Description
NOTICE OF INTENT TO AWARD A SOLE SOURCE The US Army National Ground Intelligence Center (NGIC) intends to utilize other than full and open competition procedures to procure stand-alone licenses for maintenance and technical support services associated with existing MuSES software, currently in use by the agency. The anticipated source for this requirement is ThermoAnalytics, Inc., 23440 Airpark Blvd - Calumet, MI 49913-9233. This acquisition will be processed under FAR Part 12 - Acquisition for Commercial Items and will be made pursuant to the authority in FAR Part 13.501(a)(1). The North American Industry Classification System Code (NAICS) for this requirement is 511210 with the size standard of $38.5 million. The Federal Supply Code (FSC) / Product Service Code (PSC) is D319. Only one award will be made as a result of this solicitation. This will be awarded as a firm-fixed price type of contract. ThermoAnalytics software programs are protected by trade secrets and provide unique capabilities for thermal and infrared simulation. There are no other known sources able to meet agency requirements. The statutory authority for this sole source requirement is 41 U.S.C. 253 (c) (1) as implemented by FAR 6.302-1 only one source available, no substitutions possible. THIS IS NOT A SOLICITATION FOR COMPETITIVE QUOTATIONS. Interested parties must show clear and convincing evidence that competition would be advantageous to the Government. Information must be submitted by email (subject line to reference W26MT973311801) to John Hull at john.r.hull31civ@mail.mil, by 1:00 pm eastern standard time on Wednesday, January 31, 2018. Responses received will be considered solely for the purpose of determining whether or not to conduct a competitive procurement. A determination by the Government not to compete the proposed procurement action, based upon response to this notice, is solely within the discretion of the Government. No reimbursement for any cost connected with providing capability information will be provided.
