Description
The U.S. EPA, Office of Administration and Resources Management (OARM) intends to negotiate on a sole source basis with Beatty, Harvey, Coco Architects, LLP, a small business, to provide a redesign of the Seawater Pump Systems Relocation under the authority of 41 U.S.C. 3304(a)(1). EPA requires a redesign of a Beatty, Harvey, Coco (BHC) Architects, LLP original design for a Seawater Pump Systems Relocation due to a previously unknown environmental impact presented by the State of Rhode Island and the U.S. Army Corps of Engineers. BHC created the original design documents under Contract EP-C-12-33, Task Order 15 in accordance with EPA requirements. The design was submitted to the State of Rhode Island and the U.S. Army Corps of Engineers for review and approval. The State of Rhode Island and U.S. Army Corps of Engineers rejected the original design due to a previously unknown environmental impact. BHC, as EPA's representative, negotiated with the State of Rhode Island and U.S. Army Corps of Engineers regarding the needed changes to the design to accommodate the new requirements. Due to the length of time it took to negotiate with the State of Rhode Island and the U.S. Army Corps of Engineers, the contractual mechanism for this work expired and cannot be extended. Beatty, Harvey, Coco (BHC) Architects, LLP is the only design firm that can redesign the Seawater Pump Systems Relocation design documents because the modifications to the design are based on BHC's original design and the discussions/negotiations they had as EPA's representative with the State of Rhode Island and the U.S. Army Corps of Engineers. BHC is uniquely qualified to adjust their original design to accommodate the new requirements. Beatty, Harvey, Coco (BHC) Architects, LLP is the only known source able to satisfy the need for the redesign of the Seawater Pump Systems Relocation. THIS NOTICE IS NOT A REQUEST FOR QUOTATION. However, any firm believing itself capable of providing the redesign of the Seawater Pump Systems Relocation based on the original BHC Design and knowledge of the negotiations between BHC, as EPA's representative, and the State of Rhode Island and U.S. Army Corps of Engineers may submit technical documentation to establish their capability. Such documentation must be submitted to the Contracting Officer within 15 calendar days of electronic posting of this notice. A determination not to compete the proposed requirement based upon responses received will normally be considered solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement or to proceed on a sole source basis. Documentation should be submitted in writing to Scott Tharp via email at tharp.scott@epa.gov. Telephone responses will not be honored.
