- Description
- This action was awarded as an 8(a) Sole Source Set-Aside under the authority of section 8(a) of the Small Business Act. This is a non-personal services contract to provide support services for Dust Control and Mitigation Services within Fort Bliss Operational Area, Texas and New Mexico. The Government shall not exercise any supervision or control over the contract service providers performing the services herein. Such contract service providers shall be accountable solely to the primary contractor who, in turn is responsible to the Government. 5.0 Specific Tasks: 5.1 Basic Services (Task 1a): The Contractor shall provide services dust control and mitigation services for Priority Areas 1, 2, and 3 (Technical Exhibits 3 & 4). The Government will not exercise any supervision or control over the contract service providers performing the services herein. Such contract service providers shall be accountable solely to the Contractor who, in turn is responsible to the Government. 5.2 Dust Suppression Services: The Contractor shall attend a project kick-off meeting or teleconference within 30 days of contract award to discuss task requirements and expectations. The Contractor shall document the meeting and provide meeting notes to all Government Personnel per Technical Exhibit 2. The Contractor shall apply the dust suppressant chemical to the defined area(s) as specified in the contract and the application shall be uniform and neat to ensure the roadway is treated and dust is effectively controlled. No puddles of chemical are allowable; all puddles shall be reworked into the soil by manual or mechanical means. Chemical application outside of the specified area(s) is ineffective in controlling lofted dust from vehicle traffic; the Contractor shall keep the application within the defined area(s). The Contractor shall coordinate with the Fort Bliss Air Program Manager and COR so coordination between Range Control and the Contractor can be accomplished for the safety of the Contractor and or driver. Communication shall be at the least two (2) weeks prior to the scheduled work period. The Contractor shall apply chemical to areas defined in the award of the Base contract as Priority Areas 1, 2, and 3 (Attachment 4) and shall contact the COR and Fort Bliss Air Program Manager when application is started and completed. • The product must be applied neat and uniform to the soil surface, road way or area. • The product must be applied in a timely and efficient manner to eliminate or minimize closure of the road way or area. • The product must have a cumulative effect on the surface to which it is applied, and display the ability to be re-compacted into a cohesive base when disturbed. 5.2.1 Submittals: The Contractor shall provide the following list of submittals prior to performance of work as requested per Task Order. The Contractor shall submit required documents within fifteen (15) calendar days after award of contract but no later than 15 calendar days prior to scheduling to allow the Government to review documentation. 1) Safety Data Sheet (SDS); 2) Bulk analysis testing of concentrated product performed by a disinterested third party laboratory will include the following that conform to U.S. EPA approved methods: a. volatile organic compounds (VOC) b. semi-VOC c. metals (at a minimum arsenic, barium, cadmium, chromium, lead, mercury, selenium, silver) d. polynuclear aromatic hydrocarbons (PAH) e. toxicity characteristic leachate procedure (TCLP) f. total petroleum hydrocarbon (TPH) g. corrosivity h. reactivity i. ignitability 3) Acute and chronic toxicity test data performed on the concentrate by a disinterested third party laboratory conforming to U.S. EPA approved methods; 4) Spill prevention and control procedures; and 5) Certified statement on Contractor's letterhead affirming dust control product meets requirements for the product contained in Section 4.3.1 Performance Requirements. 5.2.2 Dust Suppression Chemical: The Contractor shall procure an appropriate chemical for application within specified standards as specified in section 4.3. Contractor shall provide the chemical SDS no later than 15 calendar days after award of task order to the COR for Governmental approval. If the Contractor changes the chemical during the period of the Task Order, the Contractor shall re-submit items 1, 2, 3 and 5 as stated in Safety Data Sheet on 5.2.1. The Contractor shall maintain the chemical SDSs on-site and in the vehicle during application, preferably within the passenger cabin and appropriately identified. The Contractor shall transport all chemicals in accordance with 49 CFR Department of Transportation regulations; chemicals shall not be stored in the passenger compartment of vehicles. The Contractor shall coordinate with the Fort Bliss Air Program Manager and COR prior to delivering the chemical to the installation. The chemical may require storage or staging if delivered by either over-the-road (OTR) or rail freight and coordination among all parties involved is required prior to beginning application. For each application, the Contractor shall prepare an Application Report that documents all coordination meetings for the delivery of the chemical to Ft. Bliss, the actual application of the chemical of Ft. Bliss property including chemical mixing rates, application rates, application map and locations clearly identified, and application personnel information. 5.2.3 Spill Prevention. Contractor shall maintain spill prevention and control procedures of the dust suppression chemical to be submitted to the Contracting Officer no later than 15 calendar days after contract award. At a minimum the procedures shall cover spill kits and reporting of spills. The Contractor shall report any spills within two (2) hours to the following agencies in descending order: 1) Fort Bliss Fire Department and 2) DPW-E Emergency Spill Response Team, which will be provided by the Fort Bliss Air Program Manager. 5.3 Optional Services - Base Year: Exercise of options is at the Government's discretion. The contractor shall not perform these optional services unless the Contracting Officer has executed a contract modification exercising the option and issued a notice to proceed. 5.3.1 Task 1b: Dust Mitigation Priority Area 4: (Attachment 4) The Government may exercise the option for application of Dust Mitigation chemicals per subtasks 5.1 - 5.2.3 for Priority Area 4. 5.3.2 Task 1c: Dust Mitigation Priority Area 5: (Attachment 4) The Government may exercise the option for application of Dust Mitigation chemicals per subtasks 5.1 - 5.2.3 for Priority Area 5. 5.3.3 Task 1d (Option): Dust Mitigation Priority Area 6: (Attachment 4) The Government may exercise the option for application of Dust Mitigation chemicals per subtasks 5.1 - 5.2.3 for Priority Area 6. 5.4 Option Year 1 - Services: Exercise of options is at the Government's discretion.
