- Page 2 of 2 JUSTIFICATION FOR SINGLE SOURCE AWARDS IAW FAR 13.106-1 (OVER MICRO-PURCHASE THRESHOLD($3.5K) BUT NOT EXCEEDING THE SAT ($150K)) IAW FAR13.104, COs must promote competition to the maximum extent practicable to obtain supplies and services from the source whose offer is the most advantageous to the Government, considering the administrative cost of the purchase. When competition is not practicable, IAW FAR13.106-1(b), COs solicit from a single source for purchases not exceeding the simplified acquisition threshold. COs may solicit from one source if the CO determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization). IAW FAR13.106-3(b)(3),COs are required to include additional statements explaining the absence of competition (see 13.106-1 for brand name purchases) if only one source is solicited and the acquisition does not exceed the simplified acquisition threshold (does not apply to an acquisition of utility services available from only one source) or supporting the award decision if other than price-related factors were considered in selecting the supplier. This template when completed can be used to document single source awards IAW FAR13.106-3(b)(3). Note: Statements such as "only known source" or "only source which can meet the required delivery date" are inadequate to support a sole source purchase. 1. ACQUISITION PLAN ACTION ID: VA262-17-AP-8223 1A. PROJECT/TASK No. None 1B. ESTIMATED AMOUNT: $107,937.51 2. BRIEF DESCRIPTION OF SUP PLIES OR SERVICES REQUIRED AND THE INTENDED USE: The Contractor shall furnish all labor, equipment, materials supplies, and parts perform on site full maintenance services on the 3M Abators and Ethylene Oxide (ETO) Sterilizers for VA San Diego Healthcare System (VASDHS), 3350 La Jolla Village Drive, San Diego, CA 92161. The Contractor shall provide the following: Cleaning of the equipment; Reviewing operating software diagnosis to ensure equipment is in accordance with the manufacturer s specifications; Calibrating and lubricating the equipment; Performing intervening maintenance; Testing and replacement of faulty and worn parts and/or parts that are faulty, fail, or become worn; Inspecting and replacing, electrical wiring and cables for wear and fraying Inspecting and replacing all mechanical components. Furnishing documentation, all measurements, and calibration data collected to ensure that the system is performing in accordance with the manufacturer s performance standards. 3. UNIQUE CHARACTERISTICS THAT LIMIT AVAILABILITY TO ONLY ONE SOURCE, WITH THE REASON NO OTHER SUPPLIES OR SERVICES CAN BE USED: 3M Company is the original manufacturer of the ETO Sterilizers and their associated Abators and holds the proprietary rights to all equipment parts, hardware, and software. These units must be maintained by authorized, trained personnel with access to original equipment parts. The units form a core set of reprocessing devices used by Sterile Processing Services (SPS) at VASDHS, and can only have minimal downtime without severely affecting the output of SPS. Without these devices, various medical cases have the potential of being cancelled because sterile supplies would not be able to be delivered. They require quarterly preventive maintenance service and continual corrective maintenance that Biomedical Engineering is unable to provide. Additionally, 3M Company doesn t provide third party vendors authorization to repair and maintain the Ethylene Oxide Sterilizers and their associated Abators equipment. Accordingly, 3M Company is the only firm capable of providing the services described above without the Veteran's Health Administration experiencing unacceptable delays in fulfilling its requirements. Additionally, another type of equipment may exist, but it would cost an expensive amount of monies for a replacement system, it would take up to twelve (12) months to install and more time to train staff. Furthermore, improper maintenance or repair by an unauthorized vendor may lead to voiding any warranties and may lead to inaccurate readings and cancellation of patient treatment. 4. DESCRIPTION OF MARKET RESEARCH CONDUCTED AND RESULTS OR STATEMENT WHY IT WAS NOT CONDUCTED: A sources sought notice (VA262-17-N-1505) was issued on www.fbo.gov from July 21, 2017 through August 7, 2017 requesting interested Service Disabled Small Businesses (SDVOSB), Veteran Owned Small Businesses (VOSB), Small Businesses and Women Owned and there were no responses. A Vetbiz review on September 11, 2017 resulted in over eight thousand (8000) contractors. I called three (3) companies, there was no answer for two of the companies and the other company provided maintenance of emergency vehicles. Many of these companies that are listed on Vetbiz are listed under maintenance and repair resulted in the following: (1) cannot provide maintenance and repair of medical equipment and (2) are not capable to provide the software licensing or parts required for the equipment. 5. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b).
