- INVITATION to BID 24-MONTH TERM SALE ** Specified Duration of Sale Agreement: 24 MONTHS Scrap: Approx. 4,000 lbs lead-acid batteries are generated annually Award Announcement Date: 27 July 2018 For Inspection Appointment: Call 413-557-3951 Bid Close Date: 17 August 2018 Only email and mail bids accepted. Email Bids to: champanine.saviengvong@us.af.mil Mail Bids to: Westover Air Reserve Base, 439 MSG/CEV, 250 Patriot Ave, Box 40, Chicopee, MA 01022-1670 TRANSPORTATION MUST BE PROVIDED BY BIDDER. Material Location: Westover ARB ** In a 'term' sale, Seller offers an estimated quantity over a period of time, and Buyer offers a unit price per quantity ($/pound) for an estimated amount over that specified period. General Provisions •1. Material may be inspected by appointment as noted above at Westover ARB. •2. Bid response must be on company letterhead and signed by company official. •3. No bid deposit is required. WEIGHT CERTIFICATION : Weight tickets must be provided to the Government. DEFAULT : Material must be picked up within two weeks of Government contacting Vendor of needed pickup. Payment must be received NLT ten (10) calendar days after material pick-up. If the Purchaser fails to pay for and or remove the commodity within the time allowed by this agreement, Westover ARB Qualified Recycling Program will send the Purchaser a default notice that must be cured within ten (10) days from mailing date. If Purchaser fails to cure default within the stated period, the Purchaser shall lose all rights, title and interest, which he may otherwise have acquired in and to such property as to which a default has occurred. INSURANCE : The Purchaser/Transport Agent shall be required to provide and maintain during the entire period of this contract, at least the motor vehicle liability and bodily injury insurance as required by State and local laws. CONFIDENTIALITY : Any and all information made available to the purchaser/representatives as a result of this contract, shall be kept confidential. Failure to comply with this provision is a basis for termination of the sales agreement. TERMINATION : Sales agreement is subject to termination if Westover ARB Qualified Recycling Program receives two (2) or more valid, written complaints from Commanders, professional staff about the purchaser/representatives to include but not limited to: rudeness, lack of knowledge of recyclables, tardiness, and failure to appear on schedule days. We reserve the right to direct removal of the purchaser under this contract for misconduct, violation of confidentiality, security reasons, or whose presence has been detrimental to the interests of Westover ARB Qualified Recycling Program. TRANSPORTATION : The Purchaser/Transport Agent must possess a valid driver's license, insurance and registration of vehicle for access Westover ARB. SPILLAGE: The Purchaser/Transport Agent shall be responsible for any spills/leaks resulting from their work while on Westover ARB and agrees to expeditiously cleanup all spills /leaks to the satisfaction of the Westover ARB Spill Response Manager or designee and in compliance with all applicable federal, state and local laws and regulations. The cleanup shall be at no cost to the government and the Purchaser/Transport Agent agrees to hold the government harmless and indemnify the government for any costs incurred as a result of or incidental to, any handling, removal, transportation, storage, treatment or disposal of scrap materials performed by the purchaser/representative. In the case of imminent health and safety dangers, the government reserves the right to take immediate action to contain and minimize a spill. Upon such action by the government, the purchaser/representative shall reimburse the government for costs incurred upon submission of an actual costs bill. In the event of a spill/leakage the Purchaser/Transport Agent may request support from the installation on a cost reimbursable basis. All spill/leakage incidents must be reported immediately to Westover Fire Services 413-557-1117 or 413-557-3818. INDEMNIFICATION : Purchaser aggress to hold and save harmless at all times the United States (including Westover ARB Qualified Recycling Program, its agents, representative, and employees) against any and all claims, demands, suits, judgments, costs, charges, and expenses arising out of or in connection with any loss, damage or injury resulting from the negligence or other fault of the purchaser, its agents, representatives, and employees. The purchaser will release the US Government and Westover ARB Qualified Recycling Program from any and all liability. DANGEROUS PROPERTY : Purchasers are cautioned that articles or substances of a dangerous nature may remain in the property regardless of the care exercised to remove same. The Government assumes no liability for damages to property of the Purchaser, its employees, or to any other person arising from or affiliated with the purchase, use or disposition of this material. The Purchaser shall hold the Government harmless from any and all such demands, suits, actions, or claims arising from or otherwise relating to the purchase of this material.
