- INTRODUCTION PURSUANT TO FAR Subpart 5.2-Synopses of Proposed Contract Actions, THIS IS A PRE-SOLICITATION NOTICE OF A PROPOSED CONTRACT TO ACTION. THIS IS A PRE-SOLICITATION NON-COMPETITIVE NOTICE OF INTENT TO AWARD A CONTRACT OR PURCHASE ORDER WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME). The National Center for Advancing Translational Sciences (NCATS) at the National Institutes of Health (NIH) intends to award a purchase order to intends to negotiate and award a purchase order to Thermo Electron North America LLC for preventative maintenance services and emergency parts for Thermo Fisher analytical instruments. NORTH AMERICAN INDUSTRY CLASSIFICATION SYSTEM (NAICS) CODE The intended procurement is classified under NAICS code 811219 with a Size Standard of $20.5 million. REGULATORY AUTHORITY The resultant contract will include all applicable provisions and clauses of the Federal acquisition Requlation (FAR) in effect through the Federal Acquisition Circular (FAC) 2005-97, dated January 24, 2018. STATUTORY AUTHORITY This acquisition is conducted under the authority of the Federal Acquisition Regulation (FAR) Part 13-Simplified Acquisition Procedures, Subpart 13.106-1 (b) (1), Soliciting from a single source. DESCRIPTION OF REQUIREMENT Project Description Thermo Service Contract for ADME Bioanalytical Group in TRND biology Purpose and Objectives The Therapeutics for Rare and Neglected Diseases (TRND) program's mission is to encourage and speed the development of new treatments for diseases with high unmet medical needs. TRND stimulates therapeutic development research collaborations among NIH and academic scientists, nonprofit organizations, and pharmaceutical and biotechnology companies working on rare and neglected illnesses. To keep working towards this goal, TRND requires the continuation of a service contract for our Thermo instruments in the lab. The service agreement is for the following services and items: Support plan services for the Q Exactive Mass Spectrometer to include: unlimited number of demand on-site service visits with a maximum 72-hour response; engineer labor and travel is included; priority status for technical support inquiries; one (1) scheduled preventative maintenance visit; Thermo Scientific supplied personal computers are covered; factory-certified replacement parts included; software updates and notifications; subscription to e-Support Online Technical Resources; one-time 10% discount on parts, accessories or consumables for end user during active contract; and software updates and notifications. Updates are defined as software revisions that provide minor changes that are needed to correct or improve the previous version of the software. Software updates are normally indicated by a software revision number change e.g. version 1.1 to version 1.2. Computers purchased from Thermo and required for the operation of the system are covered under the support plan. Replacement of computers that required an upgrade to new operating systems are not included in the support plan. Support plan services for the UltiMate 3000 HPG-3400RS High Pressure M, UltiMate 3000 WPS-3000TRS Thermostatted, and UltiMate 3000 TCC-3000SD Thermostatted C to include: unlimited number of demand on-site service visits with a maximum 72-hour response; engineer labor and travel is included; priority status for technical support inquiries; one (1) scheduled preventative maintenance visit; Thermo Scientific supplied personal computers are covered; factory-certified replacement parts included; software updates and notifications; subscription to e-Support Online Technical Resources; one time 10% discount on parts, accessories or consumables for end user during active contract; and software updates and notifications. CLOSING STATEMENT This synopsis is not a request for competitive proposals. However, interested parties may identify their interest and capability to respond to this notice. Responses to this solicitation must include clear and convincing evidence of the offeror's capability of fulfilling the requirement as it relates to the technical evaluation criteria. The price proposal must include the labor categories, an estimate of the number of hours required for each labor category, fully loaded fixed hourly rate for each labor category, breakdown and rationale for other direct costs or materials, and the total amount. Responses to this notice must include sufficient information to establish the interested parties' bona fide capabilities of providing the product or service. The price quote shall include: total price, delivery date after receipt of order, and any other information or factors that may be considered in the award decision. Such factors may include: Factor 1 - Technical Approach: Offeror's technical approach shall be evaluated for completeness, feasibility, soundness, and practicality for accomplishing the requirements of the Statement of Work (SOW). Factor 2 - Delivery/Performance: Offeror's ability to meet or exceed the delivery date/period of performance in the SOW shall be evaluated. Factor 3 - Price/Cost: Offeror's price/cost shall be evaluated for fairness and reasonableness. Factor 4 - Past Performance: Offeror's past performance shall be evaluated based on one or more of the following: the contracting officer's knowledge of and previous experience with the supply or service being acquired; customer surveys, and past performance questionnaire replies; the Governmentwide Past Performance Information Retrieval System (PPIRS); or any other reasonable basis. In addition the Dun & Bradstreet Number (DUNS), the Taxpayer Identification Number (TIN), and the certification of business size must be included in the response. All offerors must have an active registration in the System for Award Management (SAM) www.sam.gov." A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. The information received will normally be considered solely for the purposes of determining whether to proceed on a non-competitive basis or to conduct a competitive procurement. All responses must be received by 11:59 AM Eastern Standard Time, Wednesday, April 18, 2018, and reference number NIHDA201800166.
