Description
SOLE SOURCE JUSTIFICATION 1. Agency/Contracting Activity: U.S. Army Engineer District, Savannah, 100 West Oglethorpe Avenue, Savannah, GA 31401 2. Description of Action: Nature: New Requirement Follow-on Requirement Mod to Existing Purchase Order/Contract Number I Pricing: Firm-Fixed Price Time & Materials Funds: OMA Other Funds: Name of Proposed Contractor(s): Institute for Bird Populations Street Address: PO Box 1346 City, State, Zip: Point Reyes Station, CA, 94956 Phone: 505-870-3735 3. Description of Services or Supplies: The total estimated value of the proposed action is $ 156,056.00 for Base year and two option periods. The Monitoring Avian Productivity and Survivorship (MAPS) Program comprises a continent - wide network of hundreds of constant-effort mist netting stations. Analyses of the resulting banding data provide critical information relating to the ecology, conservation, and management of North American land bird populations, and the factors responsible for changes in their populations. IBP is the proprietor of such data. Gathering baselin e informat ion on existing biological resources is a critical step in the formulation of long-term monitoring strategies. To help decide how to best allocate scarce resources to avian monitoring efforts, land managers often require detailed information about the current diversity, distribution, and abundance of birds that depend on the lands they manage. According ly, IBP has established its Avian Inventory Program which assists biologists and land managers overseeing national parks and other public lands by designing and implementing scientifically sound avian inventory projects. In 1990, Congress passed legislation establishing the Legacy Resource Management Program to provide financial assistance to the Department of Defense (DoD) efforts to preserve our natural and cultural heritage. The program assists DoD in protecting and enhancing resources while supporting military readiness. Since 1990, TBP has provided DoD installations with reports summarizing regional and program -wide results of the Monitoring Avian Productivity and Survivorship {MAPS) Program using data from over 400 MAPS stations annually operated in a constant-effort manner and have detected significant findings in population dynamics among regions. 4. Authority: Action using simplified acquisition procedures: FAR 6.302-3: IAW 10 U.S.C. 2304(c)(3). (1) Full and open competition need not be provided for when it is necessary to award the contract to a particular source or sources in order-- (i) To maintain a facility, producer, manufacturer, or other supplier available for furnishing supplies or services in case of a national emergency or to achieve industrial mobilization, (ii) To establish or maintain an essential engineering, research, or development capability to be provided by an educational or other nonprofit institution or a federally funded research and development center, or (iii) To acquire the services of an expert or neutral person for any current or anticipated litigation or dispute. 5. Reasons for Authority Cited: Monitoring Avian Productivity and Survivorship (MAPS) Stations contract identifies the following reasons for sole source: MAPS is a breeding bird monitoring program conducted on over 500 stations Nationwide. This program is a major component of DoD's Partners in Flight interagency songbird conservat i on initiative. DoD has a standing relationship with the nonprofit organization, the Institute for Bird Populations (IBP), to train volunteers for MAPS station.completion and oversight. The Institute for Bird Populations (IBP) is the principle investigator for DoD/MAPS monitoring. They are a nonprofit organization who developed the protocol/database and are dedicated to establish, coordinate, and manage the data for the entire MA PS program. All MAPS monitoring must be conducted through this established program due to proprietary database. IBP has conducted fort Bragg MAPS stations via sole source contracts at both the DoD and Bragg levels since l 995. In such a capacity they have developed extensive volunteer assistance pools for use on Fort Bragg with this combination contract/volunteer program. 6. Actions to Increase Competition: The requirement of these services cannot reasonably be met by a new solicitation because of the lack of knowledge and availability of proprietary database. There is no other source equally qualified to provide necessary requirements. 7. Market Research: A sources sought was posted on Federal Business Opportunities website on March 3, 2018 and closed March 13, 2018. There were no responses from interested parties that could perform the work. 8. Yes No 9. Additional Facts and/or Information to support the justification. This is a purchase order requiring experience and access to a unique database for management of monitoring avian populations. In accordance with FAR 6.302-3(a)(2)(ii), "For DOD, NASA, and the Coast Guard, services may be deemed to be available only from the original source in the case of follow-on contracts for the continued prov ision of highly specialized services when it is likely that award to any other source would result in (A) Substantial duplication of cost to the Government that is not expected to be recovered through competition or (B) Unacceptable delays in fulfilling the agency's requirements." 10.
