and Technology (OI&T), Enterprise Program Management Office (EPMO), has a requirement for the renewal of three Non-Production and 12 Production Liferay DXP Enterprise Subscription Platinum Level Software licenses and maintenance support. An additional 14 Non-Production Liferay DXP Enterprise Subscription Platinum Level Software licenses and maintenance support are also required. The Liferay software licenses are currently being utilized as the user interface of the My HealtheVet (MHV) platform. With the entire MHV web based portal running on Liferay, it is critical that OI&T EPMO MHV teams have access to technical support necessary to support the system. The renewal of Liferay licenses and maintenance support will allow non-technical Veterans Health Administration staff to continue to manage website content updates without intervention from the EPMO staff. Additionally, the software maintenance will provide bug fixes and updates that are required to keep the software operational to mitigate security vulnerabilities. The period of performance is 12 months from October 3, 2018 through October 2, 2019 with three12-month option periods and optional tasks for an additional one Non-Production and three Production Liferay DXP Enterprise Subscription Platinum Level Software licenses and maintenance support has been included for each option period. The total estimated price of the proposed action, inclusive of all options and optional tasks, is $ 4. Statutory Authority: The statutory authority permitting this exception to fair opportunity is Section 41 U.S.C. 4106(c)(2) as implemented by the Federal Acquisition Regulation (FAR) Subpart 16.505(b)(2)(i)(B) entitled, Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized. 5. Rationale Supporting Use of Authority Cited Above: Based on market research, as described in section 8 of this document, it has been determined that limited competition for Liferay DXP Enterprise Subscription software and support is viable among authorized resellers of these products. The current MHV platform utilizes Liferay licenses for its user interface. This user interface integrates with the currently fielded MHV platform, which has 26 distinct applications, such as Appointments, Pharmacy, Blue Button, and the Healthy Living Assessment. Liferay has been integrated with each of these MHV capabilities. If any other brand name software was to be utilized as the user interface for the MHV platform, then all 26 applications would require integration with the new software. All of the current applications are coded to specifically interact with Liferay source code. Any integration of a different software solution would result in the inability to access MHV for at least 1.5 years. The reengineered MHV platform is built on Liferay and if another platfrom would be implemented, it would have to be rewritten, tested, deployed as well as stop all of the current Legacy work that is currently ongoing to move onto the Liferay platform. This would result in extensive delivery delays of up to two years and $4.4M in costs that would not be recovered through competition. These estimates are based on previous efforts for similar procurements. This would severely impact million Veterans as MHV is the Veteran s sole resource for virtual healthcare from VA. Veterans would lose the ability to virtually access their personal health information, virtually contact their physicians, access thier appointment information, and virtually refill vital medications, among all the other capabilities that MHV currently provides. Additionally, since Liferay software is proprietary, no other vendor can provide the required software maintenance and technical support. In order to continue to correct bugs or remediate security vulnerabilities in any existing/ new software, access to the source code is required. No other vendor, other than the software developer, has access to this source code. Furthermore, for this reason, no other vendors offer technical support for the product that VA can utilize to allow non-technical VHA staff to continue to manage website content updates without intervention from the EPMO staff. Other software developers that offer similar products merely provide software maintenance and technical support for their own proprietary software products. 6. Efforts to Obtain Competition: Market research was conducted, details of which are in the market research section of this justification. In accordance with FAR 5.301 and 16.505(b)(2)(ii)(D), award of the resultant delivery order will be synopsized and this justification will be made publicly available on the Federal Business Opportunities Page within 14 days of award. In accordance with FAR 16.505(a)(4)(iii)(A), the justification will be posted with the request for quote on the NASA SEWP V GWAC website with the solicitation to notify all interested parties. 7. Actions to Increase Competition: In order to remove or overcome barriers to competition in future acquisitions for this requirement, the Government will continue to perform market research to determine if there are any new products or maintenance services available that will fulfill the Government s need. 8. Market Research: Market research was conducted in August 2018 by the Government s technical experts. The team searched content management products Alfresco, Drupal 8.0, and Team site. The Government s technical experts determined that none of the products will meet the Government s requirements due to interoperability and compatibility issues as outlined in section 5 of this justification. While these software developers provide products that perform similar functions, selecting an alternate product would require a significant redesign to the MHV portal. Additionally, these vendors only offer software maintenance and technical support for their own proprietary products. Market research has concluded that Liferay is the only software product, and its associated software maintenance and technical support, that meets all of the needs of the Government. In August 2018, the Contract Specialist conducted market research to ascertain the extent of limited competition among resellers of the required software licenses and associated software maintenance. Through the use of the Provider Look-up tool on the NASA SEWP V GWAC website, 10 Service Disabled Veteran-Owned Small Businesses (SDVOSBs) were identified as resellers of the required Liferay Software licenses and maintenance support. Therefore, limited competition is anticipated. 9. Other Facts: None 10. Technical and Requirements Certification: I certify that the supporting data under my cognizance, which are included in this justification, are accurate and complete to the best of my knowledge and belief.
