- Justification and Approval for Sole Source Statement of Work Synopsis for Intraocular Lens (IOL) Consignment BPA: This is a combined Sole Source Synopsis / Solicitation published for informational purposes only. This proposed action is for the Blanket Purchase Agreement (BPA) of the Intraocular Lens (IOL) Consignment on Wright-Patterson Air Force Base. See Attachment 1, Statement of Work. The Government intends to solicit and negotiate with only one source under the authority of 10 U.S.C. 2302b, Implementation of Simplified Acquisition Procedures (41 U.S.C. 1901). This proposed procurement will be a Sole Source under North American Industry Classification System Code (NAICS) 339113: Surgical Appliance and Supplies Manufacturing. Business size standard for NAICS 339113 is 750 employees. PSC/FSC code: 6515: Medical and Surgical Instruments, Equipment, and Supplies. There are two proposed sources due to surgeons being trained on either Alcon or AMO lenses, but not both. The first proposed source is Alcon Laboratories, located at 6201 South Freeway, Fort Worth, TX 76134. The second proposed source is AMO Sales & Services, Inc. (J&J Vision Care), located at 1700 E. St Andrews Place, Santa Ana, CA 92705. A determination by the Government not to compete this proposed BPA based upon responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. This notice of intent is not a request for competitive quotations. However, all responsible sources may submit a capability statement, proposal, quotation or exception to the intent to purchase on a sole source basis, which shall be considered by the Government, if received by Friday, 10 August 2018, 02:00 P.M. EST. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. In order to comply with FAR 5.207(c)(15), the reason for lack of competition is as follows: The performing surgeons at Wright-Patterson Medical Center have only been trained on IOLs from the two suppliers listed above. There is only one other major market participant for IOL lenses. This company offers silicone-based lenses, however these present medical contradictions that WPAFB surgeons have determined to be contrary to best medical interests of patients. A Sources Sought was posted to www.fbo.gov in an attempt to find alternative vendors that could meet the consignment requirement. One response was received, however the company did not provide evidence that that they had experience with IOL Consignment Agreements. Also, both AMO and Alcon expressed that returns and exchanges of unused property is only possible where the title of such property has not transferred from the manufacturer to any other party. Therefore, the proposed sole sources are the only known sources able to satisfy the Government's requirements. Delivery Schedule: 14 Days After Contract Award Delivery Destination: ATTN: MEMO 4881 Sugar Maple Drive Bldg. 830, Area A WPAFB, OH 45433-5529 Delivery Type: FOB Destination (As defined in FAR 2.101 - Definitions, the seller or consignor is responsible for the cost of shipping and risk of loss.) Inspection and Acceptance: Both inspection and acceptance will be by the Government at Destination. Important Notice to Contractors: All prospective awardees are required to register at the System for Award Management (SAM) and to maintain active registration during the life of the contract. SAM can be accessed at https://www.sam.gov. For a detailed description of the applicable SAM requirements and payment information, please review the clauses included in the attached solicitation.
