VHAPM Part 808.405-6 Limiting Sources Attachment 1: Justification for Limiting Sources for Micro-Purchase Threshold up to the SAT VHAPM Part 808.405-6 Limiting Sources Page 1 of 2 Original Date: 08/30/2017 Revision 01 Eff Date: 04/23/2018 DEPARTMENT OF VETERANS AFFAIRS FAR 8 Justification for Limiting Sources (LSJ) For Limiting Sources (<SAT) Acquisition Plan Action ID: VA246-18-AP-11236 Contracting Activity: Department of Veterans Affairs, VISN 06, Salem Medical Center, 658-18-3-034-0805 Description of Action: The objective of this request is to procure by means otherthan full and open competition to increase volume of available existing sterilization containers and instrument baskets for the increased number of instrumentation sets being built at Salem VAMC in Salem, VA. Firm-fixed price is planned for the acquisition. Order against: FSS Contract Number: V797P-4299B Name of Proposed Contractor: Buffalo Supply Street Address: 1650A Coal Creek Dr City, State, Zip: Lafayette, CO 80026 Phone: 303 666 6333 Description of Supplies or Services: The estimated value of the proposed action is $ 201,882.70 This request is for multiple line items of surgical instruments to accommodate equipment and instrumentation currently in use at the VAMC Salem. Authority: ORDER AGAINST FSS: Authority of the Multiple Award Schedule Program, Title III of the Federal Property and Administrative Services Act of 1949 (41 USC 251, et seq.); Title 40 USC 501, Services for Executive Agencies; and Section 803 of the National Defense Authorization Act of 2002 (PL 107-107) and implemented by FAR 8.405-6. Mark the applicable exception: An urgent and compelling need exists, and following the procedures would result in unacceptable delays(FAR 8.405-6(a)(1)(i)(A); Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized; (FAR 8.405-6(a)(1)(i)(B)); In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order and the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original order was not previously issued under sole-source or limited-sources procedures (FAR 8.405-6(a)(1)(i)(C)); or Items peculiar to one manufacturer. An item peculiar to one manufacturer can be a particular brand name, product, or a feature of a product, peculiar to one manufacturer). A brand name item, whether available on one or more schedule contracts, is an item peculiar to one manufacturer (FAR 8.405-6(b)). Rational/explanation to support cited authority: Thes items must be exact match items to accommodate existing multiple instrument sets. This complies with VHA directive 1116A page 5 section 6 responsibilities under b. Director, National Program Office for Sterile Processing. This request has multiple items that must match existing instrument sets in use at the medical center in order to maintain standardization of the instrumentation throughout the operating room. Thes items on the acquisition is serving a multiple Operating Room speciality prodedures in all surgical services suah as Orthopedics, Vascular, Platic, ENT, Podiatry, Thoracix, GYN, and General Surgery. Therefore, the items must be the same manufacture and product numbers, Set written Standards of Operation procedures regarding reprocessing instruction are already established at the medical center would have to be rewritten to accommodate a change in instrumation leading to additional training and expense. Operating Room and Sterile Processing Staff have prior training and competent use of these instruments currently in service in the OR. A product change would require time to re-establish Operating Procedures and staff training creating a delay in the use of the instrumentation and delay patient care. The use of multiple manaufactures of instrumentation, is that there would be so many different manufacturer intructions to follow in the reprocessing of the instrumentation which creates confusion for the sterile processing staff and extend the time to reprocess the instruments, ultimately, delaying reprocessing for the next patient surgical prodedure. This type of occurance is also costly to the medical center and inefficient. Therefore, it is essential that these items must be exact match on the procurement request to meet requirements already set at the medical center. Note that this determination satisfies the requirements of FAR 8.405-6. The requirement to prepare a written justification IAW FAR 6.303 does not apply to Federal Supply Schedules.
