- National Cemetery Administration NCA Pacific District 1301 Clay Street, Suite 1230 North Oakland, CA 94612-5209 JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION FAR 6.302-5, 41 U.S.C. 334 (a) (5) Lady Vets Services INC; 9018-000047 1 Page 2 of 2 1. Agency and Contracting Activity Identification: The National Cemetery Administration ( NCA), Pacific District, 1301 Clay Street, Suite 1230 North, Oakland CA 94612-5209, as directed by the NCA Riverside National Cemetery will enter into a Purchase Order that requires justification for other than full and open competition procedures. 2. Nature of Acquisition Being Approved: Riverside National Cemetery Grounds Maintenance Services. Award shall be made through other than full and open competition to Lady Vets Services INC, utilizing the VA s sole authority to award contract to Service Disabled Veteran Owned Small Businesses. 3. Description of Requirement: The awarded contractor is to provide Mowing services. The period of performance shall be from April 01, 2018 through September 30, 2018. The estimated cost is $491,495.80. 4. Statutory Authority Permitting Other Than Full and Open Competition: The Services are being procured under the authority of FAR 6.302-5, 41 U.S.C. 334 (a) (5) in conjunction with VAAR 819.7007 Sole source awards to service-disabled Veteran-owned small business concerns. 5. The Nature of the Acquisition Requires Use of the Authority Cited: FAR Part 6.302-5/ VAAR 819.7007. This Authority is for sole source to a SDVOSB company without seeking competition so long as the contract is awarded to a certified SDVOSB company listed on Vetbiz.gov. The rule of 2 does not apply in this case. 6. A Description of Efforts Made to Ensure That Offers From as Many Potential Sources As Practicable and Whether a Notice Will Be Publicized. A notice shall be posted in accordance with FAR part 5 procedures. This requirement will be competed and awarded on a SDVOSB competitive set-aside after this temporary contract vehicle is in place 7. Anticipated Cost: The anticipated cost is be fair and reasonable to the government based upon comparative service pricing from past competed requirements awarded and the government cost estimate. Lady Vets services submitted pricing that is 10% less than the prior SDVOSB award. 8. Results of Market Survey: Market research indicates that many companies able to provide the service. This requirement will be a competitive SDVOSB set aside while this contract vehicle is in place. Several SDVOSB companies have been notified of this expected requirement which the long-term contract is expected to be awarded on 10/01/2018 (FY19). 9. Any Other Facts Supporting the Use of Other Than Full and Open Competition: 819.7007(4)(b) Sole source awards to service-disabled Veteran-owned small business concerns. The contracting officer s determination whether to make a sole source award is a business decision wholly within the discretion of the contracting officer. A determination that only one SDVOSB concern is available to meet the requirement is not required. 10. Any Other Interested Sources? There are many SDVOSB companies interested on the long-term solicitation. This current justification is for the short term (6 Months) interim agreement. 11. A Statement of the Actions, if any, the Agency May Take To Remove of Overcome Any Barriers to Competition Before Any Subsequent Acquisition is required: It is anticipated that this requirement shall be made competitive while this contract vehicle is in place to avoid interruption in services. 12.
