52.212-5 Contract Terms and Conditions Required to Implement Statutes or Executive Orders Commercial Items (Jan 2018) - Please see attached This notice is a Notice of Intent. This notice is published in accordance with Federal Acquisition Regulation (FAR) 5.101(a)(1) requiring dissemination of information regarding proposed contract actions. This is a Notice of Intent to award a Sole Source Firm Fixed Price Contract under the authority of 41 U.S.C. 3304(a)(1), as implemented by FAR 13.106-1(b) - Only One Responsible Source and No Other Supplies or Service Will Satisfy Agency Requirements, and is not a request for competitive quotes. The National Institute of Allergy and Infectious Diseases (NIAID), Rocky Mountain Laboratories (RML), intends to negotiate on a sole source basis with Life Technologies Corporation, 5781 Van Allen Way, Carlsbad, CA, 92008-7321, UNITED STATES, for the procurement of EVOS Microscope and components. Below is a list of items being procured. EVOS Auto FL Imaging System 22" Multi-Touch Monitor External PC with 16 GB RAM FL Auto Accessory kit 3 US Power Cords Condenser Slider, Diffusion Condenser Slider, Block Vessel Holder for Slides (AMEPVH001) Intermediate Stage Plate (AMEPVH022) Light Shield Dust Cover USB A to B cable (6Ft)/ DVI cable (6Ft) USB stick Cartridge Extraction Tool Corded Optical USB Mouse Light Cube Access Door On-site installation One-year warranty License/Certification (CE and ETL approved) The North American Industry Classification System (NAICS) code for this procurement is 334516 Analytical Laboratory Instrument Manufacturing with a small business size standard of 1000 employees. Life Technologies is an "other than small business". This will be the only notice of the Government's intent to solicit, negotiated, and award to one source to satisfy this requirement. The Government plans to award a contract for this requirement within 15 days of this notice. While this synopsis does not constitute a solicitation, interested vendors may identify their interest and capability to satisfy this requirement. The Government understands that Life Technologies is the only vendor which can provide the requested services for NIAID. However, firms that believe they can provide the capability required to fully meet the Government's requirement may submit a capabilities statement, including past performance, in writing to the identified point of contact within fifteen (15) days after publication of this notice. Such documentation shall be evaluated solely for the purpose of determining whether or not to conduct this procurement on a competitive basis. A determination not to compete this requirement, based upon responses to this notice, is solely within the discretion of the Government. Interested parties may identify their interest and capability to respond to the requirement or submit offers on NOI # 1901877.
