Description
The U.S. Nuclear Regulatory Commission (NRC) intends to enter into a sole source contract with WMATA so that the NRC can pay transit subsidy costs for Metro Rail trips for NRC employees that are eligible for the federal transit subsidy in accordance with Executive Order (EO) 13150. That EO provides a non-taxable subsidy designed to encourage employees to use mass transportation for their daily commute to and from work by methods other than single occupancy vehicles. WMATA is the operator of the Washington Metrorail System. WMATA does not permit any other sources to accept payments for Metro Rail fares, and subsidies to NRC employees that receive the transit subsidy benefit for Metro Rail is applied directly to their Metro SmarTrip card at the beginning of each month. The only way for NRC employees to use that benefit is to have a SmarTrip card issued by WMATA. Therefore, in order for the NRC employees to access the subsidy, this contract must be awarded to WMATA. The authority to enter into a contract on a sole-source basis with WMATA is 41 U.S. C. 253(c)(1) and Federal Acquisition Regulation 6.302-1 which provides for limiting competition in those situations where the supplies or services are available from only one responsible source and no other supplies or services will satisfy the agency requirements.
