INTRODUCTION THIS IS A PRE-SOLICITATION NON-COMPETITIVE (NOTICE OF INTENT) SYNOPSIS TO AWARD A CONTRACT OR PURCHASE ORDER WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME). The National Institutes of Health (NIH), Clinical Center (CC), Office of Purchasing and Contracts (OPC) on behalf of the Department of Laboratory Medicine (DLM), Clinical Center (CC) at the National Institutes of Health (NIH) intends to negotiate and award a contract without providing for full and open competition (Including brand-name) to: Sebia Inc. 1705 Corporate Drive, #400 Norcross, GA 30093 NORTH AMERICAN INDUSTRY CLASSIFICATION SYSTEM (NAICS) CODE The intended procurement is classified under NAICS code 334516 with a Size Standard of 1,000 employees. REGULATORY AUTHORITY The resultant contract will include all applicable provisions and clauses in effect through the Federal Acquisition Circular (FAC) 2005-99-1, July 16, 2018. This acquisition is conducted under the procedures as prescribed in FAR subpart 13-Simplified Acquisition Procedures at an amount not exceeding the simplified acquisition threshold ($250,000). STATUTORY AUTHORITY This acquisition is conducted under the authority of the Federal Acquisition Regulation (FAR) Part 13-Simplified Acquisition Procedures, Subpart 13.106-1 (b) (1), Soliciting from a single source and is not expected to exceed the simplified acquisition threshold. Contracts awarded using FAR Part 13-Simplified Acquisition Procedures are exempt from the requirements of FAR Part 6-Competition Requirements. GENERAL INFORMATION 1. Title: Sebia Hydrasys Electrophoresis reagents 2. Background Information: The Clinical Center is a clinical research hospital providing medical services for patients participating in human research protocols of the National Institutes of Health (NIH). The clinical center provides patient facilities and services for clinical investigators by the NIH Institutes, conducts research in related areas and supervises residency and other training programs. DLM is responsible for providing clinical laboratory services for patients at the NIH Clinical Center. DLM provides state-of-art laboratory testing in support of Clinical Center patient care and serves as a center of excellence in research and training in laboratory medicine, particularly in the areas, which utilize the unique strengths of the NIH. 3. Purpose or Objective: The Department of Laboratory Medicine (DLM) is seeking to obtain reagents from Sebia for the use in Hydrasys electrophoresis instruments. These are the only known supplies that will fit into the DLM's Sebia Electrophoresis instrumentation consisting of 3 Hydrasys2 units(S/N 1151, SN1152 and SN 1241), GELSCAN and Phoresis software. 4. Period of Performance: A base period of one year beginning on or around 09/15/2018. CONTRACTOR REQUIREMENTS (SCOPE OF WORK) Independently and not as an agent of the Government, the vendor shall supply the reagents in a timely fashion to allow for proper quality control and continuation of laboratory testing in support of Clinical Center patient care. The reagents should come quarterly and can be determined by the lead technologist as to what should be included in the orders. These are to be used in the Department of Laboratory Medicine in Electrophoresis/ Special chemistry section of Clinical Chemistry Service. The vendor shall deliver reagents, kits, and consumables to DLM, located at 10 Center Dr. Bldg. 10 Room 2C-306, Bethesda, MD, 20892 (inside delivery), Special chemistry/Electrophoresis section. The following reagents, kits, controls and consumables are necessary for the instrumentation on hand: HYPERGAMMA CONTROL SERUM (5x1ml) NORMAL CONTROL SERUM (5x1 ml) CSF ANTI IGG (.66ml) CSF CONTROL (0.5 ml) FIXATIVE AND IF ANTISERA (SM) (SET) BJ ANTISERA SET Kf-Lf (SM) HYDRAGEL 4 IF (SM) WO/AS (40T) HYDRAGEL 3 CSF ISOFOCUSING (30T) HYDRAGEL 15 PROTEIN B1 + B2 (150 TEST) HYDRAGEL 9 CSF ISOFOCUSING (90T) HYDRAGEL 9 IF (SM) WO/AS (90T) ANTI-IgD ANTI- IgE FLUIDIL 5 ml HYDRASYS WASH SOLUTION (10 VIALS) DESTAIN SOLUTION (10 VIALS) SCAN CONTROL FILM - Kit have configurations of 15, or 30 samples per gel and 4, or 9 for immunofixation assays - Shelf life is at least 18 months in order to make the test volumes cost effective - Sebia offers extensive agarose gel electrophoresis test menu allowing full workload consolidation. - Electrophoresis kits include all necessary reagents that are either ready to use or are liquid concentrates (meaning they only require the addition of DI water). CONTRACTING WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME) DETERMINATION Sebia is the only known vendor for the reagents for Sebia Electrophoresis Systems. These kits, reagents and supplies are used in patient care for electrophoresis and immunofixation testing. These are the only supplies that will fit into the current DLM special chemistry testing instrumentation, any other supplies could cause delay in testing for specific multiple myeloma, multiple sclerosis and other protocols. Securing these products is imperative in meeting the needs of the Chemistry Service as these products are sensitive and highly specific to its semi-automated agarose gel electrophoresis instrumentation. The determination by the Government to award a contract without providing for full and open competition is based upon the market research conducted as prescribed in FAR Part 10-Market Research. CLOSING STATEMENT This synopsis is not a request for competitive proposals. However, interested parties may identify their interest and capability to respond to this notice. Responses to this notice shall contain sufficient information to establish the interested parties' bona-fide capabilities for fulfilling the requirement and include a technical proposal, a cost-price proposal, the period of performance, the Dun & Bradstreet Number (DUNS), the Taxpayer Identification Number (TIN), and the certification of business size. All offerors must have an active registration in the System for Award Management (SAM) www.sam.gov. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. The information received will normally be considered solely for the purposes of determining whether to proceed on a non-competitive basis or to conduct a competitive procurement. All responses must be received by September 12, 2018, 1:00 PM Eastern time and must reference solicitation number 18-011601.
