As prescribed in 12.301 (c), the Contracting Officer may insert a provision substantially as follows: Evaluation -- Commercial Items (Oct 2014) (a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved. (End of Clause) 5352.201-9101 Ombudsman (Apr 2014) OMBUDSMAN (Apr 2014) (a) An ombudsman has been appointed to hear and facilitate the resolution of concerns from offerors, potential offerors, and others for this acquisition. When requested, the ombudsman will maintain strict confidentiality as to the source of the concern. The existence of the ombudsman does not affect the authority of the program manager, contracting officer, or source selection official. Further, the ombudsman does not participate in the evaluation of proposals, the source selection process, or the adjudication of protests or formal contract disputes. The ombudsman may refer the interested party to another official who can resolve the concern. (b) Before consulting with an ombudsman, interested parties must first address their concerns, issues, disagreements, and/or recommendations to the contracting officer for resolution. Consulting an ombudsman does not alter or postpone the timelines for any other processes (e.g., agency level bid protests, GAO bid protests, requests for debriefings, employee-employer actions, contests of OMB Circular A-76 competition performance decisions). (d) The ombudsman has no authority to render a decision that binds the agency. (End of clause) Administrative Information: Contractor Consent to Background Checks : The contractor and, as applicable, subcontractor shall not employ persons for work on this contract if such employee is identified as a potential threat to the health, safety, security, general well-being or operational mission of the installation and its population, nor shall the contractor or subcontractor employ persons under this contract who have an outstanding criminal warrant as identified by Law Enforcement Agency Data System (LEADS) through the National Crime Information Center. LEADS checks will verify if a person is wanted by local, state, and federal agencies. All contractor and subcontractor personnel must consent to LEADS background checks. Contractor and subcontractor personnel who do not consent to an LEADS check will be denied access to the installation. Information required to conduct an LEADS check includes: full name, driver's license number, and/or social security number, date of birth of the person entering the installation, and completion of a background check questionnaire. The contractor shall provide this information using the Scott AFB Form 21, Contractors Consent for Background Check, and shall submit it in conjunction with the contractor's request for either base or vehicle passes. Completion of a successful LEADS check does not invalidate the requirement for an escort when contractor or subcontractor personnel are working within controlled or restricted areas. Contractors shall ensure their employees and those of their subcontracts have the proper credentials allowing them to work in the United States. Persons later found to be undocumented or illegal aliens will be remanded to the proper authorities. The contractor shall not be entitled to any compensation for delays or expenses associated with complying with the provisions of this clause. Furthermore, nothing in this clause shall excuse the contractor from proceeding with the contract as required. REAL ID ACT INFORMATION SHEET Passed by Congress in 2005, the REAL ID Act enacted the 9/11 Commission's recommendation that the Federal Government "set standards for the issuance of sources of identification, such as driver's licenses." The Act established minimum security standards for state-issued driver's licenses and identification cards and prohibits Federal agencies from accepting for official purposes licenses and identification cards from states that do not meet these standards. The following states/territories has an extension for REAL ID enforcement, allowing Federal agencies to accept driver's licenses and identification cards from at Federal facilities and nuclear power plants until October 10, 2018. Q & A Real ID Program Q: When does the implementation start? A: The implementation of the REAL ID Act at Air Force Installations will begin on 15 September 2016. Q: Does this affect those with a military, retiree, dependent or CAC ID? A: No. There is no change for base access to individuals who already possess military or DoD issued credentials; non-DoD personnel without base access credentials will be the largest demographic affected by REAL ID Act requirements. Q: What identification is required of minors? A: There is no change to current procedures. When entering an installation with an individual in possession of a REAL ID Act compliant identification card, minors are not required to have an identification credential. Q: If I have a military ID and want to take my mom on base, does she need to get a background check? A: If you are a military ID cardholder and she is under your escort, she only needs to show a picture ID. If she needs unescorted access, i.e., entering the installation on her own, she will need a REAL ID Act compliant credential to be issued an access pass. A background check will be done prior to issuing the pass. Q: I have guests attending a personal event for someone on base, do they each need a background check for this or just an access pass? A: If you are escorting them in your vehicle, a photo ID will suffice without a background check. If you have guests that need to travel unescorted onto an Air Force Installation, guests 18 and over will need a background check and an access pass. The passes will be valid for the duration of the visit. Background checks and passes are issued at the Visitor Control Center (VCC). In order to conduct the background check, a REAL ID Act compliant credential will be required to establish individual identity. Q: Do you need to get a new driver's license or passport? A: You have until Oct 2020 to replace your current license with a REAL ID compliant license, as long as your state is compliant or is noncompliant with an extension. Q: I am a DoD contractor with a Common Access Card. Can I bring my wife onto the installation without her needing a background check or access pass? A: No. Your wife will require a background check and access pass. Contractors are not authorized to escort uncleared visitors on the installation. Q: What's needed to access a base? A: Access to Air Force installations is based upon, identify proofing, a background check and a purpose for entry. Installation commanders may deny access and issuance of access credentials based upon information obtained during the background process that indicates the individual may present a threat to the good order and discipline of the installation. Q: Why are background checks being implemented on visitors? A: Homeland Security Presidential Directive #12 directs the Department of Defense to use the National Crime Information Center - Law Enforcement Automated Data System (LEADS) to vet personnel entering any military installation who do not possess a U.S. Government Common Access Card or Uniformed Services Identification Card. Q: What is LEADS? A: LEADS is the National Crime Information Center - Interstate ID Index. It is the DoD minimum baseline background check required for entrance onto military installations for non-DoD ID Card holder and visitors. Visitors under the age of 18 will not have an LEADS check conducted. Q: Is DHS trying to build a national database with all of our information? A: No. REAL ID is a national set of standards, not a national identification card. REAL ID does not create a federal database of driver license information. Each jurisdiction continues to issue its own unique license, maintains its own records, and controls who gets access to those records and under what circumstances. The purpose of REAL ID is to make our identity documents more consistent and secure. Q: Why are some states still not compliant? Isn't this law? A: It is Federal law. REAL ID is Federal law requiring Federal agencies to restrict the circumstances under which they may accept state-issued driver's licenses and identification cards for official purposes. REQUIREMENT : a) BACKGROUND: This contract is to install DVR and additional cameras and supporting systems project for the James Sports Center, bldg. 1987. PROJECT SCOPE : Contractor will purchase and install a 32 channel DVR with 3TB hard drive. Purchase and install 6 new cameras (4 outdoor style and 2 indoor style) in the following locations: the sauna area, the exterior front door, 2 for the basketball court area, the 2nd floor hallway, and one additional camera in room 201. Customer has requested that all 13 of the old cameras be replaced with cameras equal to their seven Speco dome style cameras. The DVR and all cabling will move to the office area from the back equipment room. Cabling that is currently run to the back room will be relocated or extended to the new DVR location in office area. The wall mounted cabinet in the back equipment room will also be relocated to the office area. A 50 inch HDTV will be purchased and installed on the back wall of the lobby/main entrance area. The cameras will be displayed on this new TV and an existing flat screen TV in the office area. •2. •a) Description of Work : Contractor will purchase and install a 32 channel DVR with 3 TB hard drive. All materials for the system will come with a minimum of 1 year warranty. Work is as follows: The Contractor shall take precautions to avoid damaging the existing area. The Contractor shall install plastic sheeting, or other approved materials, over the existing floors where his personnel will be working. If any damage does occur, the Contractor shall repair the damaged areas to match the existing construction. The Contractor shall access the work area through either through the front or side doors. The Contractor shall install warning tape around the office entrance during the course of the work. The Contractor shall provide a standard 1-year warranty for the system desk. •3. SCHEDULE: Schedule shall be as follows: •a) Performance period: The period of performance (PoP) for this project is approximately 180 days from the date that Notice to Proceed (NTP) is issued. All work must be scheduled to be completed within this timeframe. Any modifications or extensions must be requested through the 375th Civil Engineer Squadron (375 CES) and the Contracting Officer for review and discussion. Contractor must provide construction milestones to 375 CES and the Contracting Officer. •b) Construction may be authorized by the Contracting Officer upon acceptance and approval of the schedule and equipment/material submittal approvals. •4. GENERAL CONDITIONS: The work consists of furnishing all labor, materials and equipment necessary to accomplish, but not limited to, the following: a) Contractor shall site verify any and all dimensions and/or existing site conditions prior to the commencement of work. Commencement of work shall begin within ten (10) calendar days upon the receipt of the NTP issued by the Contracting Officer. b) All work shall be completed within the agreed upon PoP as stated within the contract issued by the Contracting Officer. c) Contractor shall be required to apply for and submit to the Contracting Officer an AF Form 103, Work Clearance Request, for all work to be accomplished under this delivery order five (5) days prior to the commencement of work. The AF Form 103 can be obtained from and approved by 375 CES. d) Contractor shall brief all Sub-Contractors on all safety and fire prevention regulations, emphasizing the requirement to obtain a daily AF Form 592, Welding, Cutting, and Brazing Permit, when welding, cutting, or brazing operations are to occur under this delivery order. The AF Form 592 can be obtained from and approved by 375 CES. e) Contractor shall complete and submit the appropriate DD Form 1354, Transfer and Acceptance of DoD Real Property, as outlined in Section 01010, General Requirements. The DD Form 1354 can be obtained from 375 CES. •5. Operational Testing: Personnel from Fitness Center and contractor will conduct a full and operational test of new equipment before acceptance of product. Any problems found during this time of inspection will be repaired and resolved prior to contractor departure. •6. Contractor Consent to Background Checks: The contractor and, as applicable, subcontractor shall not employ persons for work on this contract if such employee is identified as a potential threat to the health, safety, security, general well-being or operational mission of the installation and its population, nor shall the contractor or subcontractor employ persons under this contract who have an outstanding criminal warrant as identified by Law Enforcement Agency Data System (LEADS) through the National Crime Information Center. LEADS checks will verify if a person is wanted by local, state, and federal agencies. All contractor and subcontractor personnel must consent to LEADS background checks. Contractor and subcontractor personnel who do not consent to a LEADS check will be denied access to the installation. Information required to conduct a LEADS check includes: full name, driver's license number, and/or social security number, date of birth of the person entering the installation, and completion of a background check questionnaire. The contractor shall provide this information using the Scott AFB Form 21, Contractors Consent for Background Check, and shall submit it in conjunction with the contractor's request for either base or vehicle passes. Completion of a successful LEADS check does not invalidate the requirement for an escort when contractor or subcontractor personnel are working within controlled or restricted areas. Contractors shall ensure their employees and those of their subcontracts have the proper credentials allowing them to work in the United States. Persons later found to be undocumented or illegal aliens will be remanded to the proper authorities. The contractor shall not be entitled to any compensation for delays or expenses associated with complying with the provisions of this clause. Furthermore, nothing in this clause shall excuse the contractor from proceeding with the contract as required. •8. Badges : The contractor is required to provide identification badges for their employees. All contractor personnel shall wear these badges while on duty on the government site. Badges are required to identify the individual, company name, and be clearly and distinctly marked as contractor. Size, color, style, etc. are to be mutually agreed to by contractor and government. The contractor's identification badge will not be used as an entry requirement for installation entry or into any government designated controlled or restricted area. •9. Contractor Registration of Vehicles on Scott AFB: All contractor or contractor employees' vehicles used for the performance of this contract shall comply with all local, state and federal regulations. Additionally any pass shall be surrendered to Security Forces upon demand to positively identify a persons need to be on Scott AFB. •10. Access to Installation during Force Protection Conditions (FPCONs): Contractors will be assigned a mission essential designation IAW requirements contained in Scott Air Force Base Integrated Defense Plan 31-1. Only the installation commander or the unit commander requesting contract support will assign the mission essential designation. •11. Property Protection: Property protection for facility where the contractors' primary work center is located will be the responsibility of the local facility manager and local Government Security Manager, or their duly authorized representative IAW AFI 31-101, Integrated Defense and command/local directives. The contractor shall safeguard all government-owned equipment and materials in his/her possession or use. •12. Safeguarding Classified or Unclassified Information: The contractor shall meet Air Force standards for storing, processing, and handling classified information and systems. Additionally, all resources (e.g. maps, publication/instructions, photos) provided by the government to assist the contractor in the performance of their contract will be surrendered upon termination of employment or the end of the contract performance period. •13. Non-Disclosure Agreements : To safeguard information, the contractor shall enter into non-disclosure agreements with the responsible local security manager. •14. Privacy Act: Work on this project requires that personnel have access to Privacy Information. Personnel shall adhere to the Privacy Act, Title 5 of the U.S. Code, Section 552a and applicable agency rules and regulations. •15. Contractors Working in Controlled or Restricted Areas: The unit requesting contract support will provide escort (s) for contractors' at all times when within a controlled area. Contractors shall not escort other contractor employees within controlled or restricted areas. In addition, contractors shall fulfill, maintain, and comply with all security requirements IAW Scott Air Force Base Integrated Defense Plan 31-1, and command/local directives. The contractor shall comply with security regulations imposed by the installation commander and/or the agency responsible for the project location. •16. Contractor shall, during the course of construction, keep an accurate electronic record of as-built conditions, all variations from the contract drawings, for whatever reason, including those made because of the selection of optional materials, shall be clearly indicated. These variations shall be shown in the same general detail utilized in the initial contract drawings. The as-built drawings shall be maintained in a current condition during the course of construction. The as-built drawings shall be furnished to the Contracting Officer and 375 CES not later than ten work days after the final inspection date. As part of the as-built drawings a separate set of plans shall be marked-up showing areas found/known to contain asbestos. •17. Contractor shall install bar-code labels on all newly installed systems, as required. Bar-code labels that match applicable component-sections will be provided to the Contractor by 375 CES. •18. All documents related to the disposal of hazardous material must be supplied to 375 CONS and 375 CES. The Contractor must obtain the proper documents from 375 CES to ensure all materials leaving Scott Air Force Base can be tracked and accounted for, in accordance with all governing laws. •19. Under the 1992 Clean Air Act, all products used in executing this project must not be related to the Class I Ozone Depleting Chemicals (ODCs) identified in Air Force Policy. The following products are considered Class I ODCs: CFC-11, CFC-12, CFC-113, CFC-114, CFC-115, Halon 1211, Halon 1301, Halon 2402, CFC-13, CFC-111, CFC-112, CFC-211, CFC-212, CFC-213, CFC-214, CFC-215, CFC-216, CFC-217, Carbon tetrachloride, and Methyl Chloroform. •20. Field Conditions: The Contractor shall be responsible for all field measurements to accomplish work. Quantity and sizes of materials shall be determined from site visits and drawings. The Contractor shall carefully examine the entire site and building and shall make all necessary investigations to become thoroughly aware of the existing conditions and all difficulties involved in the completion of the work in accordance with the contract documents. •21. Accomplishment of Work: The work areas of the existing building will be in occupied and unoccupied areas. The Contractor must ensure that all access to the existing building remains clear for occupants and emergency access at all times during the construction period. All temporary closures, barriers, and protective procedures shall be coordinated with the Contracting Officer. All work shall be accomplished during the standard 8-hour day, 5-day week, Monday through Friday, between the hours of 7:30 A.M. and 4:30 P.M. local time, excluding Federal Legal holidays and non-work days resulting from holidays occurring on weekends. •22. Work Conditions: The Contractor shall coordinate work with the Contracting Officer, in conjunction with the User and 375 CES. The Contractor shall notify the Contracting Officer or the 375 CES inspection representative the day before he/she moves onto the work site to commence work. The Contractor shall again provide notification the day he moves back to the work site after an interruption of work of two or more days in duration. The Contractor shall also provide an original work schedule and updates if required. This schedule shall describe major work items and projected completion dates. •23. Protection of Building Property: The Contractor shall protect from damage all building property located in or adjacent to the building and shall repair, replace or otherwise be held liable for all such damage. Building properties include but are not limited to, furniture, vehicles, or items of supplies. Exercise control measures of all dust and toxic fumes associated with construction operations, in order to prevent hazards or illness to base and Contractor personnel. •24. Cleanup: The Contractor shall cleanup each work site at the end of each work day to the satisfaction of the Contracting Officer. Upon completion of the work, all construction equipment and debris shall be removed from the site and the area shall be left in a neat and completely acceptable condition as required by the General Provisions. Contractor must always recycle materials, such as, but not limited to cardboard and paper. The Contractor will use whatever means necessary to store all recyclable materials and is responsible for turning in recyclable materials to the Base Recycling Center. •25. Patching and Repairing: After the work has been completed, holes, cuts, and damages made in the finished surfaces of the work site and adjacent areas shall be properly repaired and restored to match the existing finishes. Any abrasion or disfigurement of the finish work or any portion of the building where any such abrasion or disfigurement is caused by the activities of the Contractor shall be repaired and neatly refinished to match the adjacent work to the satisfaction of the Contracting Officer. Contractor shall maintain integrity of all fire walls/barriers. •26. Products: All products shall conform to their respective manufacturing and performance publications. All materials and equipment used in the work area shall be the products of manufacturers regularly engaged in the manufacture of construction products. •27. Submittals: The Contractor shall submit for approval all items as required by other parts of these specifications. The Contracting Officer may request submittals in addition to those required by the other parts of this Statement of Work when deemed necessary to adequately describe the work. Submittals shall be made to the Contracting Officer in five (5) copies using AF Form 3000, Material Approval Submittal. In general, submittals shall be provided a minimum of thirty (30) calendar days in advance of scheduled installation to allow satisfactory time for Government review. Additionally, unless stated otherwise submissions on test results and other submissions of a similar nature shall be made within fourteen (14) calendar days after the work or test is performed. Each submittal shall be complete and in sufficient detail for ready determination of compliance with contract requirements. Submittals shall include such items as Contractor's or manufacturer's shop drawings, descriptive literature, catalog cuts, samples, certifications, installation procedures and recommendations, templates, and other descriptive literature as may be required by the Contracting Officer. Catalog cuts and other descriptive data which may have more than one model or type shall be clearly marked to show the model, type, size, and all optional or accessory equipment the Contractor proposes to install. Submittals on component items forming a system or interrelated items shall be submitted at one time as a single submittal in order to demonstrate that the items have been properly coordinated and will function as a unit. Approval of submittals will not relieve the Contractor of compliance with the project drawings and specifications. Submittal items that are disapproved will be promptly corrected and resubmitted by the Contractor. No materials shall be installed until submittals are approved by the Contracting Officer. All submittals involving color selections, patterns, and other decorative architectural features shall be submitted at the same time for both interior and exterior materials. •28. Specifications: Work shall be performed in strict accordance with these contract general specifications, as well as all applicable local, state, and national Building and Life Safety Codes, American Society for Testing and Materials (ASTM) specifications. Safety plans and procedures issues must adhere to all applicable Occupational Safety and Health Act (OSHA) regulations.
