Description

This is a special notice prepared in accordance with Federal Acquisition Regulation (FAR) 5.2 "Synopses of Proposed Contract Actions." US Army Corps of Engineers (USACE), Portland District intends to negotiate/award a sole-source purchase order with IHC America Inc. USACE requires the acquisition of two new weir overflow hydraulic cylinders and two bottom door hydraulic cylinders for the U.S. Army Corps of Engineers dredge Essayons to ensure continued dredge operation. The original equipment manufacturer, IHC America Inc., is the sole proprietor of parts conforming to the requirements. The overflow and hopper door systems are proprietary designs of IHC. IHC America is the domestic agent for the original manufacturer. Alternative non-OEM parts cannot meet the requirement. The statutory authority for this non-competitive acquisition is FAR 13.106(b)(1) For actions for commercial supplies or services not exceeding the Simplified Acquisition Threshold (SAT), the requirements of FAR 13.106(b)(1) apply to single source acquisitions conducted pursuant to FAR part 13. A SOLICITATION WILL NOT BE POSTED. The Government intends to proceed with this sole source action. The NAICS code is 336611 - Ship Building and Repair. The size standard for this NAICS code defined by the U.S. Small Business Administration is 1,250 employees. THIS NOTICE IS NOT A REQUEST FOR COMPETITIVE PROPOSALS OR QUOTATIONS. A determination by the Government not to compete this proposed requirement is solely within the discretion of the Government.
