Description
This is a special notice prepared in accordance with Federal Acquisition Regulation (FAR) 5.2 "Synopses of Proposed Contract Actions." The U.S. Army Corps of Engineers (USACE), Far East District (POF) intends to negotiate/award a sole-source firm-fixed price modification to contract W912UM-16-C-0020 with Thomas J. Davis, Inc. (TJD, Inc. CAGE: 1FDL0). The primary work is for fire protection and electrical engineering services. Other minor services such as BIM, interior design, energy modeling, landscape design, LEED support and rendering are also involved. The work in general consists of field investigations, conducting all required studies/reports, attending meetings/conferences, for BIM support, preparation of Landscape Design, Architectural Renderings, Comprehensive Interior Design (CID), LEED Documentation online, LEED Design Notebook, Energy Modeling, and related pre-final, back check, and contract documents. The design work is to be performed for Project No. 86877, Army Family Housing facilities Project at Camp Humphreys, South Korea. The statutory authority for this non-competitive acquisition is 10 United States Code 2304(c)(1) as implemented in Federal Acquisition Regulation 6.302-1(a)(2)(iii), Only one responsible source and no other supplies or services will satisfy agency requirements, it is likely that award to any other source would result in substantial duplication of cost to the Government that would not be recovered through competition and would result in unacceptable delays in fulfilling the Government's requirements. Contract W912UM-16-C-0020 was awarded to TJD, Inc. on 1 April 2016 for design of Army Family Housing facilities Project No. 86689 at Camp Humphreys, Korea. TJD, Inc. provided all design services for the project and work under Contract W912UM-16-C-0020 has been substantially completed. The POF Engineering Division's Design Branch was tasked to prepare the design for Project No. 86877, a separate Army Family Housing facilities Project at Camp Humphreys. The Army Family Housing facilities to be constructed under these two projects are virtually identical and their designs will be virtually identical in most of the respects associated with the proposed TJD, Inc. design work. The POF Engineering Division Design Branch lacks in-house capability and/or current capacity to prepare designs in the areas of fire protection, electrical engineering, BIM, comprehensive interior design, energy modeling, landscape design, and LEED which TJD, Inc. has already produced. Because TJD, Inc. has already performed nearly identical design services for Project No. 86689 as will be required for Project No. 86877, using that architect engineer contractor's services to re-use/adapt design for Project No. 86877 will avoid substantial duplication in cost, because TJD, Inc. has already performed the work. POF estimates that contracting with TJD, Inc. for the proposed work will reduce design effort for Project No. 86877. Furthermore, because of the re-use (adaption) of the first design it is of particular importance to keep the original designer (AE) involved so that they may continue the design using their own product, produced as part of the original contract. This would alleviate liability to the government that arise when involving multiple entities (AE's) contributing to one final design product. A SOLICITATION WILL NOT BE POSTED. The Government intends to proceed with this sole source action. The NAICS code is 541310, Architectural Services. THIS NOTICE IS NOT A REQUEST FOR COMPETITIVE PROPOSALS OR QUOTATIONS. All responsible sources may submit a capability statement, proposal, or quote to the contracting officer before the notice end date. If no affirmative written responses are received by 4:00 PM local time on 16 December 2017, an award will be made without further notice. Oral communications are not acceptable in response to this notice. A determination by the Government not to compete this proposed requirement is solely within the discretion of the Government.
