- NOTICE OF CONTRACT ACTION: The Department of Veterans Affairs Strategic Acquisition Center intends to enter into a sole source contract with Alcon Laboratories, Inc., 6201 South Freeway Fort Worth, TX, 76134-2001 and Bausch & Lomb, Inc., 40 Technology Drive Irvine, CA 92618-2301. The proposed sole source action is to acquire an array of IOLs such as Posterior and Anterior Chamber Lens to treat conditions such as visually significant cataracts, anisometropia, phacomorphic glaucoma, traumatic cataracts and/or anterior segment reconstruction and secondary IOL implantation in aphakia for use during medical procedures at the Veterans Affairs Medical Centers (VAMCs) throughout the U.S and its territories. An IOL is designed to restore the patient s vision by replacing the eye s natural lens. These implants shall be delivered under Just-In-Time (JIT), Direct Vendor Delivery (DVD) and Consignment delivery methods. The Contractor shall provide remote and onsite technical assistance and training for surgical cases. The devices shall meet all applicable Food and Drug Administration Class III medical device Pre-Market Approval and consensus standards (e.g., ISO 11979 series, ANSI Z80 series.). The statutory authority permitting other than full and open competition is 38 U.S.C. § 8123 and 41 U.S.C. § 3004(a)(5), Federal Acquisition Regulation (FAR) § 6.302-5(a)(2)(i)., Veterans Affairs Acquisition Regulation (VAAR) § 806.302-5 (b) (1), Authorized by Statute. In accordance with 38 U.S.C. § 8123, the Secretary may procure prosthetic appliances and necessary services required in the fitting, supplying, and training and use of prosthetic appliances by purchase, manufacture, contract, or in such other manner as the Secretary may determine to be proper, without regard to any other provision of law. The North American Industry Classification Systems (NAICS) code for this requirement is 339113 Surgical Appliance Supplies Manufacturing. The size standard is 750 employees. This notice of intent is not a request for Expressions of Interest (EOI), proposal or quotations. This is a written notice to inform the public of the Government's intent to award on a sole source basis for the required prosthetic appliances and ancillary services.
