Description
Intent to Sole Source S3 Cell Sorter Dual Laser System The Department of Veterans Affairs intends to issue sole-source firm-fixed priced base + 2-year option to renew contract to Bio-Rad Laboratories, Inc., 2000 Alfred Noble Drive, Hercules, CA 94547. A sole source procurement will be issued to Bio-Rad Laboratories, Inc. because they are the only vendor capable of fully performing the service. Due to the specialized nature of the work it must be conducted by personnel with a high level of training and qualifications.   This procurement is being conducted in accordance with FAR Part 6.302-1 and 13.106-1(b)(2), soliciting from a single source.   The NAICS code is 811219 and has a size standard of $20.5 Million for this procurement. STATEMENT OF WORK SCOPE: Contractor shall furnish all labor, transportation, parts, and expertise necessary to perform preventative maintenance (PM) and repairs to the BIO-RAD S3 cell sorter. SERVICES TO BE PROVIDED: General: Contractor will provide the necessary manpower, supervision, tools, and parts to properly execute the PM and repair (as necessary) of the equipment listed above. Service Monday through Friday between 8am-5pm with the exception of all federal holidays and Saturdays and Sundays. A Field Service Report (FSR) must be generated and a copy given to the VAMC Memphis Point of Contact or designee after any work done on the instrument.. Maintenance and Repair: Any replacement of hardware on the S3 shall be followed by a thorough recalibration of the instrument. A certified BIO-RAD field service technician shall be flown out to the Memphis VAMC Research Service any time service is required but also to perform one PM visit per annum. All repairs shall be performed to manufacturer s specifications as written in the manufacturer guidelines and in accordance with good industry practice. SECURITY: Information Security: Contractor will not have access to VA network and all correlations will be through Vendors website and Contractors personal email. Contractor will report to Research Administration office supervisor or Director of Operations as to Check in / Check out. Contractor will be authorized within restricted areas by Director of Operations Approval. Video / Photography will be prohibited within the VA property. VA approved ID badge must be worn above the waist facing forward required on VA premises at all times. VA mandatory training will be required course VA10176 prior to work assignment and provided to the COR / Project Manager of the completed training certificate annually there afterwards. https://www.tms.va.gov/plateau/user/login.jsp.   "The Authorization requirements do not apply, and that a Security Accreditation Package is not required" 4. VA INFORMATION CUSTODIAL LANGUAGE The following standard Items relate to records generated in executing this contract: 1. Citations to pertinent laws, codes and regulations such as 44 U.S.C. Chapter 21, 29, 31 and 33; Freedom of Information Act (5 U.S.C. 552); Privacy Act (5 U.S.C. 552a); 36 CFR Part 1222 and Part 1228. 2. Contractor shall treat all deliverables under the contract as the property of the U.S. Government for which the Government Agency shall have unlimited rights to use, dispose of, or disclose such data contained therein as it determines to be in the public interest. 3. Contractor shall not create or maintain any records that are not specifically tied to or authorized by the contract using Government IT equipment and/or Government records. 4. Contractor shall not retain, use, sell, or disseminate copies of any deliverable that contains information covered by the Privacy Act of 1974 or that which is generally protected by the Freedom of Information Act. 5. Contractor shall not create or maintain any records containing any Government Agency records that are not specifically tied to or authorized by the contract. 6. The Government Agency owns the rights to all data/records produced as part of this contract. 7. The Government Agency owns the rights to all electronic information (electronic data, electronic information systems, electronic databases, etc.) and all supporting documentation created as part of this contract. Contractor must deliver sufficient technical documentation with all data deliverables to permit the agency to use the data. 8. Contractor agrees to comply with Federal and Agency records management policies, including those policies associated with the safeguarding of records covered by the Privacy Act of 1974. These policies include the preservation of all records created or received regardless of format [paper, electronic, etc.] or mode of transmission [e-mail, fax, etc.] or state of completion [draft, final, etc.]. 9. No disposition of documents will be allowed without the prior written consent of the Contracting Officer. The Agency and its contractors are responsible for preventing the alienation or unauthorized destruction of records, including all forms of mutilation. Willful and unlawful destruction, damage or alienation of Federal records is subject to the fines and penalties imposed by 18 U.S.C. 2701. Records may not be removed from the legal custody of the Agency or destroyed without regard to the provisions of the agency records schedules. 10. Contractor is required to obtain the Contracting Officer's approval prior to engaging in any contractual relationship (sub-contractor) in support of this contract requiring the disclosure of information, documentary material and/or records generated under or relating to this contract. The Contractor (and any sub-contractor) is required to abide by Government and Agency guidance for protecting sensitive and proprietary information. This notice of intent is not a request for competitive quotes. However, interested parties may identify their interest and capability to respond to the requirement and submit quotations no later than 10am CST, April 23, 2018 to: kevin.cochran2@va.gov Responses received will be evaluated; however, a determination by the Government not to compete the proposed procurement based upon responses received to this notice is solely within the discretion of the Government. The Government reserves the right to use information provided by respondents for any purpose deemed necessary and legally appropriate. Respondents are advised that the Government is under no obligation to acknowledge receipt of the information received or provide feedback to respondents with respect to any information submitted. After a review of the responses received, a pre-solicitation synopsis and solicitation may be published in Federal Business Opportunities. However, responses to this notice will not be considered adequate responses to a solicitation. Determination by the Government not to compete the proposed procurement based upon responses received to this notice is solely within the discretion of the Government.
