- RFQ - Purchase of TBERD 5800 for Camp Zama-Sasebo-Iwakuni, Yokota Air Base, Japan Purchasing Agency: 374th Contracting Squadron/PKBB Bldg. 620, Yokota Air Base, Fussa-shi, Tokyo 197-0001 Japan 1. This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued. 2. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-99, effective 16-Jul-2018. The DFARS provisions and clauses are those in effect to DPN 20180629, effective 29-Jun-2018. The AFFARS provisions and clauses are those in effect to AFAC 2018-0525, effective 25-May-2018. 3. The North American Industry Classification System (NAICS) code for this procurement is 334515. There is no set aside for this RFQ in accordance with FAR 19.000(b) as this contract will be performed solely in Japan. 5. The Government intends to make award to the lowest priced offeror who is technically acceptable as described below. Technical Acceptability means that a technical expert will review the quote to determine if the product meets the Government's minimum needs on a pass/fail basis. The following factors will be used in the evaluation process: 1. Price: Total Lowest Price 2. Technical: The Government's Minimum Requirements: Each quote will be evaluated for technical acceptability based on the attached Salient Characteristics. The submitted descriptive literature shall not exceed 10 pages in length. (b) Technical Acceptability Factor. The government will evaluate technical offers on a pass/fail basis and assign an Acceptable or Unacceptable rating as described in Table 1 below. Table 1. Technical Ratings Rating Description Acceptable Offer meets the requirements of the solicitation. Unacceptable Offer does not meet the requirements of the solicitation. (c) To be considered for award, offers of "equal" products, including "equal" products of the brand name manufacturer, must meet the salient physical, functional, or performance characteristic specified in this solicitation; clearly identify the item by brand name, if any; and make or model number. Include descriptive literature such as illustrations, drawings, or a clear reference to previously furnished descriptive data or information available to the Contracting Officer; and clearly describe any modification the Offeror plans to make in a product to make it conform to the solicitation requirements. Mark any descriptive material to clearly show the modification. The Contracting Officer will evaluate "equal" products on the basis of information furnished by the Offeror or identified in the offer and reasonably available to the Contracting Officer. (d) Comptroller General Examination of Record The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records -- Negotiation. (1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract. (2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. (End of clause) AFFARS 5352.201-9101 OMBUDSMAN (Jun 2016) (a) An ombudsman has been appointed to hear and facilitate the resolution of concerns from offerors, potential offerors, and others for this acquisition. When requested, the ombudsman will maintain strict confidentiality as to the source of the concern. The existence of the ombudsman does not affect the authority of the program manager, contracting officer, or source selection official. Further, the ombudsman does not participate in the evaluation of proposals, the source selection process, or the adjudication of protests or formal contract disputes. The ombudsman may refer the interested party to another official who can resolve the concern.
