- NOTICE OF INTENT TO AWARD SOLE SOURCE THIS IS NOT A REQUEST FOR COMPETITIVE QUOTATION. This is a notice of intent to award a sole source contract under statutory authority 10 USC 2304(c) (1), set forth in Federal Acquisition Regulation 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. The Reference Number is N4561018RCTG001. The 628th Contracting Squadron, 101 E. Hill Blvd., Charleston AFB SC, requires Law Enforcement Officer Flying Armed (LEOFA) Prisoner Escort training in accordnce with 49 CFR and TSA guidelines. The 628th Contracting Squadron intends to make an award to Shooting-Performance LLC, 13406 E.91st Street N., Owasso OK 74055-2656. Market research was performed and information gathered in determining this company to be the only reliable source for this requirement in the US. Per FAR Part 5.207-13(e) Fed Biz Ops Numbered Note 22 applies and is modified to read: The proposed contract action is for services for which the Government intends to solicit and negotiate with only one source under the authority of FAR 6.302. Interested parties may identify their interest and capability to response to the requirement or submit a quotation. This notice of intent is not a request for competitive quotations. However, all quotes received by the appointed due date will be considered by the Government. A determination by the Government not to compete with this proposal based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. The justification for the sole source requirements as follows: Required training must be in accordance with 49 CFR and be conducted utilizing TSA required training curriculum. Additionally, training will include combative techniques and weapons firing training within an aircraft environment. The intended vendor provided training utilizing 150 seat aircraft. Shooting-Performance LLC is the only known source that can satisfy the Government's requirement. The Government will continue to search the market for vendors who can provide services that will fulfill the LEOFA Prisoner Escort training requirements. When requested, the ombudsman will maintain strict confidentiality as to the source of the concern. The existence of the ombudsman does not affect the authority of the program manager, contracting officer, or source selection official. Further, the ombudsman does not participate in the evaluation of proposals, the source selection process, or the adjudication of protests or formal contract disputes. The ombudsman may refer the interested party to another official who can resolve the concern. (b) Before consulting with an ombudsman, interested parties must first address their concerns, issues, disagreements, and/or recommendations to the contracting officer for resolution. Consulting an ombudsman does not alter or postpone the timelines for any other processes (e.g., agency level bid protests, GAO bid protests, requests for debriefings, employee-employer actions, contests of OMB Circular A-76 competition performance decisions).
