- Atch 4 - CRWL FBO Comment Resolution Matrix Atch 3 - Draft SMC Solicitation and Contract Language Atch 2 - Draft CRWL, SMC Instruction Atch 1 - Sec. 1612, FY18 NDAA FBO Special Notice, Industry/Public Early Engagement Opportunity BACKGROUND: Section (Sec.) 1612 of the Fiscal Year (FY) 2018 National Defense Authorization Act (NDAA) (P.L. 115-91) requires the Commander of Air Force Space and Missile Systems Center (SMC) to establish and maintain an Air Force Space Contractor Responsibility Watch List (CRWL). DISCUSSION: In accordance with Sec. 1612 (a), the intent of the CRWL is to list contractors (and subcontractors) with a history of poor performance on space procurement and research, development, test, and evaluation contracts. When a contractor's (or subcontractor's) performance is determined to be uncertain due to certain performance issues, the SMC Commander may place that contractor (or subcontractor) on the CRWL. Approval of the SMC Commander is required to initiate applicable procurement actions with contractors (and subcontractors) listed on the CRWL. EARLY ENGAGEMENT: Draft CRWL implementation documents, as described below, are provided as attachments to this notice. SMC welcomes industry input on the attached CRWL comment matrix and will consider inputs received in development of the final implementation documents. However, SMC will not be providing responses to comments received in response to this notice. Respondents will identify themselves by providing a company or organization name and a POC name and email in the CRWL Comment Resolution Matrix (Attachment 4). Likewise, respondents will identify the document, page number, and paragraph number of the text to which they are commenting in the CRWL comment matrix. ATTACHMENTS: 1. FY2018 NDAA Sec. 1612, provided for reference. 2. Draft SMC Instruction (SMCI), Air Force Space Contractor Responsibility Watch List (CRWL). The draft SMCI establishes applicability of the instruction, outlines roles and responsibilities within SMC, provides procedures for placing a contractor (or subcontractor) on, and removing them from, the CRWL, and describes the effect of listing a contractor (or subcontractor) on the CRWL. Upon approval of the SMC Commander, the SMCI will be published on the AF E-Publishing site: http://www.e-publishing.af.mil/Product-Index/. 3. Draft SMC Solicitation and Contract Language. The draft solicitation and contract language will become internal SMC mandatory procedures. Contracting officers will be required to include the mandated language in solicitations and resultant contracts as directed. 4. CRWL Comment Resolution Matrix.
