Description
This is a special notice prepared in accordance with Federal Acquisition Regulation (FAR) 5.2 "Synopses of Proposed Contract Actions." U.S. Army Corps of Engineers, Portland District intends to award a sole source, firm-fixed-price supply contract for the procurement of Coded Wire Tags (CWT) with Northwest Marine Technologies. The tags and detection equipment are protected by US Patent Right No.'s 4955396, 4655396, 4753193, 5134,370, 5324940, 5816196 and 6145476. The purpose of this acquisition is to furnish 2,550,000 CWTs in FY18 for the USACE Portland District's Hatchery Program. The statutory authority for this non-competitive acquisition is 10 U.S.C 2304(c)(1) as implemented by FAR 6.302-1(b), Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. The Government intends to solicit this action on or about 26 January 2018. The NAICS code is 334220, Radio and Television Broadcasting and Wireless Communications Equipment Manufacturing. The size standard as defined by the U.S. Small Business Administration is 750 employees. THIS NOTICE IS NOT A REQUEST FOR COMPETITIVE PROPOSALS OR QUOTATIONS. Interested concerns must show clear and convincing evidence that competition of this requirement would be advantageous to the Government. All responsible sources may submit a capability statement, proposal or quote to the contracting officer before the notice end date. If no affirmative written responses are received by 10:00 AM Local Time on 22 January 2018, a solicitation will be made without further notice. Oral communications are not acceptable in response to this notice. A determination by the Government not to compete this proposed requirement is solely within the discretion of the Government.
