Please do not request award status prior to this date. Manufacturer: DATEL, Inc. Justification for Sole Source Only : Standard commercial off-the-shelf (COTS) are not available to fully satisfy the requirements of SCD X201752148. The Government (DLA) requires electronic devices to be certified to MIL-PRF-38535 for monolithic microcircuits or to MIL-PRF-38534 for hybrid microcircuits as applicable. Market research resulted in the identification of a single approved QML-38534 Flash ADC source of supply, DATEL. Except for DATEL, the Aerospace/Defense Industry has moved away from developing high performance "Flash ADC" solutions and have opted to develop more efficient ADC architectures with higher resolution and increased sampling speeds. DATEL's ADC208A represents a near-complete part match and the device is recommended for new military designs. Minor carrier modifications and mounting (28 pin Cer-DIP) are necessary to make the ADC-208A device fully compliant IAW WR-ALC SCD X201752148. Per discussion with DATEL representative Jim Hornsby on 9 September 2017, the requested item meets the FAR 2.101 definition of "Commercial Item" in (3)(ii): "Minor modifications of a type not customarily available in the commercial marketplace made to meet Federal Government requirements. Minor modifications means modifications that do not significantly alter the nongovernmental function or essential physical characteristics of an item or component, or change the purpose of a process." The minor modifications requested do not alter the overall form, fit, and function of the requested item. When requested, the ombudsman will maintain strict confidentiality as to the source of the concern. The existence of the ombudsman does not affect the authority of the program manager, contracting officer, or source selection official. Further, the ombudsman does not participate in the evaluation of proposals, the source selection process, or the adjudication of protests or formal contract disputes. The ombudsman may refer the interested party to another official who can resolve the concern. (b) Before consulting with an ombudsman, interested parties must first address their concerns, issues, disagreements, and/or recommendations to the contracting officer for resolution. Consulting an ombudsman does not alter or postpone the timelines for any other processes (e.g., agency level bid protests, GAO bid protests, requests for debriefings, employee-employer actions, contests of OMB Circular A-76 competition performance decisions).
