- NATIONAL NUCLEAR SECURITY ADMINISTRATION NATIONAL NUCLEAR SECURITY ADMINISTRATION OFFICE OF SECURE TRANSPORTATION JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION Repair Services for the Magnum Universal Night Sights (MUNS) I. REQUESTING OFFICE The Office of Secure Transportation (OST) of theUnited States Department of Energy (DOE)/ National Nuclear Security Administration (NNSA) has a service requirement to repair and retrofit its inventory of Magnum Universal Night Sights (MUNS). OST plans to acquire these services by means of other than full and open competition. The contracting activity is the NNSA Services Acquisition Branch Field Program Section OST Team, NA-APM-124.2. This document sets forth the justification and approval for the use of one of the exceptions to full and open competition allowed under the Competition in Contracting Act (CICA) of 1984, Public Law 98-369. II. NATURE OF ACTION BEING APPROVED This document sets forth the justification and approval of the use of one of the exceptions to full and open competition allowed under CICA. This contract action is for repair services. OST maintains an inventory of approximately ninety (90) AN/PVS-27 MUNS which were procured in 2012 for operations and readiness training.1 The AN/PVS-27 MUNS is a high resolution clip-on night vision device manufactured by FLIR which mount to any MIL-STD rail just forward of the riflescope. A recent OST inspection revealed that a majority of the imaging tubes associated with the AN/PVS-27 MUNS are misaligned. As a result, the MUNS are currently not suitable for OST mission operations and training. Therefore, at this time, OST has an urgent need to correct the misalignment of the imaging tubes for each AN/PVS-27 MUNS. Additionally, OST has a need to retrofit one AN/PVS-27 MUNS to the next generation imaging tube. Because FLIR is the sole manufacturer and the only authorized service provider for the AN/PVS-27 MUNS, there is an urgent need to procure the repair services. FLIR Surveillance Inc. is a large business based on the NAICS Code 811219 and size standard of 500 employee. FLIR is located at 25 Esquire Road, North Billerica, MA 01862. The estimate cost of this effort is approximately $90,000. III. DESCRIPTION OF SERVICES/SUPPLIES The OST Federal Agents (FA) are responsible for the safe and secure transportation of nuclear weapons, special nuclear materials, and weapons components/assemblies between production facilities and Department of Defense facilities using ground and air modes of transportation. Because the FAs are responsible for preventing the theft, sabotage or takeover of the nuclear weapons/materials, it is critical that the AN/PVS-27 MUNS are repaired and returned to service. The AN/PVS-27 MUNS assist the FAs with target acquisition, reconnaissance, and surveillance. OST plans to ship its defective MUNS to FLIR's authorized repair facility where FLIR will perform the authorized repairs by realigning the imaging tubes in each MUNS and ensure that the MUNS' boresight characteristics are within normal manufacturing specifications for accuracy and repeatability. All 1 Because the AN/PVS-27 MUNS were procured in 2012, all applicable warranty periods have expired. repaired AN/PVS-27 MUNS will be shipped back to OST Logistics at 11408 Roberts Blvd Fort Smith, AR. 72916. The estimated cost to repair each AN/PVS-27 MUNS is approximately $900.00. Additionally, OST will request that one AN/PVS-27 MUNS be converted to the latest generation white phosphorus tube. The estimated cost to install the white phosphorus tube is approximately $9,000.00. IV. AUTHORITY 41 USC 3304(a)(1), as implemented by the Federal Acquisition Regulation (FAR) Subpart 6.302-1(a)(2) 'Only one responsible source and no other supplies or services will satisfy Agency requirements,' permits contracting without providing for full and open competition when only one responsible source and no other type of property or service will satisfy the needs of the current contract. V. APPLICATION OF AUTHORITY FAR 6.302-1(b)(1)(i) specifies full and open competition need not be provided for when there is a reasonable basis to conclude that the agency's minimum needs can only be satisfied by unique supplies or services available from only one source or only one supplier with unique capabilities. In this case, FLIR is considered a global leader in the design and manufacture of high-performance thermal imaging systems and visible-light imaging systems. At this time, FLIR is the only authorized original equipment manufacturer who can perform the needed repairs to correct the offset and/or deviation of the AN/PVS-27 MUNS from its original manufacturing specifications. VI. EFFORTS TO IDENTIFY ADDITIONAL SOURCES A Notice of Intent Synopsis to Award to a Sole Source will be posted through FedConnect that notifies the public of the Government's intent to award this action by means of other than full and open competition in accordance with FAR 5.201. This approved justification will then be posted in accordance with FAR 6.305. In addition, OST has determined that Knights Armament Company (KAC) has the capability as a family owned and operated small business company to perform product evaluations. However, KAC's capabilities is limited to testing the AN/PVS-27 MUNS alignment to determine the degree of offset or deviation from manufacturer specifications. KAC lacks the ability to perform in-house repairs since KAC is not the manufacturer of the AN/PVS-27 MUNS. Finally, OST also contacted the Defense Logistics Agency (DLA) repair facility and was informed that DLA cannot perform the repairs. Accordingly, at this time, FLIR is the only authorized manufacturer who can perform the needed repairs. VII. DETERMINATION OF PRICE AS FAIR AND REASONABLE The Contracting Officer will make a determination of price reasonableness utilizing various methods to include a price analysis incorporating a technical analysis; an Independent Government Cost Estimate, and other market research. Per FAR 52.215-20(1)(ii) Requirements for Cost or Pricing Data or Information Other than Cost or Pricing Data (Oct 2010) is not required for commercial items. Accordingly, it is the determination of the CO that the anticipated price will be fair and reasonable based on a price analysis of the contractor's proposal when compared with the Government's IGE. VIII. MARKET SURVEYRESULTSANDDOCUMENTATION For the reasons mentioned in Section VI, no additional market surveys are required at this time. IX. OTHER FACTS None X. STEPS TO FOSTER COMPETITION At this time, the government is not aware of any other manufacturer authorized to perform the repairs as discussed. Any interested parties will have the opportunity to respond to the Notice of Intent. XI. CERTIFICATION All supporting data of a technical nature (including the market research) is the responsibility of the technical representative. The information in this Justification for Other than Full and Open Competition is certified as accurate and complete to the best of my knowledge and belief.
