- The National Institute of Allergy and Infectious Diseases (NIAID) of the National Institutes of Health (NIH) in support of the Vaccine Research Center (VRC) intends to negotiate on an other than full and open competition basis with Wyatt Technology Corp., 6330 Hollister Avenue, Santa Barbara, CA 93117 to procure maintenance services for three Wyatt Instruments in the laboratory. The instruments are as follows: 1.) HELEOS II Ambient (1603-H2); 2.) OPTILAB TrEX (1301-TREX); 3.) CALYPSO II (167-WCG3). This acquisition will be processed under FAR Part 12 - Acquisition for Commercial Items and will be made pursuant to the authority in FAR Part 13.501(a)(1). Only one award will be made as a result of this solicitation. This will be awarded as a firm fixed price type of contract. Optimal instrumentation function is integral to the completion of the many projects dependent on this instrumentation. To ensure these Wyatt instruments are operational and will support the critical research in the laboratory a maintenance service is required. Wyatt is the manufacturer and the sole source, vendor does not have resellers. This manufacturer does not distribute parts through any other vendors and the only way to obtain these parts is through a maintenance contract. In addition to the parts, this system requires periodic software updates and fixes, which can only be obtained through Wyatt maintenance contract. Maintenance of these Instruments by qualified personnel is essential for their efficient functioning to maintain continuity and data integrity. This is not a request for quote. Offerors who can provide this particular service may submit a statement of capabilities. A determination not to compete this requirement, based upon responses to this notice, is solely within the discretion of the Government. The statutory authority for this sole source requirement is 41 U.S.C. 253 (c) (1) as implemented by FAR 6.302-1 only one source available, no substitutions possible. THIS IS NOT A SOLICITATION FOR COMPETITIVE QUOTATIONS. All responsible sources who can provide the same services may submit a response that could be considered by email (subject line to reference NIAID-NOI-18-1880052) to Akilah Bullock at akilah.bullock@nih.gov, by 3:00 pm eastern standard time Tuesday, November 21, 2017. All information furnished must be in writing and must contain sufficient detail to allow NIAID to determine if it can meet the above unique specifications described herein. All responses received by the closing date of this solicitation will be considered by the Government. A determination not to compete this requirement, based upon responses to this notice, is solely within the discretion of the Government.
