- Description
- The National Institute of Standards and Technology (NIST) intends to negotiate on a sole source basis with The Society of Photo-Optical Instrumentation Engineers (SPIE), Bellingham, WA under the statutory authority permitting other than full and open competition, 41 U.S.C. 1901, as implemented by the Federal Acquisition Regulation (FAR) Subpart 13.501 Simplified Procedures for Certain Commercial Items, to acquire on-line access to the SPIE Digital Library (SDL). This is a sole source inasmuch as the SPIE is a syndicated highly unique subscription product comprised of the world's largest collection of eJournals, proceedings, and eBooksoptics relating to optics and photonics research, to which SPIE is the owner of all rights, title and copyright to the materials contained within the collection. SPIE is the only qualified source designated to manage the content of the repository and retain the backfiles/archives associated with the subscription package. Furthermore, SPIE disseminates the materials contained within the repository and is the only vendor with the legal rights to publish and distribute those materials worldwide. The collection is not available on-line through any other interface or vendor. A firm fixed-price purchase order will be issued on or about October 19, 2018 for a 1-yr. base period and include four (1-yr.) option periods. No solicitation package will be issued. This notice is not a request for competitive proposals; however, interested parties may identify their interest and capability to respond to the requirement. Inquiries will only be accepted via e-mail to randy.schroyer@nist.gov. The government will consider responses received by 5:00PM, EST, 18 May 2018. Written responses to this synopsis shall contain sufficient documentation to establish a bona fide capability to fulfill the requirement. A determination by the Government not to compete this proposed requirement based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement in the future. This notice of intent is not a Request for Proposal (RFP) nor is it a request for competition. No telephone requests will be honored. The North American Industrial Classification System (NAICS) code for this acquisition is 519130 and the size standard is 1,000 employees.
