SOLICITATION NUMBER: NB770000-18-02369 AGENCY: National Institute of Standards and Technology NOTICE TYPE: Special Notice JOFOC STATUTORY AUTHORITY: FAR 13.106-1(b)(1) CONTACT POINTS: Karen Armstrong, Contract Specialist (301) 975-3671; Keith Bubar, Contracting Officer (301) 975-8329 DESCRIPTION: The National Institute of Standards and Technology (NIST), intends to negotiate, on a sole source basis, under the authority of FAR 13.106(b)(1), with the ANSYS, Inc. for the acquisition of a yearly licensing, maintenance and technical support fee associated with HFSS to be used by the NIST Applied and Computational Mathematics Division, for the period of 05/21/2018 - 05/20/2019. ***** Sole source determination is based on the need for NIST to acquire ANSYS software maintenance to receive technical support and also potential software upgrades or enhancements of ANSYS Software Maintenance Programs. NIST must renew these services to effectively continue our projects utilizing the following software packages; •ANSYS HFSS (Full 3D Electromagnetic Wave Simulator) TECS •ANSYS Optimetrics (For HFSS, and Q3D Extractor, Maxwell) •ANSYS Electronics HPC Pack - TECS •ANSYS Electronics HPC Pack - Lease No other software products will allow NIST to continue the aforementioned projects. The following are included in the annual software maintenance and support agreement; •Updates to currently licensed products (this includes bug fixes, patch releases and general updates) •User-id and Password access to ANSYS On", Technical Support (OTS, Web Site (which contains white papers, application notes and help for a variety of applications and product areas) •Access to ANSYS Support Network (which Includes telephone and email access) -On-site visits by Applications Engineers when appropriate (this Includes tasks such as: design and project guidance, debug of critical Issues, short training sessions on advanced topics etc.) The software packages are proprietary of ANSYS; and, there are no other resellers. ANSYS, Inc. does not authorize outside sources to perform maintenance on this software. The North American Industry Classification System (NAICS) code for this acquisition is 511210 - Software Publishers, with a small business size standard of $38.5 million dollars. A determination by the Government whether to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. Interested parties that believe they could satisfy the requirements listed above for NIST may clearly and unambiguously identify their capability to do so in writing on or before the response date for this notice. This notice of intent is not a solicitation. Any prospective contractor must be registered in the System for Award Management (SAM) in order to be eligible for award. Information concerning SAM registered requirements may be viewed via the Internet at http://sam.gov. INSTRUCTIONS: All interested parties shall submit clear and convincing documentation demonstrating their capabilities to satisfy the requirements listed above to Karen Armstrong by email at karen.armstrong@nist.gov, no later than 5:00 p.m. Eastern Time on Monday, May 14, 2018. Fax inquiries will not be accepted. The capability documentation should include general information and technical background describing in detail the prospective contractor's capabilities and experience that will demonstrate the ability to support these requirements.
