Gaming Hosting Services TAC-18-51197 2 of 8 JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY 1. Contracting Activity: Department of Veterans Affairs (VA) Office of Procurement Acquisition and Logistics Technology Acquisition Center 23 Christopher Way Eatontown, NJ 07724 2. Description of Action: The proposed sole source action is for a firm-fixed price (FFP) order for the Veterans Health Administration (VHA) Employee Education System (EES) eLearning Gaming Office. 3. Description of Supplies or Services: The Department of Veterans Affairs (VA), Veterans Health Administration (VHA),Employee Education System (EES) elearning Gaming Office has a requirement to reuse the current hosting data collection metrics baseline out of the Veterans Affairs Virtual Medical Center (VAVMC) for implementation into the Geriatrics, Goals of Care Conversation, and Crash Cart Gaming products. These training modules were developed and delivered from 2016-2017 and hosted in the VAVMC. This hosting solution provides the collection of user data metrics and the export of reports. The main scope is to leverage current VAVMC user data collection functionalities by incorporating these capabilities into the Geriatrics, Goals of Care Conversation, and Crash Cart Gaming products. The Gaming Educational training products were designed, developed, tested and delivered as educational training applications to ensure that VA Healthcare Providers and staff personnel are adequately trained in specific medical procedures and/or processes as outlined in the learning objectives for each game. At the time of initial deployment the Games were hosted and serviced by the VAVMC providing VHA the ability to capture user data and the exporting of reports. Since the initial Gaming product baselines, the VAVMC no longer can support the collection of user data and the exporting of such data in the form of reports. The period of performance is 12 months from the date of award. 4. Statutory Authority: 5. Rationale Supporting Use of Authority Cited Above: Based on market research, as described in paragraph 8 of this justification, it was determined that limited competition is available amongst Geriatrics,Gaming Goals of Care Conversation and Crash Cart Gaming products authorized resellers. The proposed source action is for Engineering and Computer Simulations (ECS), Inc. 11825 High Tech Avenue, Suite 250, Orlando, FL 32817. ECS currently owns the source code, therefore is the only one responsible source that must be used for the contracting vehicle in place for this effort and did not include the purchase of source code data. Due to the proprietary nature of the source code, only ECS can provide the necessary implementation of the Geriatrics, Goals of Care Conversation, and Crash Cart Gaming products for VAVMC. 6. Efforts to Obtain Competition: Market research was conducted, the details of which are in section 8 of this justification. This effort did not yield any additional sources that can meet the Government s requirements; therefore, no competition is anticipated for this acquisition. In accordance with FAR 5.301 and FAR 8.405-6(a)(2), notice of award of the resulting order will be synopsized on the Federal Business Opportunities website and this justification will be made publicly available within 14 days of award. 7. Actions to Increase Competition: The Government will continue to conduct market research to ascertain if there are changes in the market place that would enable future actions to be competed for this gaming hosting services. 8. Market Research: Market research was conducted by the Governments technical expert, Aurelio Maldonado during February 2018 by reviewing the capabilities of Serious Educational Games Prime Contract holders such as Systems Kinetics and Engineering, Creative Veteran Productions, Advanced Computer Learning Company, and MTS, Inc. Though all of these companies are likely capable of providing the required development, none have access to the proprietary source code used in the Engineering and Computer Simulations (ECS) cloud environment.On August 9, 2018, the Government sent ECS a market research inquiry to provide information on whether they own the source code and if they are the sole developer of Gaming Hosting Services. On August 9, 2018, ECS responded and confirmed that they own the source code and are the sole developer for Gaming Hosting Services. On September 5, 2018, the Contract Specialist contacted ECS to inquiry whether ECS was the sole owner of the Source Code. On September 6, 2018, ECS advised that they are the sole owner of the Source Code and do not have any authorized resellers. One of the products specifically referenced in the email was Gaming Hosting Services. As a result, the market research confirmed that ECS is the only source provider capable of meeting the Government s requirements for this effort. 9. Other Facts: None. 10. Technical and Requirements Certification: I certify that the supporting data under my cognizance, which are included in this justification, are accurate and complete to the best of my knowledge and belief.
