- Draft SOW This combined synopsis and solicitation is being posted to the Federal Business Opportunities (FBO) page located at http://www.fbo.gov. It is understood that FBO is the single point of entry for posting of synopsis and solicitation to the internet. This is a combined synopsis and solicitation for commercial items prepared in accordance with the format in FAR Subpart 13.5 Simplified Procedures for Certain Commercial Items and in accordance with format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued. This synopsis/solicitation will be open for less than 30 days, in accordance with FAR 5.203(b). Request for Quotation (RFQ) number is N66604-18-Q-2187. The North American Industry Classification Systems (NAICS) code for this requirement is 541715; Small Business Size Standard is 1,000 employees. This requirement is being solicited as an Unrestricted, sole source procurement to Marine Ecology and Telemetry Research as concurred with by the NUWCDIVNPT Office for Small Business Programs. The proposed contract action is for services for which the Government intends to negotiate with only one source under the authority of 10 U.S.C. 2304 (c)(1), as implemented by FAR 6.302-1, Only One Responsible Source. The Naval Undersea Warfare Center Division, Newport (NUWCDIVNPT) intends to award a Firm Fixed Price (FFP) purchase order for In-service support services, including marine mammal tagging, photo identification assessments and population dynamic analyses of target species as outlined below: CLIN 0001: In-service support services, including marine mammal tagging, photo identification assessments and population dynamic analyses of target species in accordance with the Statement of Work (Attached), QTY: 1/Job. CLIN 0002: Data, Not Separately Priced. Period of Performance (PoP): Date of Award - 12 Months Thereafter The Naval Undersea Warfare Center Division Newport, RI (NUWCDIVNPT) intends to award a Firm Fixed Price purchase order to Marine Ecology and Telemetry Research on a sole source basis. NUWCDIVNPT requires highly specialized services for which an award to any other source would result both in an unacceptable impact to schedule that would result in unacceptable delays and a duplication of costs which could not be recovered through competition. Marine Ecology and Telemetry Research possesses specialized experience, permits, proprietary data, and custom software tools that makes them the only vendor able to meet the Government's requirements. Incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-97. The provision at FAR 52.212-1 Instructions to Offerors--Commercial Items applies to this solicitation. The provision at FAR 52.212-2 Evaluation - Commercial Items applies to this solicitation. The provision at FAR 52.212-3 (ALT 1), Offeror Representations and Certifications--Commercial Items applies to this solicitation. FAR 52.212-4, Contract Terms and Conditions--Commercial Items, FAR 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders-Commercial Items apply to this solicitation. The provision at DFARS 252.204-7008, Compliance with Safeguarding Covered Defense Information Controls applies to this solicitation. Clause 252.204-7015, Notice of Authorized Disclosure of Information for Litigation Support applies to this solicitation. The following addenda or additional terms and conditions apply: Defense Priorities and Allocations System (DPAS) rating is DO-C9. The Government has determined that Electronic and Information Technology (EIT) Section 508 requirements do not apply to this requirement. This solicitation requires registration with the System for Award Management (SAM) prior to award, pursuant to applicable regulations and guidelines. All responsible sources may submit a capability statement which will be considered by the Government. A determination by the Government not to compete this proposed acquisition based on responses to this notice is solely within the discretion of the Government.
