Description
Notice of Intent This is a Notice of intent to Sole Source for a Chemistry Analyzer at JB Charlston. NOTICE OF INTENT TO AWARD SOLE SOURCE THIS IS NOT A REQUEST FOR COMPETITIVE PROPOSALS. This is a notice of intent to award a sole source contract under statutory authority 10 USC 2304(c) (1), set forth in Federal Acquisition Regulation 6.302-1 -- Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.. The Reference Number is FM44188247AW01. The 628th Contracting Squadron, 101 E. Hill Blvd., Joint Base Charleston, intends to award a sole source contract to acquire a lease renewal for a Chemistry Analyzer to support the 628 Medical Group at Joint Base Charleston Air Base. The 628th Contracting Squadron intends to make an award to Siemens Diagnostics. Market research was conducted and information gathered in determining this company to be the only source for this requirement at our location. In accordance with (IAW) FAR Part 5.207(c)(15)(ii), the proposed contract action is for services for which the Government intends to solicit and negotiate with only one source under the authority of FAR 6.302-1(b)(4). This notice of intent to award is not a request for competitive proposals; however responsible sources may submit a capability statement, proposal, or quotation which shall be considered by the agency. A determination by the Government not to compete this requirement based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. The justification for the sole source requirements as follows: In accordance with FAR 6.303-2: (1) Agency and Activity: 628 Contracting Squadron, Joint Base Charleston, SC (2) Nature of action being approved: Sole source acquisition. (3) The purpose of this acquisition is to provide a lease renewal for a Chemistry Analyzer. (4) Justification Rationale: IAW FAR 6.302-1(b)(4) Use of this authority may be appropriate in situations such as the following: When there is a reasonable basis to conclude that the agency's minimum needs can only be satisfied by unique supplies or services available from only one source or only one supplier with unique capabilities. (5) Demonstration of Unique Qualifications: The continuation of the supply contract will allow the MDG to use the current leased Chemistry analyzer in order to test Patient samples. Validation required includes, calibration, precision/accuracy verification, patient correlation, CHCS interfacing, and Lab Director review. The validation of the analyzer is crucial in maintaining the services provided by the MDG Lab in patient testing. The suggested vendor's reagents and supplies are the only items that will work on the analyzer. The use of any other items would void the warranty, as well as cause harm to the instrument. It would not perform testing correctly and Patient results would be invalid. (6) Description of Solicitation Efforts: IAW FAR 5.102(a) (2), this notice will be posted on the Government-wide Point of Entry (FedBizOpps.gov), but retained in the contract file to   document the rationale for a sole source award. (7)The contracting officer has determined that the anticipated cost to the Government will be fair and reasonable based upon estimated travel costs, and market rates for this type of service. (8)Description of market research: Market Research was conducted to determine commerciality of the product. Chemistry Analyzers are available in the market, however, the current Chemistry Analyzer utilized is needed to continue operations. Therefore renewal of the lease for the existing equipment is recommended. (9) Other supporting facts: IAW FAR 6.302-1(b)(4) Use of this authority may be appropriate in situations such as the following: When there is a reasonable basis to conclude that the agency's minimum needs can only be satisfied by unique supplies or services available from only one source or only one supplier with unique capabilities. (9) Interested Sources: N/A (10) Actions to prevent barriers that may lead to restricted consideration in the future: Because this is a lease renewal, considerations to purchase or lease another Chemistry Analyzer will be made in the future, (11) This justification is accurate and complete to the best of the contracting officer's knowledge and belief. 5352.201-9101 OMBUDSMAN (a) An ombudsman has been appointed to hear and facilitate the resolution of concerns from offerors, potential offerors, and others for this acquisition. When requested, the ombudsman will maintain strict confidentiality as to the source of the concern. The existence of the ombudsman does not affect the authority of the program manager, contracting officer, or source selection official. Further, the ombudsman does not participate in the evaluation of proposals, the source selection process, or the adjudication of protests or formal contract disputes. The ombudsman may refer the interested party to another official who can resolve the concern.   (b) Before consulting with an ombudsman, interested parties must first address their concerns, issues, disagreements, and/or recommendations to the contracting officer for resolution. Consulting an ombudsman does not alter or postpone the timelines for any other processes (e.g., agency level bid protests, GAO bid protests, requests for debriefings, employee-employer actions, contests of OMB Circular A-76 competition performance decisions). (c) If resolution cannot be made by the contracting officer, the interested party may contact the ombudsman, [Insert names, addresses, telephone numbers, facsimile numbers, and e-mail addresses of Center/MAJCOM/DRU/AFRCO/SMC ombudsman/ombudsmen]. Concerns, issues, disagreements, and recommendations that cannot be resolved at the Center/MAJCOM/DRU/SMC ombudsman level, may be brought by the interested party for further consideration to the Air Force ombudsman, Associate Deputy Assistant Secretary (ADAS) (Contracting), SAF/AQC, 1060 Air Force Pentagon, Washington DC 20330-1060, phone number (571) 256-2395, facsimile number (571) 256-2431. (d) The ombudsman has no authority to render a decision that binds the agency. (e) Do not contact the ombudsman to request copies of the solicitation, verify offer due date, or clarify technical requirements. Such inquiries shall be directed to the Contracting Officer.
