- U.S. General Services Administration GSA Region 7 Leasing Division Justification for Other than Full and Open Competition Lease Number: GS-07B-15015 Project Number: 8AR2105 Agency Name: Courts, Probation, US Attorneys, SSA, & US Marshals Estimated Contract Value: $483,939.14 1. Identification and Description of Action Being Approved: The General Services Administration currently leases 19,561 rentable square feet (RSF) of office space at 615 S Main St, Jonesboro, AR under lease number GS-07B-15015 for the Courts, Probation, USMS, USAO, and SSA. The current lease expired 12/31/17. Approval is requested to negotiate a lease extension with the incumbent lessor without full and open competition for continued occupancy at this lease location. 2. Description of Supplies or Services Required: Lease GS-07B-15015 for 19,561 RSF, expired on 12/31/17. The space is located in the EC Gathings Fed Courthouse at 615 S Main St in Jonesboro, AR and is currently occupied by Courts, Probation, USMS, USAO, and SSA. The current Lessor is Mark Dattel. The current lease includes courtroom, office, and other related space for the tenants. This proposal will extend the current lease 12 months to provide sufficient time to build-out the new/replacing lease space. 3. Identification of Statutory Authority: GSAM 570.405 (c) specifies that FAR 6.302-1 applies to lease extensions in certain situations related to protecting the Governments current occupancy until replacement space is ready for occupancy. FAR 6.302-1 is the implementing regulation for 41 U.S.C. 253 (c)(1) - Only one responsible source and no other supplies or services will satisfy agency requirements. 4. Demonstration that the Acquisition Requires use of the Authority Cited: An extension is required to protect the Government's occupancy until the replacement space is occupied. It is not reasonable to duplicate the tenant's existing space at another location while replacement space is being acquired. 5. Description of Efforts to Solicit as Many Offers as Practical: Exception to Advertising: GSAM 570.106(d) provides that the contracting officer need not publicize the proposed acquisition of a leasehold interest in real property by lease extension under the conditions defined in 570.405. 6. Demonstration that the Anticipated Cost will be Fair and Reasonable: GSA is currently paying $24.74 per RSF, fully serviced for 19,561 RSF at 615 S Main St in Jonesboro, AR. The estimated square footage to be acquired under the lease extension is 19,561 RSF (14,314 ABOA). On February 15, 2018, market research was generated within the Jonesboro, AR area using CoStar and existing GSA lease data. According to the market data, the average rate is $24.19 per RSF. If GSA executes a 12-month extension, the anticipated rate will not exceed 10% above the market mid-point, or $26.61 per RSF. The incumbent lessor provided an estimated asking rate of $24.74 per RSF for the extension period. 7. Description of the Market Survey Conducted: Market research within the Jonesboro, AR area using CoStar properties and existing GSA lease data. 8. Other Facts Supporting the use of Other Than Full and Open Competition: The current Lessor is responsive and is meeting the requirements of the lease. The current leased location meets the agency's requirements. 9. List of Sources that Expressed an Interest in the Acquisition: Incumbent - Mark Dattel 10. Statement of Actions to Overcome Barriers to Competition: The lease action to provide long term replacement space provides the opportunity for full and open competition where alternative space is available and seeking competition is in the best interest of the Government. The Government continually strives to improve processes which will minimize the need for extensions. 11. CONTRACTING OFFICER CERTIFICATION By signature on this justification for Other than Full and Open Competition, the Contracting Officer certifies that the award of a lease extension of 19,561 RSF is in the Government's best interest and that this Justification is accurate and complete to the best of my knowledge and belief. 12.
