Maritime Law Enforcement Advisor Manila, Philippines Issuance Date: 03/05/2018 Closing Date: 03/19/2018 SOLICITATION NUMBER: PSC-18-012-INL SUBJECT A solicitation for a Personal Services Contractor (PSC), Department of State (DOS), Bureau for International Narcotics and Law Enforcement Affairs (INL) The United States Government (USG), represented by the DOS, seeks applications from US citizens interested in providing PSC services as described in this solicitation. PRE-AWARD ETHICAL RESPONSIBILITIES OF PSC (JUN 2011) This solicitation may result in the award of one or more personal services contracts as defined in FAR 2.101. Prior to contract award, all offerors or quotes must advise the cognizant Contracting Officer if they have a personal conflict of interest, such as a financial conflict, that would prevent them from either meeting the requirements of the clause entitled, "Post-Award Ethical Responsibilities of Personal Services Contractors," or otherwise objectively performing their contractual duties upon contract award. HOW TO APPLY Offerors proposal shall be in accordance with the requirements stated in this solicitation at the place and time specified. A proposal will be determined non-responsive and ineligible for consideration unless all required documents and information are included in the submission. Offerors shall ensure their resume demonstrates their possession of the minimum qualifications outlined in this Solicitation, as well as their ability to fulfill all required duties. The Government is not responsible for any costs incurred by the offeror during the solicitation process. NOTE REGARDING GOVERNMENT OBLIGATIONS FOR THIS SOLICITATION This solicitation in no way obligates the Department of State to award a PSC contract, nor does it commit the Department of State to pay any cost incurred in the preparation and submission of the application. POSITION TITLE: INL Maritime Law Enforcement Advisor 6. MARKET VALUE: $85,181 - $125,091 (FS-02 Equivalent) 7. PERIOD OF PERFORMANCE: One year from date of award, with four optional years 8. PLACE OF PERFORMANCE: Manila, Philippines 9. JOB DESCRIPTION: See below GENERAL STATEMENT OF THE PURPOSE OF THIS CONTRACT The Bureau of International Narcotics and Law Enforcement Affairs, Office of Europe and Asia (INL/EA), is responsible for the development, supervision, coordination and implementation of international law enforcement assistance activities and international criminal justice issues for the Department of State. This Personal Service Contract (PSC) position will report to the International Narcotics and Law Enforcement Affairs (INL) Director at the U.S. Embassy in Manila, Philippines. INL/EA has a substantial maritime law enforcement initiative underway in Southeast Asia. Existing regional and bilateral maritime law enforcement programs with Indonesia, Malaysia, the Philippines, and Vietnam focus on developing institutional functions and strengthening operational capabilities in the maritime domain. INL Manila is managing more than $10 million in maritime law enforcement assistance funds and coordinating with partners such as Joint U.S. Military Assistance Group (JUSMAG), Defense Threat Reduction Agency (DTRA), and Joint Interagency Task Force West (JIATFW) an even greater investment by these organizations in bilateral maritime law enforcement and related technical assistance programs in the Philippines. The maritime law enforcement assistance is focused primarily on Philippine Coast Guard (PCG), National Coast Watch System, and Philippine National Police-Maritime Group. Several of the projects currently in the initial stages of development such as the construction and startup of a PCG Technical and Maritime Training Center involve joint investments by the Government of the Philippines, JUSMAG, JIATFW, and INL. This assistance will support INL's continuing training and capacity building efforts for these maritime law enforcement organizations. This significant level of INL assistance, coupled with substantial and complex interagency and bilateral cooperation, require a dedicated Maritime Law Enforcement Advisor at INL Manila to adequately address planning, programming, budgeting oversight, coordination, and of these programs. The INL Maritime Law Enforcement Advisor also will provide expertise and guidance to assist the Government of the Philippines in its ability to assert law enforcement authority and control within its maritime domain. The purpose of the Maritime Law Enforcement Advisor is to contribute to the whole-of-government strategy to strengthen the institutional capacity of the Philippines' coastal and riverine forces involved in maritime law enforcement and the disruption of transnational criminal networks in the maritime environment. The Advisor will also work with colleagues and counterparts in the U.S. Government and the Government of the Philippines to foster maritime law enforcement cooperation throughout Philippine security forces. The Advisor will reside in Manila, with considerable time spent traveling and working in the field with INL's implementing partners. The Advisor will also serve as one of Embassy Manila's primary points of contact on issues of maritime law enforcement with the Government of the Philippines and participate in a joint working group with the PCG regarding the implementation of the bilateral maritime law enforcement program with the Philippines. The Advisor exercises expert judgment in providing recommendations for actions relating to initiating projects and executing approved new programs under general supervision and is expected to coordinate as functionally appropriate with other INL units in the region, Washington, and U.S. government interagency counterparts to accomplish the purposes of this initiative. Completed work is reviewed for timeliness and effectiveness. The Advisor will perform the full range of assistance project management skills, including planning, budgeting, procurement, contracting, monitoring and evaluation, and other tasks or duties assigned on an ad hoc basis. DUTIES AND RESPONSIBILITIES 1. Serve as the advisor for INL's maritime law enforcement program in the Philippines. 2. Serve as a point of contact for the INL-funded maritime law enforcement programs in the Philippines. 3. Provide regular reporting to the Embassy INL Director on program implementation and maritime law enforcement issues in the Philippines. 4. Design and implement program activities to improve maritime and regular law enforcement coordination and interoperability. 5. Develop program designs, performance monitoring plans, and evaluation planning for projects in support of maritime law enforcement capacity-building. 6. Coordinate interagency efforts with relevant USG partners. 7. Coordinate with other U.S. Embassies and maritime law enforcement program in the Philippines. 8. Coordinate with other donors active in maritime law enforcement. 9. Draft policy and advocacy papers, attend meetings and conferences. Facilitate exchange of information and practices to ensure robust communication on maritime law enforcement. 10. Prepare background materials and reports to be used by U.S. Government officials in preparing speeches, briefings, and 11. Supervise locally-hired staff, as needed. TRAININGS & DISTANCE LEARNING COURSES 1. Completes the Contracting Officer Representative (PA296) distance-learning (DL) course through the Foreign Service Institute (FSI) within 120 days of arriving at Post. 2. Completes the Introduction to Working in an Embassy (PN113) distance-learning (DL) course through the Foreign Service Institute (FSI) within the first six (6) months of arriving at Post. 3. If applicable - Completes the mandatory Foreign Affairs Counter-Threat (FACT) Course (OT610) prior to deployment to Post. RELATIONSHIPS The Maritime Law Enforcement Advisor will report to the INL Director in Manila. The Maritime Law Enforcement Advisor position will be included in Embassy Manila's staffing pattern with assigned office space and support services. The Maritime Law Enforcement Advisor will report on a day-to-day basis to the INL Director. The Maritime Law Enforcement Advisor may oversee the work of Locally Employed Staff, as directed. Internal travel may be required, as approved by the INL Director. The Contracting Officer's Representative (COR) is delegated the authority to act for the Contracting Officer in matters concerning technical clarification, inspection and, after concurrence by the Contracting Officer, acceptance of Contractor performance under the contract, including preparation of receiving reports, and the authorization of progress payments when appropriate. The COR will coordinate all work with the Contractor and review Contractor's performance at significant stages of its development. In no instance, however, shall the COR be authorized to alter or modify the specifications or the contract terms and the conditions or waive the government's requirement, price, delivery, or other terms and conditions. Such changes must be authorized, in writing, to the Contracting Officer. DELIVERABLES/REPORTS Deliverables are required under this PSC and shall include; monthly status reports, monthly evaluation of contractor performance, special reports when required and "Completion of assignment report," which shall be a compressive review of the projects in which the contractor was involved. Each report shall include a critique of and recommendations for the various projects. The completions of assignment reports are due no later than fifteen (15) days prior to the expiration of this contract. The Personal Service Contractor shall submit two (2) copies of each report as required to the following; 1. INL/POST Director(s) and; 2. INL/Program Officer Per FAR Part 4, the above referenced documents shall be incorporated and copies stored in the PSC's hard file under Section V.; Tab E - Receiving Reports. The Contractor shall prepare and submit two copies of each technical report required by the schedule of this contract (e.g., progress reports, final reports, etc.), to the Embassy INL Section and to the Program Officer, Bureau of International Narcotics and Law Enforcement Affairs (INL), Department of State Washington, DC. The title page of all reports forwarded pursuant to this paragraph shall include a descriptive title, the author's name(s), contract number, project number, and title, contractor's name, name of the State Department project office, and the publication or issuance date of the report. When preparing reports, the Contractor shall refrain from using elaborate artwork, multicolor printing, and expensive paper/binding, unless it is specifically authorized in the Contract Schedule. Wherever possible, pages should be printed on both sides using single spaced type. COMPLEXITY This position involves planning, organizing and completing financial and organizational analysis of enormous complexity. Due to the high visibility and political sensitivity of the issues in which INL is involved, there is extreme difficulty in identifying the nature of the issues and planning, organizing and determining the scope and depth of studies/audits to be undertaken. The PSC is expected to address difficult scenarios by separating the substantive nature of the programs or issues into their components and determining the nature and magnitude of programs or issues, as well as in discerning the intent of the legislation and policy statements and determining how to translate the intent into program actions. SCOPE AND EFFECTIVENESS The PSC performs broad and extensive assignments related to a complex administrative/financial program spanning the full-range of citizen safety, law enforcement, rule of law, and counternarcotics programs in the Philippines, which is of significant interest to the public and to Congress. MINIMUM REQUIREMENTS 1. U.S. citizenship; able to obtain/maintain Department of State Secret and Medical Clearances, and ethics, if applicable. 2. Minimum of a Bachelor's Degree from an accredited institution plus five (5) years of related experience; or Associate's degree plus seven (7) years of related experience; or ten (10) years of related experience in the fields of international development, law enforcement, international relations, and/or public administration. 3. Proficiency in Microsoft Office. 4. Excellent oral and written English communication, negotiation and interpersonal skills. 5. Demonstrated experience in Maritime Law Enforcement PREFERRED KNOWLEDGE AND SKILLS 1. Experience in planning, managing, implementing, and coordinating U.S. maritime matters relating to U.S. Coast Guard or other maritime entities, activities, systems, equipment and resources applicable to waterways, coastal and international waters. 2. Experience with U.S. contracting procedures and procurement mechanisms. 3. Prior experience working in Southeast Asia. 4. Experience in strategic planning and policy development. 5. Experience working with the international organizations and foreign government representatives. 6. Experience working with U.S. Embassies overseas. 7. Experience or familiarity with coordinating with U.S. Department of Defense interlocutors and/or the U.S. Coast Guard. GOVERNMENT-FURNISHED EQUIPMENT The PSC shall be able to use a furnished with office space, a computer, office telephone, and other supplies needed for job requirements. This property will be owned and maintained by the Department of State DoS. TRAVEL REQUIREMENTS Travel may be required, as approved by the INL Director. PRE-DEPLOYMENT REQUIREMENTS 1. If applicable - Consultations with the INL Program Office may be required. EVALUATION CRITERIA Factor 1: Program Management: (25 points) Experience in overseas program management. Experience in assessing, analyzing, and planning programs. Experience in training, procurement, program planning, execution, monitoring and evaluation. Knowledge and understanding of INL, Federal Acquisition Regulation (FAR), and U.S. federal government procurement. Supervisory experience. Factor 2: Liaison: (20 points) Ability to conduct liaison activities with USG agencies, Host Nation representatives, and the international community to develop and coordinate rule of law programs. Demonstrable ability to communicate in English, both orally and in writing, including through written reports. Factor 3: Subject Matter Experience (25 points) Experience working in marine law enforcement and on criminal justice and/or law enforcement in Southeast Asia, the Philippines in particular. Experience coordinating multi-agency law enforcement programs in an international setting. Factor 4: Past Performance: (30 points) Past performance evaluation of applicant's ability to perform under the contract. In conducting the evaluation, the USG reserves the right to utilize all evaluation information available at the time of evaluation, whether provided by the applicant or obtained from other sources. The most qualified candidates may be interviewed, required to provide a writing sample, and demonstrate an ability to operate commonly used office applications. INL will not pay for any expenses associated with the interviews. In addition, applications (written materials and interviews) will be evaluated based on content as well as on the applicant's writing, presentation, and communication skills. In the event that a candidate has fully demonstrated his/her qualifications and there are no other competitive applicants, INL reserves the right to forego the interview process. Professional references and academic credentials will be evaluated for applicants being considered for selection. COMPENSATION (BASE PAY) For award, INL will negotiate for this contract based on the market value as outlined above and overall experience relevant to the solicitation requirements.
