- Description of Custom Sight Glasses This is a special notice prepared in accordance with Federal Acquisition Regulation (FAR) 5.2 "Synopses of Proposed Contract Actions." US Army Corps of Engineers, Portland District, intends to award a sole-source, Firm-Fixed Price contract to Applied Industrial Technologies. The purpose of this acquisition is to provide custom Magtech Sight Glasses for the John Day Dam Project. The statutory authority for this non-competitive acquisition is 10 U.S.C 2304(c)(1) as implemented by FAR 13.106-1(b) for purchases not exceeding the simplified acquisition threshold. Furthermore, in accordance with FAR 6.302-1 (b)(1)(ii), the item to be purchased is available from only one source. A SOLICITATION WILL NOT BE POSTED The Government intends to proceed with this sole source action. The NAICS code is 334513, Instruments and Related Products Manufacturing for Measuring, Displaying, and Controlling Industrial Process Variables. The size standard in number of employees as defined by the U.S. Small Business Administration is 750. THIS NOTICE IS NOT A REQUEST FOR COMPETITVE PROPOSLS OR QUOTATIONS. Interested concerns must show clear and convincing evidence that competition of this requirement would be advantageous to the Government. All responsible sources may submit a capability statement, proposal or quote to the purchasing agent before the notice end date. If no affirmative written responses are received by 12:00 PM Pacific Time on 05 September 2018 an award will be made without further notice. Oral communications are not acceptable in response to this notice. A determination by the Government not to compete this proposed requirement is solely within the discretion of the Government. The U.S. Army of Corps of Engineers is not responsible for any costs incurred by responding to this notice.
