- SOURCES SOUGHT NOTICE DEPARTMENT OF HOMELAND SECURITY (DHS) TRANSPORTATION SECURITY LABORATORY FOR HAZARDOUS/UNIVERSAL/ENERGETIC WASTE REMOVAL/DISPOSAL SERVICES 1. This Request for Information (RFI) is to ascertain a level of interest of certified hazardous/universal/energetic waste removal companies capable of providing services for the removal and disposal of hazardous waste materials from the Transportation Security Laboratory (TSL). This action is made in anticipation but not the guarantee of the award of a three year (base year plus two option years) Firm Fixed Price (FFP) contract to be solicited under GSA Schedule SIN 00CORP/899.5. Hazardous, Universal, and Energetic waste management services include the segregating, packaging, transportation, and disposal of hazardous and non-hazardous wastes. All applicable Federal, State of New Jersey, and local regulations shall be adhered to; and land disposal of this waste is not an acceptable means, even if allowed by regulations. Excluded for this solicitation is the disposal of municipal type trash and refuse, radioactive waste, and sharps waste. 2. The Contractor shall furnish all labor, materials, equipment, transportation, supervision and management required for the collection and transportation of Hazardous, Universal, and Energetic wastes from the Transportation Security Laboratory; and the preparation of environmental documentation, including hazardous waste manifests and Land Disposal Restriction Forms. All work shall be in compliance with all applicable federal, state, and local statutes and regulations. The Contractor shall possess Environmental Protection Agency (EPA) and/or state identification numbers necessary for off-site transportation and disposal. The Contractor will maintain insurance that meets all local, state, and federal regulatory requirements for a transporter, and/or disposer of hazardous waste. The Contractor shall certify that facilities used for the disposal of waste are operated in compliance with all federal, state, and local regulations. 3. The Contractor will segregate, pack, transport, and provide for final disposal of Hazardous, Universal, and Energetic wastes. The Contractor shall handle and dispose of a wide variety of Hazardous, Universal, and Energetic wastes and chemicals. There will be wastes in liquid, solid, and semisolid forms; and wastes that come from material that has become deteriorated or unsuitable for use. It is anticipated that pickups of Hazardous and Universal wastes will occur on a monthly basis. The price of disposal for each type of waste will include costs for segregating, packaging, transporting, and disposing of the waste. The Contractor shall be required to pick up waste within ten (10) business days, once notified by a TSL representative. It is anticipated that pickups of Energetic Materials Waste will occur as needed, up to four times a year. The price of disposal for Energetic Materials Waste will include costs for segregating, packaging, transporting, and disposing of the waste. The Contractor shall be required to pick up waste within ten (10) business days, once notified by a TSL representative and/or on a set monthly schedule as agreed upon by the TSL and the contractor. 4. Containers of mixed wastes shall be segregated and repackaged into proper containers. Repackaging also includes consolidation and minimization of the hazardous and non-hazardous waste material by emptying small and partially full containers into larger containers. Where possible, the contractor shall empty TSL containers into contractor supplied containers, thus allowing the TSL to reuse their containers. 5. A Safety Data Sheet (SDS), when available, will be provided by TSL for use in preparation of a Waste Profile by the Contractor. 6. The Contractor shall perform all tests necessary to identify unknown wastes. Results of the tests shall be provided to the Contracting Officer's Representative (COR). Once identification has been made, the Contractor shall package and coordinate disposal of the waste. 7. Sampling and laboratory analytical services shall be provided by the Contractor as necessary to support operating and disposal requirements. 8. The Contractor will mark and label each container in accordance with Department of Transportation (DOT) requirements prior to shipping off-site. The Contractor shall load the containers onto the transporters vehicle. The Contractor shall weigh the containers prior to shipping off-site. 9. The Contractor shall complete any manifest required by the EPA or the State of New Jersey to track the movement of hazardous waste. An authorized TSL employee must sign any manifest prior to the removal of the waste to verify that the waste was properly shipped for disposal. Contractor shall provide copies of manifests covering transport of the waste from its pick-up at the TSL to its final destruction. Manifests shall show pick-up time and date, arrival time and date at the disposal site, weights and other certifications as required by the EPA and the State of New Jersey. One copy of the manifest shall be provided to the COR or designee at the time of pick-up. The signed copy of the manifest by the designated facility owner or operator certifying receipt of the hazardous materials must be received by the COR or designee within 45 days of the waste pick-up. Original certifications of proper disposal/destruction certifying the proper disposal of waste shall be provided to the COR and/or his/her designee once the waste is destroyed. 10. Any spills, damage to containers, or environmental contamination or damage caused by the contractor (or their subcontractor(s)) to hazardous waste or non-hazardous waste, shall be cleaned up, repaired, or corrected by the Contractor and at the expense of the Contractor. The Contractor is responsible for any damage or loss suffered by the Government; or injury suffered by any government employee as a result of any spills of hazardous waste caused by the Contractor. 11. The Contractor shall manage the total work effort associated with operations and all other services required herein to assure fully adequate and timely completion of these services. Included in this function are a full range of management duties including but not limited to, planning, scheduling, cost accounting, report preparation, establishing and maintaining records, and quality control. The Contractor shall supply an adequate staff of personnel with the necessary management expertise to assure the performance of the work in accordance with sound and efficient management practices. 12. The Contractor shall furnish all tools and equipment required for the performance of this contract. The TSL will not provide tools or equipment to the Contractor. 13. The Contractor shall satisfy all applicable regulatory agency requirements. In the event a regulatory agency assesses a monetary fine against the TSL for violations caused by the Contractor, the Contractor shall reimburse the TSL for the amount of the fine. 14. The Contractor shall complete all reports required by the EPA while performing services as a transporter or disposer of hazardous waste. These reports include manifest discrepancy reports; exception reports; and reports of hazardous waste discharge, fire, or explosion. 15. The Contractor shall provide regulatory interpretation to determine requirements for the proper classification, segregation, transportation, and disposal of all hazardous and non-hazardous wastes. 16. The Transportation Security Laboratory is currently classified as a Small Quantity Generator. Volumes listed will vary; and the TSL makes no guarantee that a pick-up will contain or be limited to the estimated amounts. 17. Any quotations, if requested or provided, shall be FOB Destination. SAMPLE MANIFEST The following is an example of what a typical Hazardous and Universal Materials pick-up may consist of. Please note that the quantities for any and all items listed will not be consistent for each pick-up and will change each time a pick-up is scheduled. As such, the information below should only be used as a guide for review purposes. - (5) 55 gallon drum labpacks for Hazardous Waste - (5) 16 gallon drum labpacks for Hazardous Waste - (5) 5 gallon drum labpacks for Hazardous Waste - (2) 30 gallon drum for Universal and Non-Hazardous Waste - Additionally Energetic Materials waste pickups will be required up to four times a year as stated above but not with every scheduled pick-up. The maximum quantity for each Energetic Materials Waste pickup should be no more than (2) 5 gallon carboys of desensitized dissolved explosives in trace quantities which are deemed a flammable hazard. DEFINITIONS: Contractor refers to both the prime contractor and any subcontractors. The prime contractor shall ensure that any subcontractors comply with the provisions of this contract. Hazardous material means a substance or material that the Secretary of Transportation has determined is capable of posing an unreasonable risk to health, safety, and property when transported in commerce, and has designated as hazardous under section 5103 of Federal hazardous materials transportation law (49 U.S.C. 5103). The term includes hazardous substances, hazardous wastes, marine pollutants, elevated temperature materials, materials designated as hazardous in the Hazardous Materials Table (see 49 CFR 172.101), and materials that meet the defining criteria for hazard classes and divisions in part 173 of this subchapter. Hazardous Substance means a material, including its mixtures and solutions, that: (1) is listed in the Appendix to 172.101; (2) is in a quantity, in one package, which equals or exceeds the reportable quantity (RQ) listed in the Appendix to 49 CFR 172.101; (3) when in a mixture or solution for radionuclides conform to the appendix to 172.101, Table 2 is in a concentration by weight, which equals or exceeds the concentration corresponding to the RQ of the material as shown in the table of the 'hazardous substance" definition in 49 CFR 171.8. This definition does not apply to petroleum products that are lubricants or fuels. (See 40 CFR 300.6.) Hazardous Waste is any material that is subject to the Hazardous Waste Manifest Requirements or the U.S. Environmental Protection Agency specified in the CFR Title 40, Part 262. Universal Waste includes, but is not limited to, materials such as broken glass, RCRA empty glassware, batteries, and fluorescent bulbs. Energetic Materials Waste is deemed as a flammable hazard and is defined as desensitized dissolved explosives materials in trace amounts. Examples can include but are not limited to trace amounts of PETN, RDX and/or TNT dissolved in solvents such as acetonitrile, methanol, ethanol, etc. which are deemed as a flammable hazard.
