- 6 April 2018 SBEAS UPDATE Industry Partners, The purpose of this update is to provide industry with the latest status of the SBEAS Source Selection in an effort to continue to be as transparent as possible regarding this acquisition. Several factors impacted the original anticipated award date for the SBEAS acquisition, resulting in the anticipated award date moving to 3 rd quarter (July-September) fiscal year 2019. Volume and Quality: The volume of proposals received in response to the solicitation was not anticipated. Additionally, d espite the transparency provided during the Industry days, one-on-one sessions and three sets of questions and answers from Industry prior to and immediately following the release of the RFP, we've had to remove offerors for not complying with the solicitation and failing to address the evaluation criteria. Protests: To date, all protests that have been filed were done so by offerors who were removed for being non-compliant. There have been a total of eight (8) protests filed at either the agency or GAO level and as such, these protests divert time from the evaluations and could have been avoided if the protesting offerors had simply taken the time to follow the instructions. The decisions issued for the protests filed, either at the agency or GAO level, resulted in only two agency protests being granted the relief sought (being placed back in the competition), while the other protests were dismissed, denied or withdrawn. Award Notifications: The Government received several inquiries about the "down selections" of proposing offerors. This is not a term that the Government defined or used as a part of the SBEAS solicitation to identify how offerors would be selected for award. In accordance with the FAR and the SBEAS solicitation, offerors eliminated from the competition will be notified promptly. As a result, those offerors who have been eliminated have been notified. This does not constitute a down-select or completion of the Government's evaluation of all proposals that were received. The Government would also like to reiterate there will be no discussions held. Additionally, the Government does not plan to seek clarifications. The ITO clearly states at paragraph 1.0 (b) "All the requirements specified in the solicitation are mandatory.... As defined by Satellite Servs., Inc., B-295866, B-295866.2, Apr. 20, 2005, 2005 CPD ¶ 84 at 2 n.2, "[c]larifications are 'limited exchanges' that agencies may use to allow offerors to clarify certain aspects of their proposals or to resolve minor or clerical mistakes. FAR § 15.306(a)." While the Government has the right to seek clarifications, the Government is not required to seek clarifications.
