- Description
- This is a special notice prepared in accordance with Federal Acquisition Regulation (FAR) 5.2 "Synopses of Proposed Contract Actions." The U.S. Army Corps of Engineers (USACE), Far East District (POF) intends to negotiate/award a sole-source firm-fixed contract with MM International (CAGE: 57F31) The A-E shall perform all work necessary for the design and preparation of documents for the construction of those items identified in the project description. The work in general consists of field investigations, conducting all required studies/reports, structural analysis of existing structure, attending meetings/conferences, preparation of design, and related construction sequencing, back check, and contract documents, and other A-E services. The design work is to be performed for Fire Station B-2122, Kwangju Air Base, South Korea. The statutory authority for this non-competitive acquisition is 10 United States Code 2304(c)(1) as implemented in Federal Acquisition Regulation 6.302-1(a)(2)(iii), Only one responsible source and no other supplies or services will satisfy agency requirements, it is likely that award to any other source would result in substantial duplication of cost to the Government that would not be recovered through competition and would result in unacceptable delays in fulfilling the Government's requirements. Contract W912UM-16-C-0017 was awarded 7 April 2016 to MM International LLC (MMI) for the design of upgrading the existing Fire Station at Kwangju Air Base. Work included, but not limited to architectural renovation, electrical, communication, mechanical HVAC and plumbing work, installation of new roof on existing wood truss, fire alarm, and installing a new sprinkler system. The design work on the contract was completed and the design contract was closed out on 8 February 2018. On 20 March 2018, the Kunsan Resident Office was notified of structural defects and differing site conditions. During removal of the existing ceilings it was discovered that the existing wood truss was broken, cracked, and/or showed signs of deflection. The construction contractor is unable to perform any interior work due to life/safety concerns. In addition, the contractor is currently unable to perform work as the roof would need to be replaced prior to any interior work as it may be damaged during adverse weather. The new sprinkler and mechanical system is currently designed to be installed on the existing wood components. However, adding additional weight to the damaged system is not feasible. The work under the proposed contract is additional design services from the A-E to design a retro-fit, light gauge metal, truss system to replace the existing broken wood truss system to support the Air Force mission at Kwangju. The Fire Station at B-2122 houses personnel, trucks, materials, and equipment to address any fire related issues. The Republic of Korea Air Force (ROKAF) is currently providing support due the absence of an active Fire Station, however the support will be limited as ROKAF has limited capacity to support its own mission and the mission of Fire Station B-2122. These design improvements are essential to make the fire station operational and sustaining the mission readiness. Because MMI has already performed the majority of the services related to the design, using the same architect engineer contractor's services for the design of this project will avoid duplication in cost. If this work were to be awarded to a different firm, the Government would require the incoming A-E firm to assume responsibility for the entire design due to the additional requirement of contractor sequencing and associated delay since the new A-E firm will need to study the existing design. Selection of another A-E for this project would increase FED's costs of obtaining the desired design services, since other A-E firms would need to perform greater effort to evaluate and validate the existing MMI design and prepare their input towards the design of this project. Moreover, selecting another A-E would result in a scenario with two different designers of record for the same building. A SOLICITATION WILL NOT BE POSTED. The Government intends to proceed with this sole source action. The NAICS code is 541310, Architectural Services. THIS NOTICE IS NOT A REQUEST FOR COMPETITIVE PROPOSALS OR QUOTATIONS. All responsible sources may submit a capability statement, proposal, or quote to the contracting officer before the notice end date. If no affirmative written responses are received by 11:59 PM eastern time on 25 May 2018, an award will be made without further notice. Oral communications are not acceptable in response to this notice. A determination by the Government not to compete this proposed requirement is solely within the discretion of the Government.
