- Intent to Sole Source NOTICE OF INTENT TO NEGOTIATE A SOLE-SOURCE CONTRACT The US Department of Commerce (DOC), National Oceanic and Atmospheric Administration (NOAA), Eastern Region Acquisition Division, Simplified Acquisition Branch intends to negotiate on a sole source basis with Industrial Economics, Inc., 2067 Massachusetts Ave. Suite 4, Cambridge, MA 02140 using the procedures in FAR Part 13, to provide an economic analysis supporting critical habitat designations for three distinct population segments of the humpback whale. The National Marine Fisheries Service requires the necessary personnel, material, equipment, services, and facilities to estimate the economic impact of a critical habitat designation for the Western North Pacific, Central American, and Mexico distinct population segments (DPSs) of humpback whales under the Endangered Species Act (ESA). The economic analysis must also inform the evaluation of compliance with Executive Order 12866, the Regulatory Flexibility Act, Executive Order 13211, Executive Order 12630, and the Unfunded Mandates Reform Act. The economic analysis is expected to be completed within a year, with an option to extend the contract to accommodate mandated review and clearance processes. The final deliverable will be a written, peer-reviewed report. The statutory authority for other than full and open competition is FAR 13.106-1(b)(1)(i), Only one responsible source. This is not a solicitation for competitive quotes. However, if any other interested party believes that it can meet the requirements, it may submit a statement of capabilities, which if timely received, will be considered by NOAA. A statement of capabilities must be received by 11:00 am, April 4, 2018 to be considered by the Government. A determination by the Government not to compete this proposed requirement based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement in the future. Evidence must be provided of ability to provide the required services. The capability statement and any other information furnished must be in writing, and must contain material in sufficient detail to allow NOAA to determine if the party can meet all of the foregoing requirements.
