Senior Police Advisor Monrovia, Liberia Issuance Date: 09/20/2018 Closing Date: 10/04/2018 SOLICITATION NUMBER: PSC-18-056-INL SUBJECT A solicitation for a Personal Services Contractor (PSC), Department of State (DOS), Bureau for International Narcotics and Law Enforcement Affairs (INL) The United States Government (USG), represented by the DOS, seeks applications from US citizens interested in providing PSC services as described in this solicitation. PRE-AWARD ETHICAL RESPONSIBILITIES OF PSC (JUN 2011) This solicitation may result in the award of one or more personal services contracts as defined in FAR 2.101. Prior to contract award, all offerors or quotes must advise the cognizant Contracting Officer if they have a personal conflict of interest, such as a financial conflict, that would prevent them from either meeting the requirements of the clause entitled, "Post-Award Ethical Responsibilities of Personal Services Contractors," or otherwise objectively performing their contractual duties upon contract award. HOW TO APPLY Offerors proposal shall be in accordance with the requirements stated in this solicitation at the place and time specified. A proposal will be determined non-responsive and ineligible for consideration unless all required documents and information are included in the submission. INL's mission is to minimize the impact of international crime and illegal drugs on the United States and its citizens through providing effective foreign assistance and through fostering global cooperation. INL's Office of Africa and the Middle East (AME) and INL's Section at Embassy Monrovia (INL/Liberia) develop and manage criminal justice sector reform programs and contribute to policy formation on civilian security issues in both regions. INL/AME and INL/Liberia personnel administer all U.S. government assistance to the criminal justice sector within the Government of Liberia (GOL), including its police, justice institutions, counternarcotics, and Bureau of Corrections and Rehabilitation. The goal of this program is to help Liberia strengthen their criminal justice institutions to provide security and public safety services to the population of Liberia. The incumbent will reside in Monrovia and travel and work frequently in the field. The purpose of this Personal Services Contract is to fill the position of Senior Police Advisor who will provide subject matter expertise in police reform and oversee all management aspects of the law enforcement assistance programs (to include training, funding, equipment accountability, program development, and implementer performance). S/he will provide expertise in a wide variety of settings, including internal U.S. Embassy meetings, as well as bilateral meetings with multiple Liberian governmental representatives. S/he will be responsible for the day-to-day coordination of INL's programming efforts involving Liberian law enforcement entities. The Senior Police Advisor will offer assistance in a wide range of areas, to include police training and reform, and will assist in coordination with the interagency and international community on such reform efforts. The Senior Police Advisor will serve as the point of contact between the INL Director and the various implementing partners and contracted advisors. The Senior Police Advisor will support, assist, and advise INL in its efforts to develop the capacity of the Liberian National Police (LNP) and other civilian law enforcement entities in Liberia. The incumbent also will provide internal control and accountability for the delivery of equipment, technical assistance, training, and other assistance to the GOL law enforcement entities within Liberia. The Senior Police Advisor is expected to develop meaningful relationships with GOL law enforcement counterparts, and will provide the LNP with guidance on standard operating procedures, recruitment and staffing, management/leadership skills, and assistance to specialized units such as the Emergency Response Unit (ERU) and the Police Support Unit (PSU). The Senior Police Advisor will assist and advise the GOL in the development and implementation of systematic institutional reform of law enforcement agencies. The Senior Police Advisor must be able to work rapidly, responding promptly to multiple demands and juggle changing priorities in a difficult and demanding environment. The position requires the ability to determine swiftly what needs to be done, when it needs to be done, and how it can be delivered with enough supervision to ensure its effectiveness. DUTIES AND RESPONSIBILITIES: Substantive: 1.Assess the roles of the LNP and other law enforcement agencies in the Liberian criminal justice system; identify and prioritize areas for reform; work with such agencies to design and implement needed reforms. 2.Manage, prioritize, and evaluate U.S. Government-sponsored law enforcement assistance projects under the guidance and direction of the INL Director, while informing all stakeholders of the details of such implementation, including progress and problem areas. 3.Coordinate with all other components of the GOL's criminal justice system to ensure system-wide integration and functionality. Provide expert advice, guidance, and leadership in the design, development, and implementation of police training programs. 4.Lead the Embassy's efforts to develop a long-term USG strategy for law enforcement assistance in Liberia. 5.Gather necessary information and plan and coordinate INL assistance activities across program and organizational lines, reconcile conflicting interests, and resolve complex and sensitive issues. 6.The Senior Police Advisor is expected to develop meaningful relationships with GOL law enforcement counterparts, and will provide the agencies with guidance on standard operating procedures, recruitment and staffing, management/leadership skills, and the development and reform of specialized units. 7.The Senior Police Advisor will assist and advise the GOL in the development and implementation of systematic reform of criminal justice institutions. 8.Provide the INL Director with current analyses and the latest information on issues relating to police reform, police training, and their coordination with other international efforts; note problem areas and opportunities that merit Embassy attention; suggest courses of action. 9.Provide expertise, commentary and suggestions as appropriate on such areas as law enforcement training and institutional reform; assist with donor coordination. 10.Develop and maintain a close working relationship with UN agencies INL and other Embassy colleagues, the Government of Liberia (GOL), other international donors, and INL's implementing partners in order to identify and resolve issues effecting the administration of police training and development programs. 11.Keep law enforcement training and reform efforts on track amid constantly changing circumstances by facilitating the interaction between the INL Director, Liberian law enforcement, international partners, and other local officials, relevant international partners, and representatives from civil society. 12.Remain aware of the personalities involved with the Liberian counterparts; ensure that INL is working with the most effective players who are most likely to accept, learn and benefit from INL law enforcement training and development programs. 13.As directed by the INL Director, brief senior U.S. Mission officials, visitors from Washington, NGOs, or international organizations, and work with Embassy counterparts in planning efforts such as the Integrated Country Strategy. 14.As directed by the INL Director, attend conferences and multilateral or regional meetings that relate to the assigned areas of responsibility. Managerial 1.Ensure that the INL Office is effective in channeling and coordinating INL assistance to law enforcement entities in Liberia. Design new programs employing Third-Party Contractors (TPC) in Liberia that will coordinate efforts between police and civil society. 2.Establish and maintain appropriate internal management control systems; ensure that INL law enforcement programs are not subject to waste, fraud, or mismanagement. Help manage the End Use Monitoring (EUM) of all U.S.-provided commodities provided to the Liberian law enforcement sector. 3.Provide analysis and guidance in project budget preparation, and program planning for law enforcement programs with an annual budget of approximately $7-11 million. 4.Conduct senior-level field surveys, evaluations, and special studies, to assess the effectiveness of INL law enforcement assistance programs. 5.Oversee the work of INL-funded TPCs as well as Criminal Justice Program Support (CJPS) Contractors Implementing INL assistance programs and projects. 6.Maintain security awareness and properly handle classified and controlled items and information. 7.PSC Acquisition Requirements and Duties: a.Duties In consultation with the INL Director, The Senior Police Advisor shall perform the full range of activities necessary to identify, acquire and deploy services and commodities necessary for law enforcement project implementation. These activities may include: i.Development/identification of project services and commodity requirements including discussions with host nation counterpart personnel, ii.Conducting market research to determine potential sources of supplies/services, iii.Coordinating with other USG agencies with similar requirements, iv.Acquisition planning, v.Drafting statements of work/specifications and evaluation criteria for use in solicitations, vi.Development of Independent Government Cost Estimates (IGCE) of the cost/price of project commodities and services, vii.Understand the duties of a Contracting Officer's Representative (COR) in order to provide relevant information to INL Liberia Program CORs where necessary, viii.Participate as a member of Technical Evaluation Panels established to review and evaluate proposals in response to formal solicitations; and ix.Successfully complete the Department of State's course "How To Be a Contracting Officer's Representative" within 120 days of contract start and provide a copy of the certificate of completion to the INL Director, the INL/AME Program Officer, and the Contracting Office (INL/RM/GAPP), whether or not the contractor is expected to be formally designated as a COR. x. Serve as acting INL Director in the INL Director's absence. b.Ethical Requirements In performance of this contract, the contractor shall be subject to the ethics rules applicable to Department of State employees under 5 CFR Part 2635 (Standards of ethical conduct for employees of the Executive Branch), 2 FAM 700 (Ethics), and 3 FAM 4120 (Employee Responsibilities Abroad) and 4170 (Official Clearance of Speaking, Writing and Teaching). Contractor shall also be subject to 5 CFR Part 2637 (regulations concerning post-employment conflicts of interest). The contractor must maintain an Ethics Clearance during the performance of this contract. TRAININGS & DISTANCE LEARNING COURSES 1.Completes the Contracting Officer Representative (PA296) distance-learning (DL) course through the Foreign Service Institute (FSI) within 120 days of arriving at Post. 2.Completes the Introduction to Working in an Embassy (PN113) distance-learning (DL) course through the Foreign Service Institute (FSI) within the first six (6) months of arriving at Post. 3.If applicable - Completes the mandatory Foreign Affairs Counter-Threat (FACT) Course (OT610) prior to deployment to Post. RELATIONSHIP: The Senior Police Advisor will report to the INL Director at the U.S. Embassy Monrovia, and may be called upon to fulfill Acting-Director responsibilities in the absence of the Director. The Senior Police Advisor will focus primarily on the programs related to Liberian law enforcement activities. The INL Director will provide general administrative and policy direction concerning overall program priorities and objectives. The Senior Police advisor will receive general policy guidance and direction from the INL Director, but will work independently to further the mission of INL. The Contracting Officer's Representative (COR) is delegated the authority to act for the Contracting Officer in matters concerning technical clarification, inspection and, after concurrence by the Contracting Officer, acceptance of Contractor performance under the contract, including preparation of receiving reports, and the authorization of progress payments when appropriate. The COR will coordinate all work with the Contractor and review Contractor's performance at significant stages of its development. In no instance, however, shall the COR be authorized to alter or modify the specifications or the contract terms and the conditions or waive the government's requirement, price, delivery, or other terms and conditions. Such changes must be authorized, in writing, to the Contracting Officer. DELIVERABLES: Within 60 days of contract award, the Senior Police Advisor will develop an annual workplan for review and approval by the INL Liberia Director. The Work Plan will be based upon the duties and responsibilities outlined above and INL's overarching, strategic goals for the strengthening of the GOL's national security radio communications network. The Work Plan shall include duties outlined herein and any additional deliverables recommended by the Advisor. The Work Plan will include: (a)Continuing Responsibilities duties carried out on a continuing basis or as required by circumstances for a time extending beyond the rating period. (b)Special Projects, which are duties that may be achieved completely in a fixed period. REPORTING REQUIREMENTS: On a schedule determined by the INL Director, the Senior Police Advisor shall provide a 1-3 page report in an editable Microsoft Word document to the INL Director in Monrovia for inclusion in the INL Monthly Reporting cable, and shall send a courtesy copy of this report to the INL Liberia Program Officer in Washington, DC. At a minimum, this report will include: •Progress on law enforcement projects during the reporting period, with specific examples; •Any significant issues which have come to his/her attention and which would impact U.S. government interests in the law enforcement sector, and how they are being addressed; •Brief readouts of significant meetings, conferences, and functions held/attended for the previous reporting period (note: this should not be exhaustive, but only include the most significant); •Any other issues which the Senior Police Advisor feels should be brought to the attention of the INL Director in Monrovia and/or the INL Liberia Program Officer; •A calendar of important upcoming dates for the next three months to include: oSignificant events related to law enforcement programming; oSignificant UN, GOL, or U.S. government operational events; oSignificant meetings with GOL ministries, foreign government officials, and U.S. government officials; oUpcoming contractual deadlines. The Senior Police Advisor shall also be prepared to submit a quarterly evaluation of contractor performance and/or special reports as requested by the INL Director. At the end of their assignment, the Senior Police Advisor shall provide a comprehensive review of the projects to include a critique of, and recommendations for, all projects. The completion of end-of-assignment report is due no later than 30 days prior to the expiration of this contract. COMPLEXITY: Develops detailed plans, goals and objectives for the long-range implementation and administration of INL policies and programs, and/or develops criteria for evaluating the effectiveness of the program. Coordinating plans with various other groups including international donors and the GOL can be complicated. Active planning involves anticipating future events and requirements, deciding or recommending what needs to be done, the people and other resources required, and the timing of the activities. Operating within the Integrated Country Strategy, the Senior Police Advisor will have ongoing opportunities to develop new ideas and approaches that impact on existing procedures and methods. The Senior Police Advisor must absorb and understand a large volume of detailed information on policies and procedures for multiple disciplines. Within a loose framework, the Senior Police Advisor will be responsible for meeting a series of mid-to-long term objectives through structuring work and resources. Often breaking new ground, this role is highly complex and requires highly developed analytical abilities and judgment. The problems encountered in this position will often be unique, highly complex and politically sensitive, or conceptual. Covering a wide range of potentially conflicting issues, the Senior Police Advisor must apply the highest analytical skill and judgment to determine the best solution from the range of possible alternatives that best serve USG interests in providing security assistance to the GOL. The work pattern will be typified by many other overlapping tasks with frequent disruption due to changes in priorities, external events, and other unanticipated events. A broad range of highly developed oral and written communication skills are required for this position. The Senior Police Advisor will, at various times, be required to transmit routine information, discuss sensitive matters with tact and diplomacy, provide complex explanations, persuade and influence, give formal presentations, express care and compassion, provide reasoned arguments, and resolve conflicts without compromising the the position(s) of stakeholders. Finally, the Senior Police Advisor must exercise leadership in order to achieve objectives and get the job done well, quickly and efficiently without close supervision. SCOPE AND EFFECTIVENESS: The Senior Police Advisor performs a broad range of tasks related to organizational control plan, process development, implementation and direction of a management control program encompassing the INL international law enforcement operations. PERSONAL CONTACTS: The Senior Police Advisor will interface primarily with mid- and senior-level officials within the U.S. Embassy in Monrovia and other international representatives in Liberia. The nature of Embassy contacts will be highly demanding, requiring the transfer of complex ideas and concepts, and support for Embassy planning and decision making. The Senior Police Advisor will interact primarily with high-level GOL and international officials, including Ministers and Deputy Ministers. The nature of the contact should be routine, but often escalating in complexity as competing/conflicting interests and security threats are encountered. MINIMUM REQUIREMENTS: •U.S. citizenship with the ability to obtain and maintain Department of State Secret level security, medical, and ethics clearances. •Bachelors Degree from an accredited institution. •Minimum fifteen (15) years of experience in law enforcement operations, management, organizational development, planning, or training. •Minimum five (5) years of supervisory experience. •Minimum two (2) years of experience in police development/reform program development and management overseas, including strategic planning, budget preparation, the procurement of goods and services, and implementation and oversight of law enforcement projects. •Demonstrated ability to explain, promote, and defend USG policies to senior law enforcement officials of other nations and the host country and representatives of international organizations. •Demonstrated experience working or coordinating with USG agencies (e.g., USAID, Justice, State, and/or Defense). •Demonstrated ability to exercise a high degree of professional judgment, diplomacy, and tact at all times in order to build successful relationships with international government partners and the international community. •Demonstrated ability to communicate clearly and effectively in English, both orally and in writing. Demonstrated experience in preparing well-written reports. •Demonstrated proficiency in Microsoft Office Suite, and ability to organize, analyze, prepare, and present information to a variety of audiences. EVALUATION CRITERIA: Factor 1 - Program Management (20 points) Demonstrated experience in law enforcement program management, especially in international programs that may include foreign government entities, non-governmental, and international organizations to include experience involving analytical, planning, management, advisor, operational, or evaluative duties. Demonstrated experience and ability to assess current programs in place and to develop and implement plans for improving the capabilities of the LNP. Factor 2 - Subject Matter Experience (30 points) Demonstrated experience, expertise, and senior-level positions in law enforcement. Individual should demonstrate previous experience in law enforcement operations, investigations, senior organizational leadership, justice sector issues, procurement of commodities and equipment, training development and implementation, and logistics support. Other preferred factors to be considered includes a Master's degree from an accredited institution in criminal justice, business administration, organizational development, or other related field or an additional five years of relevant experience in a developing country; knowledge of USG contracting practices and experience in contract oversight; and previous experience as a lead investigator or overseeing investigations. Factor 3 - Interpersonal Relations and Communications (30 points) Demonstrated ability to build meaningful relationships with host country counterparts, and liaise effectively with contractor personnel, staff members of USG agencies, and international personnel. Ability to communicate complex program issues and alternatives in a timely and concise manner, both orally and in written form. Proven ability to provide objective subject matter expertise on police program management to senior level officials within INL and the U.S. Embassy. Factor 4 - International Experience (10 points) Demonstrated experience in managing programs in foreign environments, preference for Africa and West Africa, to include ability to live, work, and travel in difficult conditions with limited support, manage programs in a complex and fluid environment, and show good judgment in challenging security situations. Factor 5 - Past Performance (10 points) Past performance evaluation of applicant's ability to perform under the contract. In conducting the evaluation, the U.S. government reserves the right to utilize all evaluation information available at the time of evaluation, whether provided by the applicant or obtained from other sources. The most qualified candidates may be interviewed, required to provide a writing sample, and demonstrate an ability to operate commonly used office applications. INL will not pay for any expenses associated with the interviews. In addition, applications (written materials and interviews) will be evaluated based on content as well as on the applicant's writing, presentation, and communication skills. In the event that a candidate has fully demonstrated his/her qualifications and there are no other competitive applicants, INL reserves the right to forego the interview process. Professional references and academic credentials will be evaluated for applicants being considered for selection. COMPENSATION (BASE PAY) For award, INL will negotiate for this contract based on the market value as outlined above and overall experience relevant to the solicitation requirements.
