- This Sources Sought Notice is for planning and information purposes only and shall not be construed as a commitment or a promise of a contract by the Government. This is not a solicitation. This notice does not constitute an Invitation for Bid (IFB), Request for Quote (RFQ) or Request for Proposal (RFP), nor does it restrict the Government as to the ultimate acquisition approach. The Government will not reimburse respondents for any costs incurred in preparation of a response to this notice. For the purpose of this acquisition, the NAICS code is 541614 Process, Physical Distribution, and Logistics Consulting Services and the small business size standard is $15M. Information received in response to this notice will be used to further define the government's requirement and determine if two (2) or more capable small businesses respond with information sufficient to support a small business set-aside. We encourage all interested large and small businesses capable of satisfying the requirement in full to identify their capabilities in meeting the requirement. Information received as a result of this Sources Sought Notice will be used solely for market research purposes. The Government shall use this market research in determining the best method of procurement, which is part of the acquisition planning process. This Sources Sought Notice is for information purposes only and no award will result from the Sources Sought Notice. This Sources Sought Notice shall be open from July 20, 2018 through August 5, 2018. All responses are due not later than 4:00 PM EDT, August 5, 2018. All responses shall be limited to email correspondence and limited to 10 pages, single spaced in Times New Roman 10 pt font. RESPONSE TO THIS SOURCES SOUGHT NOTICE: In order to be considered responsive to this Sources Sought Notice, please provide a concise capability brief that includes: 1. Name of the firm, point of contact, phone number, email address, DUNS number, a statement regarding small business status (including small business type(s)/certifications(s) such as SDB, 8(a), HUBZone, SDVOSB, WOSB, etc.) under NAICS code 541614. 2. Information in sufficient detail regarding previous experience (indicate whether as a prime contractor or subcontractor) on similar requirements (include size, scope, complexity, timeframe, government or commercial). 3. Identify whether your firm is interested in competing for this requirement as a prime contractor or not. Address any subcontracting, joint ventures or teaming arrangement you may use to perform the requirement to include possible "similarly situated entities" (same small business status) subcontractor(s). 4. Identify how the Government can best structure these contract requirements to facilitate competition by and among all business concerns. 5. Describe the facilities, technical resources, and personnel your firm and/or subcontractors or teaming partners possess that would enable you to provide the required services. 6. Identify your firm's range of contingency fee rates The narrative shall draw direct correlations and relate directly to the requirement described herein, and shall directly demonstrate the interested contractor's capabilities to perform the effort herein through the examples of past experience provided. Failure to provide the information as requested by the due date will result in the Government's continuance of the acquisition planning phase, without giving consideration to the capabilities of the contractors who do not respond timely. BACKGROUND: Section 322 of the Transportation Act of 1940, as amended (31 U.S.C. 3726) enables GSA to recover overcharges administratively determined in the post-payment audit. It provides GSA with the authority to examine, settle, and adjust accounts involving payment for transportation and related services for the United States Government and; to adjudicate and settle transportation claims by and against the United States Government. GSA's post-payment audit is performed using the information from transportation invoices and its applicable rate authority, which determines the payment authorized for charges billed by the Transportation Service Provider (TSP) for services ordered by the Government GSA's Transportation Audits Division provides transportation audit services and policy guidance as part of a government-wide program. The Transportation Audits Division ensures that charges paid by agencies for transportation services are accurate and any excess charges are recovered to the maximum extent possible. GSA is responsible for identifying overpayments and collecting monies owed to the government resulting from improper billing for transportation services provided by TSPs. GSA post-payment audits are conducted using a Two-Tier process, each Tier having a 3-month audit window. Identified overcharges are subject to protest due process which may result in adjustments or reversals prior to collections. Collections of identified overcharges are made by the Government and are subject to a 3-year statutory limitation from invoice paid date. Contingency fees are paid upon collection and are subject to reclaims due process which may result in adjustments or reversal after collections. SERVICES SOUGHT: The General Services Administration (GSA) is seeking Second Tier contract audit services on a contingency fee basis that will assist GSA in the post-payment audit of bills and supporting documentation for the following modes of transportation. Air Cargo/Freight Motor (Truck) Passenger Pipeline Rail Ship (Ocean) Small Parcel ANTICPATED PERIOD OF PERFORMANCE: Base Year plus 4 Option Years beginning October 1, 2018.
