Description
THIS IS A COMBINED SYNOPSIS/SOLICITATION FOR COMMERCIAL ITEMS PREPARED IN ACCORDANCE WITH THE FORMAT IN FEDERAL ACQUISITION REGULATION (FAR) SUBPART 12.6-STREAMLINED PROCEDURES FOR EVALUATION AND SOLICITATION FOR COMMERCIAL ITEMS-AS SUPPLEMENTED WITH ADDITIONAL INFORMATION INCLUDED IN THIS NOTICE. THIS ANNOUNCEMENT CONSTITUTES THE ONLY SOLICITATION; QUOTATIONS ARE BEING REQUESTED, AND A WRITTEN SOLICITATION DOCUMENT WILL NOT BE ISSUED. This solicitation is a Request for Quotations (RFQ). The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-100 effective August 22, 2018. Simplified acquisition procedures will be utilized. This requirement is being procured using full and open competition. Full and open competition is appropriate. This is a brand name or equal requirement. The brand name equipment referenced is manufactured by a large business. In addition, market research has not revealed equivalent equipment manufactured by small business. The associated North American Industry Classification System (NAICS) code for this procurement is 334516 and the small business size standard is 1,000 employees. The non-manufacturer rule does not apply to this procurement. This is a BRAND NAME OR EQUAL procurement. Brand name or equal is intended to be descriptive and not restrictive, and is intended to describe the performance capability and characteristics of the equipment required by the Government. All responsible quoters shall provide a quotation for the following line items. LINE ITEM 0001: Quantity 1 EA Liquid Sample Dispersion Unit, Malvern Panlytical Model #MAX3150, or equivalent, meeting or exceeding all of the following salient characteristics. All equipment must be new. Used or remanufactured equipment shall not be considered for award. -Small volume liquid dispersion unit to assist in conducting laboratory experiments; -120 ML manually controlled dispersant unit; -Internally controllable by Malvern Panalytical Ltd Mastersizer 3000 software; -External Control Module to control stirring - 350-3500 rpm speed; -Stirring speed display on module; -Maximum Measurable Particle Size - 600 microns; -Chemical Compatibility Code A2. LINE ITEM 0002: INSTALLATION The Contractor shall install the unit. Installation shall include, at a minimum, uncrating/unpackaging of the unit, set-up and hook-up of the unit and the controlling software, demonstration of salient characteristics, and removal of all trash. Installation shall be completed not later than 60 days from the date of award at the following site: NIST, Hollings Marine Laboratory, Charleston, SC. Installation shall be scheduled, in advance, with the Technical Point of Contact (TPOC) to be identified at the time of award. SHIPPING INSTRUCTIONS Delivery terms shall be FOB Destination. The Contractor shall ship to the following address: PAYMENT SCHEDULE Partial payments shall not be authorized. One single lump sum payment shall be made. A proper invoice shall be approved for payment if equipment has been received, installation has been successfully completed, and all salient characteristics have been demonstrated. The invoice will not be approved if any items are outstanding, and/or have been rejected. EVALUATION CRITERIA AND BASIS FOR AWARD The Government intends to award a purchase order, resulting from this solicitation on a lowest price/ technically acceptable basis. TECHNICALLY ACCEPTABLE Quotations shall be evaluated to determine whether or not each quotation is technically acceptable. Technically acceptable means that the Contractor has quoted equipment that meets all salient characteristics and meets the Government's need in the same manner as the brand name. PRICE Price shall be evaluated for all quoters whose quotations are determined technically acceptable. Price will be evaluated to determine that the total price is consistent with the technical portion of the quotation, and that the total price is a fair and reasonable overall price to the Government. REQUIRED SUBMISSIONS All quoters shall submit the following within their quotation: 1. For the purpose of evaluation of Technical Acceptability, the technical quotation, must include technical descriptions, product literature, and/or documentation that clearly demonstrates that the quoted equipment meets all required salient characteristics. 2. For the purpose of evaluation of Price, the Contractor shall provide a firm-fixed price, F.O.B. Destination price quotation for all line items. The Contractor shall provide a unit price and total amount for each line item, and the aggregate total for all line items. 3. This is an Open-Market Combined Synopsis/Solicitation. The Government intends to award a purchase order resulting from this Combined Synopsis/Solicitation, that will include the terms and conditions that are set forth herein. In order to facilitate the award process, ALL quotes shall include a statement regarding the terms and conditions herein as follows: a. The offeror shall state "The terms and conditions in the solicitation are acceptable to be included in the award document without modification, deletion, or addition." OR b. The offeror shall state "The terms and conditions in the solicitation are acceptable to be included in the award document with the exception, deletion, or addition of the following:" Offeror shall list exception(s) and rationale for the exception(s) Please note that this procurement IS NOT being conducted under the GSA Federal Supply Schedule (FSS) program or another Government-Wide Area Contract (GWAC). If an offeror submits a quotation based upon an FSS or GWAC contract, the Government will accept the quoted price. However, the terms and conditions stated herein will be included in any resultant Purchase Order, not the terms and conditions of the offeror's FSS or GWAC contract, and the statement required above shall be included in the quotation; 4. The Dun and Bradstreet Number (DUNS number) for the quoter's active System for Award Management (SAM) registration. Quoters must have an active registration at www.SAM.Gov to receive an award; 5. Quoters shall include a completed copy of the attached provision, "Representation by Corporations Regarding an Unpaid Delinquent Tax Liability or a Felony Conviction Under Any Federal Law (Class Deviation) (March 2015)" with their quotation; 6. The Contractor's business size in accordance with the NAICS code and size standard identified herein. 7. The country of origin for the quoted equipment.
