- REQUEST FOR INFORMATION REQUEST FOR INFORMATION (RFI) No. 1198728 TITLE: IDENTIFYING TRIBAL TOBACCO RETAILERS AND MANUFACTURERS This is a REQUEST FOR INFORMATION notice. This is NOT a solicitation for proposals, proposal abstracts, or quotations. Your responses to the information requested will assist the Government in determining the appropriate acquisition method, including whether a small business set-aside is possible. This notice does not obligate the Government to award a contract or otherwise pay for the information provided in response. The Government reserves the right to use information provided by respondents for any purpose deemed necessary and legally appropriate. Any organization responding to this notice should ensure that its response is complete and sufficiently detailed to allow the Government to determine the organization's qualifications to perform the work. Respondents are advised that the Government is under no obligation to acknowledge receipt of the information received or provide feedback to respondents with respect to any information it submits. After a review of the responses received, a pre-solicitation synopsis and solicitation may be published in Federal Business Opportunities. However, responses to this notice will not be considered adequate responses to a solicitation. No proprietary, classified, confidential, or sensitive information should be included in your response. The Government reserves the right to use any non-proprietary technical information in any resultant solicitation(s). The purpose of this notice is to obtain information regarding: (1) The availability and capability of any sources qualified to perform the work described; and (2) The availability and capability of qualified small business sources, including HUBZone small businesses, service-disabled, veteran-owned small businesses, 8(a) small businesses, veteran-owned small businesses, woman-owned small businesses, or small disadvantaged businesses. BACKGROUND The Food and Drug Administration (FDA), Center for Tobacco Products (CTP) was established by the Family Smoking Prevention and Tobacco Control Act (Tobacco Control Act) (Public Law 111-31). The Tobacco Control Act amended the Federal Food, Drug, and Cosmetic Act (FD&C Act) by, among other things, adding a new chapter granting the Food and Drug Administration (FDA) authority to regulate the manufacturing, marketing, and distribution of tobacco products to protect the public health and to reduce tobacco use by minors. The Tobacco Control Act authorizes FDA, where feasible, to contract with U.S. States and Territories (hereinafter referred to as "jurisdictions") to carry out inspections of tobacco product retailers within their jurisdictions on behalf of FDA. The American Indian and Alaska Native population has the highest prevalence of cigarette smoking (about 40%) compared to any other population group in the United States. We appreciate that many tribal governments have been working actively to reduce tobacco use within their tribes and to prevent smoking and other tobacco use among tribal youth. Through a collaborative partnership, we can protect the health of Native communities, especially youth, by ensuring compliance with the Tobacco Control Act. OBJECTIVES FDA expects to build on prior Agency efforts to identify tobacco retailers and tobacco manufacturers that are physically located in Federally recognized Indian Country (as defined in 18 U.S.C. §1151), as well as any additional tobacco retailers and tobacco manufacturers. Respondents must demonstrate their ability to perform the following operations: 1. Verify and maintain an existing tribal tobacco retailer list that will be provided by FDA. Elements required for this operation are as follows: a. For each tobacco retailer on the existing list: i. Confirm whether the retailer is located in Indian Country. Identify the associated federally-recognized tribe. ii. Confirm names and addresses of retailers, and document any updates that are necessary for names or address of retailers to be accurate. b. Clearly identify any tobacco retail establishments not on the list provided by FDA that meet the criteria listed above. Identify the associated federally-recognized tribe. c. Identify the legal owner (e.g. the tribe, individual, or corporation) for each tobacco retailer on the updated list and add to the updated list any tobacco retailer owned by a tribe not appearing on the updated list. 2. Identify any manufacturers not listed on the list provided by FDA. Elements required for this operation are as follows: a. Identify any manufacturers not on the list provided by FDA that are located in Indian Country. Identify the associated federally-recognized tribe. b. Identify the legal owner (e.g. the tribe, individual, or corporation) for each manufacturer on the list and add to the updated list any tobacco manufacturer owned by a tribe not appearing on the updated list. 3. For each of the elements listed above, provide reliable evidence confirming the information provided. This evidence must include legible electronic copies of all source material relied upon to reach the conclusion. CAPABILITY STATEMENT / INFORMATION SOUGHT The FDA is requesting interested qualified sources to provide a capability statement in a commonly used format, such as Microsoft Word or pdf. This capability statement shall be no more than five pages, excluding a cover page and table of contents, and shall include examples of similar work that has been completed successfully, including a description of the similar work and client contact information. Respondents must explain how they plan to conduct the required research, including a list of the sources that would be used. Respondents must also include a statement of how they plan to secure access to these sources. In addition, please indicate whether your organization offers any of the required capabilities described in this notice on one or more of your company's own Federal Government contracts (i.e., GSA Federal Supply Schedule contract or Government wide Acquisition Contracts) that the FDA could order from and, if so, which services are offered. Also, provide the contract number(s) and indicate what is currently available for ordering from each of those contract(s). The FDA will be determining capability based on the ability to perform the operations delineated above. Interested eligible small businesses shall also include company information to determine eligibility, including their contact information, Dun and Bradstreet (DUNS) number and size and business type (e.g. 8(a), HUBZone, etc.) based on the applicable NAICS code for the proposed acquisition: All Other Professional Scientific, and Technical Services - 541990. The associated Small Business size standard for this NAICS code is $15 Million. All capability statements shall be submitted via email to Telisha.Wilson@fda.hhs.gov by or before 10:00 AM Eastern Time on May 29, 2018 with the subject titled "RFI 1198728".
