- INTRODUCTION THIS IS A PRE-SOLICITATION NON-COMPETITIVE (NOTICE OF INTENT) SYNOPSIS TO AWARD A CONTRACT WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME). The National Institute on Drug Abuse (NIDA), National Institute of Neurological Disorders & Stroke (NINDS) Section intends to solicit by a request for quotation from ThermoFisher through their subsidiary Life Technologies Corporation for award on or around August 22, 2018. The purpose of this purchase order will be to provide the National Institute of Neurological Disorders and Stroke (NINDS) with Quantstudio 6 Flex AB Assurance maintenance plan. NORTH AMERICAN INDUSTRY CLASSIFICATION SYSTEM (NAICS) CODE and SET ASIDE STATUS The intended procurement is classified under NAICS code 811310 with a Size Standard of $7.5 Million. This acquisition is NOT set aside for small businesses. REGULATORY AUTHORITY This acquisition is conducted under the authority of the Federal Acquisition Regulation (FAR) Part 13-Simplified Acquisition Procedures. Contracts awarded using FAR Part 13-Simplified Acquisition Procedures are exempt from the requirements of FAR Part 6-Competition Requirements. FAR Subpart 13.106-1 (b) Soliciting from a single source provides that: For purchases not exceeding the simplified acquisition threshold, Contracting officers may solicit from one source IF the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name OR industrial mobilization). The resultant contract will include all applicable provisions and clauses in effect through the Federal Acquisition Circular (FAC) 2005-98 dated May 31, 2018. DESCRIPTION OF REQUIREMENT PURPOSE AND OBJECTIVES: The contractor shall provide repair service and preventive maintenance and calibration with temperature verification for the Quantstudio 6 Flex machine in the Surgical Neurology Branch (SNB) lab. PROJECT REQUIREMENTS: Independently and not as an agent of the Government, the Contractor shall furnish all the necessary services, qualified personnel, material, equipment, and facilities, not otherwise provided by the Government as needed to perform the Statement of Work below: The contractor shall provide qualified technicians, and any required tools and parts to maintain and repair the Quantstudio 6 Flex on site in the SNB Lab. The technicians shall be able to calibrate and do temperature verification on the 384 well block of this machine. The vendor shall follow the manufacturer's stated protocol in their AB Assurance Plan for maintaining, testing, and repairing the Quantstudio 6 Flex so as not to void the warranty on the machine. The machine must give consistent results so that our protocols that have tests done on it will not have inconsistent results. Contractor shall provide the following support services for one (1) QuantStudio6 Flex (s/n 278861374): 1). Contractor shall provide one (1) annual on-site proactive preventive maintenance per contract period at government's request to keep instrument's peak operation for sensitive, high-precision analysis. This PM also includes 384w block calibration and temperature verification. 2). Contractor shall provide one (1) 6 month calibration service on 384w block per performance period. 3). Contractor shall provide higher priority Remote Service Center support of technical phone support and remote instrument monitoring and diagnostics. 4). Contractor shall provide two day on-site response to on-demand on-site repair visit inclusive of travel, labor and factory-certified replacement parts required to repair QuantStudio6 Flex instrument. 5). Contractor shall provide certified OEM engineers to perform all on-site and telephone or email services. 6). Contractor shall provide software update, maintain the computer, which may mean repair or replacement. Period of Performance: The period of performance is as follows: August 22, 2018 through August 21, 2019 (Base) August 22, 2019 through August 21, 2020 (Option 1) August 22, 2020 through August 21, 2021 (Option 2) August 22, 2021 through August 21, 2022 (Option 3) August 22, 2022 through August 21, 2023 (Option 4) CONTRACTING WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME) DETERMINATION The determination by the Government to award a contract without providing for full and open competition is based upon the market research conducted. Specifically, ThermoFisher, through their subsidiary Life Technologies Corporation, is the only vendor in the marketplace that can provide the services required by NINDS. In accordance with FAR part 10, extensive market research was conducted to reach this determination. Specifically, a sources sought notice was posted to FedBizOpps referencing the above detailed requirements and no responses were received. Additionally, contacts with knowledgeable individuals both in industry and Government revealed no other sources. Finally, a review of the GSA Advantage, Dynamic Small Business Search, and previous government acquisitions returned no results that meet all of the requirements. Therefore, only Thermofisher, through their subsidiary Life Technologies Corporation, is capable of meeting the needs of this requirement. The intended source is: Life Technologies Corporation 5781 Van Allen Way Carlsbad, CA 92008 CLOSING STATEMENT THIS SYNOPSIS IS NOT A REQUEST FOR COMPETITIVE PROPOSALS. However, interested parties may identify their interest and capability to respond to this notice. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. All responsible sources may submit a capability statement, proposal, or quotation which shall be considered by the agency. The information received will normally be considered solely for the purposes of determining whether to proceed on a non-competitive basis or to conduct a competitive procurement. Responses to this notice shall contain sufficient information to establish the interested parties' bona-fide capabilities for fulfilling the requirement and include: unit price, list price, shipping and handling costs, the delivery period after contract award, the prompt payment discount terms, the F.O.B. Point (Destination or Origin), the Dun & Bradstreet Number (DUNS), the Taxpayer Identification Number (TIN), and the certification of business size. All offerors must have an active registration in the System for Award Management (SAM) www.sam.gov. All responses must be received by the closing date and time of this announcement and must reference the solicitation number, HHS-NIH-NIDA-NINDS-NOI-18-5021870.
