DEPARTMENT OF VETERANS AFFAIRS Justification and Approval (J&A) For Other Than Full and Open Competition (>$150K) Acquisition Plan Action ID:__VA263-17-AP-12599____________________ Contracting Activity: Department of Veterans Affairs, Network Contracting Office 23, Service Team, 2501 W 22nd Street, Sioux Falls, SD 57105, Purchase Request 636-18-1-018-0001 Nature and/or Description of the Action Being Processed: The purchase order contemplated will be for a firm-fixed price purchase order to EBSCO Publishing 10 Estes Street, Ipswich, MA 01938 FAR13.5 Simplified Procedures for Certain Commercial Items: This procurement is for EBSCOHost Database in accordance with FAR 13.5 Simplified Procedures for Certain Commercial Items and specifically FAR 13.501 Special Documentation Requirements, where acquisitions conducted under Simplified Acquisition Procedures are exempt from the requirements of FAR Part 6, but still require a justification using the format of FAR 6.303-2. Description of Supplies/Services Required to Meet the Agency s Needs: The Nebraska Western Iowa Health Care System Library, requires a commercial off the shelf web based, full text, online subscription to a unique source of current medical evidence that will be made available for clinical staff in the Nebraska Western Iowa Health Care System network. The information platform will include: CINAHL, MEDLINE, Dentistry and Oral Sciences Source. IGCE: $150,000 POP: 1/1/2018 to 12/31/2018 Plus 4 Option Years Statutory Authority Permitting Other than Full and Open Competition: 41 USC §253(c)(1), as implemented by FAR 6.302.1 Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302.1 FAR13.5 Simplified Procedures for Certain Commercial Items: The authority for applying the Simplified Procedures for Commercial Items of FAR 13.5 is 41 U.S.C. 1901 and is implemented by for restricting competition on this procurement via FAR 13.106-1(b)(2). Demonstration that the Contractor s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): The EBSCOHost databases are unique in the number of titles and breadth of subject matter contained. The databases are mounted on a proprietary comprehensive search platform that integrates search strategies across the databases. A comparative search of these databases compared to single publisher databases (Wiley, Springer, Elsevier etc.) already covered by VA Library National Office database subscriptions has confirmed the highest level of complementary coverage. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: An RFI for Sources Sought was posted to FBO on December 11, 2017 for 3 days with zero companies responding or showing interest. An intent to sole source will also be posted to FBO for a total of 10 days. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: Since EBSCO is a commercially available product, price will be determined fair and reasonable by the Contracting Officer by comparing prices to same or similar services. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: The AbilityOne Procurement List was checked for additions prior to January 7, 2010 for EBSCOHost Database Services at all four locations with 0 results. Priority provided by law under 38 U.S. Code § 8127 (Public Law 109-461) - The Veterans Beefits, Health Care, and Information Technology Act. Section 8127(d) s contracting pocedures are mandatory and apply to all of VA s contracting determinations including Federal Supply Schedule procurements. The Contracting Officer shall award contracts based on competition restricted to small business concerns owned and controlled by veterans if the CO has a reasonable expectation that two or more small business concerns owned and controlled by veterans will submit offers and that the award can be made at a fair and reasonable price that offers best value to the government. A search on OSDBU s VIP database using NAICS code 519130 and a keyword of Database yielded 11 results of small businesses that are service disabled veteran owned and verified and 1 Veteran owned and verifed. Of the 12 companies none of them responded to RFI 36C26318Q9133. There is not an expectation that the government will receive any quotes from any SDVOSBs or any VOSBs. The AbilityOne Procurement List was checked for additions after January 7, 2010 for EBSOHost Database Services at all four locations with 0 results. Other Special Case Mandatory Sources per FAR 8.003: This is not applicable to the instant procurement. Encouraged Sources per FAR 8.004 and VAAR 8.004: EBSCOHost Database is not avaiable on GSA s eLibrary Database. Their GSA contract expired and they are currently working on a new one. Contracting Officer s Order of Commercial Sources Priority per FAR 8.004(b) and VAAR 819.7004: SDVOSB and VOSB Sources via VetBiz VAAR Subpart 819.7004, 819.7005, 819.7006: A search on OSDBU s VIP database using NAICS code 519130 and a keyword of database yielded 12 results of small businesses that are veteran owned and verified, none of which responded to RFI that was out. SMALL BUSINESS Sources via Small Business Administration s (SBA) Dynamic Small Business website: A search on SBA s DSBS using NAICS code 519130 and a keyword of database yielded zero results of service-disabled veteran owned and/or veteran owned. VAAR 819.7004(c): Section 8(a): A search on SBA s DSBS using NAICS code 519130 and a keyword of database yielded 0results of 8(a) small businesses. Women Owned Business (WOB)/Small Disadvantaged Business (SDB)/HUBZone: A search on SBA s DSBS using NAICS code 519130 and a keyword of database yielded 0 results of woman owned or HUBZone small businesses. Other Small Businesses: A search on SBA s DSBS using NAICS code 519130 and a keyword of database yielded 0 results of small businesses. Any Other Facts Supporting the Use of Other than Full and Open Competition: None Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: EBSCO Industries, Inc, 1151 Broad St STE 212 Shrewsbury, NJ, 07702 A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: The Government will do a sources sought notice to FBO next time this Acquisition comes up for renewal to see if any new contractors are available. The Government will continue to survey potential interested vendors in the marketplace for subsequent acquisitions of the same nature.
