JUSTIFICATION AND APPROVAL (J&A) FOR OTHER THAN FULL AND OPEN COMPETITION FAR Part6.3 1. Identification of the agency and the contracting activity: The Office of Acquisition Management is conducting this acquisition of other than full and open competition for two FLIR GF315 thermal imagers to be used in support of Technical Surveillance Countermeasures (TSCM) training, on behalf of DS/T/TPS/SECD/SEB. 2. Nature and/or description of the action being approved. The requested action for approval is to support a firm-fixed-priced order for two GF315 thermal imagers. The role of SECD is to train DS personnel in classroom sessions and practical exercises on subjects ranging from construction security to technical surveillance countermeasures (TSCM). This training provides participants with the practical skills required to recognize, avoid, and respond to threats posed by hostile intelligence services, terrorist organizations, and other adversaries of the United States government. This training mission requires the use of state-of-the-art electronic monitoring equipment to support classroom demonstrations and student hands-on practical exercises. 3. A description of the supplies or services required to meet the Department's needs. The GF315 thermal imager is a recently developed, unique tool which was designed specifically for the TSCM community. This equipment is quickly being incorporated into the equipment inventories of many military and federal agency TSCM programs. The GF315 is also being incorporated into the training curriculum of the Interagency Training Center (ITC), the school which provides TSCM education and certification to United States Government TSCM personnel. This thermal imaging equipment will ensure that the Department's Office of Security Technology (ST) maintains a state-of­ the-art capability to perform effective TSCM examinations of facilities throughout the world. In order to support ST and other government agency personnel attending DS training courses, it is essential to have equipment representative of what is currently being used in the field and taught at ITC. The addition of these units will allow the Training center to conduct effective component detection training courses and workshops. A classified memorandum describing the full range of capabilities of the systems can be provided upon request. In order to properly train students on this fielded equipment, the following is required: Qty Part Number Description 2 80301-0102 FLIR GF315 w/20 degree lens 4. An identification of the statutory authority permitting other than full and open competition. This acquisition is conducted under the authority of 41 U.S.C. 3304, as implemented by FAR 6.3 and substantiated by the following: FAR 6.302-1- Only one responsible source and no other supplies or services will satisfy agency requirements. 5. A demonstration that the proposed contractor's unique qualifications or the nature of the action require use of the authority cited. The FLIR GF315 was specifically developed in response to requirements within the United States Government's TSCM program. FLIR Commercial Systems, Inc. is the only known manufacturer of this unique piece of equipment. FLIR engineers increased the range of the GF335, their mid-wave thermal imager, from 3 to 5 microns to I to 5 microns. This design modification enables the equipment to see emitted infrared signatures (thermal) and near infrared signatures. This design combines two primary TSCM tools into one which allow the TSCM operator to perform examinations more efficiently. The procurement of these items will facilitate the development of quality TSCM exercises that will ultimately enhance the ability of Diplomatic Security Service (DSS) Security Engineering Officers (SEOs) to protect Department of State facilities and operations from technical compromise. 6. A description of efforts to ensure that offers were solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by FAR Subpart 5.2 and, if not, which exception under FAR 5.202 applies. None. A notice may be publicized per FAR 5.2. 7. A determination by the ordering activity Contracting Officer that the anticipated cost to the Government is fair and reasonable. The Contracting Office determines that the anticipated price(s) will be fair and reasonable based on historical pricing. By signing the justification the Contracting Officer makes a determination that the cost/price to the Government are expected to be fair and reasonable. 8. A description of the market survey conducted (see Part 10) and the results or a statement of the reasons a market survey was not conducted. SECD has conducted extensive research to identify additional vendors who might be able to satisfy the equipment requirements. FLIR is the only known manufacturer of an imager which covers the infrared wavelength range of 1 to 5 microns. 9. Any other facts supporting the use of this justification. As this is a brand name only justification, no one contractor's unique qualifications are superior to another. Rather, the product identified by brand name is determined to be the only product that will meet the requirement. 1O. A listing of any sources that expressed a written interest in the acquisition. None. 11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required. The Office of Acquisition Management and the Security Engineering and Computer Security Training Division (DS /I'PS/SECD/SEB) will continue to keep abreast of the field tools and new technologies to understand when it will be in the best interest of the Department to change or compete the requirement in the future
