- VHAPM Part 808.405-6 Limiting Sources Attachment 2: Request for Limited Sources Justification Format >$150K VHAPM Part 808.405-6 Limiting Sources Page 3 of 3 Original Date: 08/30/2017 LIMITED SOURCES JUSTIFICATION ORDER >$150,000 FAR PART 8.405-6 Acquisition Plan Action ID:___ VA258-18-AP-0759_______ Contracting Activity: Department of Veterans Affairs, VISN 22 Gilbert, New Mexico VA Health Care System. The Surgical department has submitted purchase request 501-18-2-302-0019 in the amount of $38,972.28. Description of Action: This acquisition is conducted under the authority of the Multiple-Award Schedule Program (41 U.S.C. 251 and 40 U.S.C. 501). Lease Olympus Endoscope equipment as a new requirement that will be separated from an expiring contract (VA258-15-J-0734) due to the unique payment plan and service charges that are based on a three-year plan. Limited sole source is sought due to this upgraded equipment is only compatible with other Olympus equipment already in use in Albuquerque s Surgical department. Street Address: 3500 CORPORATE PKWY City, State, Zip: CENTER VALLEY, PA 18034 Phone: (303) 501-2343 Description of Supplies or Services: The estimated value of the proposed action is $ 244,488.28 Upgrade current leased Olympus Endoscope equipment to the new Olympus Gastrointestinal (GI) High-Definition (HD) system technology for Albuquerque s Surgical Department. Returned antiquated GI equipment to Olympus and renew the Master Lease Agreement. Deliverables: (4) IDENTIFY THE AUTHORITY AND SUPPORTING RATIONALE (see 8.405-6(a)(1)(i)(A), (B), and (C) or 8.405-6(b)), AND IF APPLICABLE, A DEMONSTRATION OF THE PROPOSED CONTRACTOR S UNIQUE QUALIFICATIONS TO PROVIDE THE REQUIRED SUPPLY OR SERVICE. (CHECK ALL THAT APPLY AND COMPLETE) An urgent and compelling need exists, and following the ordering procedures would result in unacceptable delays. Only one source is capable of providing the supplies or services required at the level of quality required because the services are unique and highly specialized that the upgraded equipment is only compatible with other Olympus equipment already in use in Albuquerque s Surgical department. In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order provided that the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original order must not have been previously issued under sole source or limited source procedures. Items peculiar to one manufacturer: A patent, copyright or proprietary data limits competition. The proprietary data is: (If FAR 8.405-6(a)(2)iii before posting. Do not include specific proprietary data. Only mention the type of equipment, procedure, etc. to show that proprietary supplies or services are being procured.) These are direct replacements parts/components for existing equipment. The material/service must be compatible in all aspects (form, fit and function) with existing systems presently installed/performing. Describe the equipment/function you have now and how the new item/service must coordinate, connect, or interface with the existing system. (5) DESCRIBE WHY YOU BELIEVE THE ORDER REPRESENTS THE BEST VALUE CONSISTENT WITH FAR 8.404(d) TO AID THE CONTRACTING OFFICER IN MAKING THIS BEST VALUE DETERMINATION: The Surgical Department requires the upgraded features to Olympus endoscopy products as part of the new EVIS EXERA III System. Physicians will be able to view the interior of the body with clarity due to several visualization improvements facilitated by the latest technology during colonoscopes. These system feature improvements are the Narrow Band Imaging (NBI) technology which complements the Dual Focus feature, since the two must be used together to examine capillary patterns and mucosal structures in fine detail. The NBI can only be operated from the EVIS EXERA III system, for this technology is a built-in feature of the EVIS EXERA III system. Therefore, the EVIS EXERA III system is a stand-alone full HD Video system and It cannot be mixed with other components from another manufacture to properly operate and support the technology. (6) DESCRIBE THE MARKET RESEARCH CONDUCTED AMONG SCHEDULE HOLDERS AND THE RESULTS OR A STATEMENT OF THE REASON MARKET RESEARCH WAS NOT CONDUCTED: No SDVOSB/VOSB's listed in VetBiz could be located that provides the services (see market research attachment). In addition, no SDVOSB/VOSB responded to a request for information (sources sought notice) that was posted on Fedbizopps website and offered the same equipment for lease. (7) ANY OTHER FACTS SUPPORTING THE JUSTIFICATION: None (8) A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS THAT LED TO THE RESTRICTED CONSIDERATION BEFORE ANY SUBSEQUENT ACQUISITION FOR THE SUPPLIES OR SERVICES IS MADE: None at this time. (9) REQUIREMENTS CERTIFICATION: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge.
