- SOW 1 Introduction 1.1 Background The Federal Bureau of Investigation intends to establish a one year blanket purchase agreement (BPA) for commercial bus services supporting the Madison, Huntsville, and Redstone Alabama area in accordance with Federal Acquisition Regulations (FAR) Part 12 and 13. This is a total small business set aside. There will be a single award for this requirement. Quotes shall be firm fixed price and quoted per one (1) day of service during regular business hours. This will be awarded based on Lowest Price Technically Acceptable. All vendors shall have an Active DUNS number in SAM.GOV for the life of the BPA. Contractors must submit proof of appropriate insurance with their initial quote. 1.2 Scope Each request for services shall provide all personnel, supervision, equipment, parts, fuel, insurance, maintenance, and transportation necessary to perform services in accordance with (IAW) the terms and conditions established in the BPA. There is no minimum guaranteed for this BPA, however, it is anticipated there will be a minimum of 1 service request and maximum of 4 service requests per month. The vendor shall be contacted via phone or e-mail regarding specific transportation needs 5 business days prior to the need, when possible. The vendor shall respond, via e-mail, with a "Confirmation of Services" to both the Technical Point of Contact (TPOC) and Contracting Officer (CO) The "Confirmation of Services" will include times, dates, locations, official quote, and documentation of proposed driver's valid Commercial Driver's License. 2 Requirements/specifications This is a non-personal services contract. The Government shall not exercise any supervision or control over contractor employees performing the services herein. Such contract service providers shall be accountable solely to the Contractor who, in turn is responsible to the Government. 2.1 Task Descriptions Prior to providing services under this BPA, the Contractor shall provide the TPOC with a Contractor Point of Contact (POC) who will be the primary designee to coordinate services and respond to any issues or concerns that arise. The Contractor shall provide the Government with a primary and alternate phone number to report maintenance problems or driver issues. The Contractor's POC shall only coordinate with the TPOC or CO for services performed under each BPA task order. The contractor shall provide climate controlled vehicles with a minimum capacity of 55 passenger seats with driver. The contractor shall provide properly maintained vehicles and shall operate in compliance with rules and regulations contained in the Federal Motor Carrier Safety Regulations. These regulations can be reviewed at http://www.fmcsa.dot.gov/regulations. All vehicles provided under this BPA shall be registered and insured in accordance with Alabama state laws and regulations. The Contractor shall ensure there are adequately trained drivers and supervisory personnel. 2.1.1 Sanitation and Maintenance: • All transportation vehicles shall be in good operating condition. • All transportation vehicles shall be climate controlled with operating heating and air conditioning. • All items needing repair must be repaired immediately upon detection and all operational features shall work without strain or unnecessary noise. • Each vehicle shall have a professional appearance that is free of noticeable dirt, debris, accident damage, or other damage. Paint schemes shall be compatible and subdued. Exteriors shall be washed as necessary, and interiors cleaned, sanitized and/or swept daily, or more often as needed. Windows shall be cleaned. Upholstery seat forearms, armrests, and cushions shall be in good repair and not torn, misshapen or unusable. • The vehicles shall have a minimum of one (1) "NO SMOKING" sign conspicuously posted inside the vehicle. • The bus operator shall arrive at the designated locations no later than ten (10) minutes prior to the scheduled departure time. The FBI will provide a parking space while the operator awaits pickup of passengers at designated FBI locations. • All bus operators shall inspect buses for any articles left by disembarked passengers. Any article discovered by the bus operator during an FBI sponsored tour shall be turned over to the FBI TPOC. 2.1.2 Vehicle Identification: For security purposes the contracted vehicles shall NOT display any transportation destination signage, outside the vehicle. The Contractor shall post a sign stating the operator's name, inside the vehicle at the front above the windshield, or other similar, appropriate, visible location. The Contractor shall also post a signage in the leased vehicles that is visible to all patrons that provides information on who to contact in relation to suggestions, complaints or comments. 2.1.3 Accident Reporting When a commercial bus carrying FBI passengers is involved in an accident the Contractor shall notify the FBI TPOC within 2 hours. If an accident occurs that results in injury, fatality, or substantial property damage, the carrier shall immediately provide the following information to the TPOC by the most expeditious means possible: a. Date, time and place of accident b. Nature of accident c. Number of FBI passengers on board d. Number, and location, of injured passengers e. Number, and disposition, of passenger fatalities f. Last point of departure and point of intended destination g. Condition of baggage and impedimenta h. Arrangements to accommodate uninjured passengers pending onward travel i. Copy of accident report from the appropriate law enforcement agency (when available) NOTE: The names and extent of injury or death of passengers will be withheld from the public, pending notification of the next of kin by the FBI. Announcements may be made by the Carrier, about its own employees, at the Carrier's discretion. 2.1.4 Insurance The Contractor shall possess and maintain adequate liability insurance in accordance with state or local regulations to cover both drivers and vehicles being operated by the drivers at his/her own expense. Contractor must submit proof of insurance with initial quote in order to be considered for award. 2.2 Position Qualifications • The Contractor is responsible for ensuring all employees possess all required licenses for operating equipment used in the execution of this BPA. • All drivers shall possess a valid Commercial Driver's License (CDL) and meet all local, state, and federal requirements necessary to operate a vehicle while performing services under this BPA. • In Contractor's "Confirmation of Services" email, Contractor shall provide a copy of the proposed driver's CDL for the specific task order. • Contractor employees performing under this BPA shall wear attire that is standardized in style and colors, be in accordance with company policy and be easily identified by either a stitched company logo or name badge with the company name and other information listed. Drivers shall maintain a neat, clean, and professional appearance and be courteous at all times. No open toed shoes or sandals are to be worn. • Drivers shall not eat or use hand held or personal electronic devices or cell phones (except for emergencies) while operating the vehicle. Music or other audio or visual recordings are not permitted on the shuttle unless authorized by the FBI TPOC. • Contractor employees shall display their license and qualifications at all times while the vehicle is in operation. 3 Place of Performance The primary place of performance will be in the Madison, Huntsville, and Redstone, AL area. 4 Period of Performance The period of performance for this effort will be as follows: PERIOD BEGIN END Base Period August 4, 2018 August 3, 2019 5 Hours of operation All work performed under each BPA call shall be in accordance with the schedule agreed upon between the Contractor and the TPOC, at time of request. The FBI reserves the right to adjust the schedule accordingly. • Monday through Sunday, including federal holidays. • Flexibility within the normal work day shall be coordinated with the TPOC. • The TPOC will notify the Contractor of any office closures or amended schedules due to delayed reporting of federal employees. 6 Deliverables The Contractor shall provide a monthly status report (MSR) to the Contracting Officer (CO) and the FBI Technical Point of Contact (TPOC). The format will be agreed to by the Contractor and the COR at the start of performance; however, the report shall include the following at a minimum: Staffing Summary, Hours and Labor performed, Current Management and Administrative problems, and Action items that describe the completed activities, areas of risk, as well as personnel and their responsibilities for the time period. The Contractor shall be responsible for providing the following deliverables: DELIVERABLE TITLE DELIVERABLE DATE METHOD OF DELIVERY Monthly Status Reports The 10th of each Month Email 7 Security Requirements The contractor shall be responsible for safeguarding, maintaining, and staging the equipment vehicles in a secure area at all times when not in route. The bus operators must be able to pass a Limited Background Investigation. This will provide the bus operators Redstone day passes for the length of the contract in order to gain access to the FBI Redstone Facility. Bus operators will be required to sign non-disclosure agreements 8 Government Representatives 8.1 Technical Point of Contact The performance of work required herein shall be subject to the technical direction of the cognizant TPOC with respect to technical matters. As used herein, "Technical Direction" is direction to the Contractor which fills in details, suggests possible lines of inquiry, or otherwise clarifies the scope of work. "Technical Direction" must be confined to the general scope of work set forth herein and shall not constitute a new assignment, nor supersede or modify any other Clause of this contract. To be valid, technical direction: Must be issued in writing consistent with the general scope of work set forth in the contract; • Shall not change the expressed terms, conditions, or specifications incorporated into this contract, and • Shall not constitute a basis for extension to the contract delivery schedule or contract price. • The TPOC is the primary representative of the Contracting Officer authorized to provide technical direction on contract performance only. • Technical direction includes: o Direction to the contractor which assists the contractor in accomplishing the Statement of Work. o Consultation regarding reports or other deliverables • Technical direction must be within the scope of the contract. The TPOC or any other technical representative does not have the authority to issue technical direction which: o Institutes additional work outside the scope of the contract; o Constitutes a change as defined in the changes clause; o Causes an increase or decrease in the estimated cost of the contract; o Alters the period of performance; or o Changes any of the other express terms or conditions of the contract. 8.2 Contracting Officer The CO is the appointed authority to bind the Government to the extent of the authority delegated. Direction that will modify the scope, schedule, terms and conditions, funding, or any other action that may modify the agreement as originally entered into with the Government must be given only by the CO.
