- The Department of Homeland Security (DHS), Federal Emergency Management Agency (FEMA), Office of the Chief Procurement Officer (OCPO) Continuity Acquisition Section, in support of National Continuity Programs (NCP), intends to negotiate on a sole source basis with CodeMettle, LLC, 6 Concourse Pkwy Ste 1050, Atlanta, GA, 30328-0004, without seeking competition for configuration of CodeMettle network monitoring software: (a) CodeMettle Base System (up to 25 devices) to manage remote spoke sites: Part Number CM-BMS-RSS; (b) CodeMettle CM-GEO-DIVERSE Base System (up to 100 devices) to manage secondary HUB site; (c) Remote engineering configuration services to support remote installation of spoke software and setup Part Number PS-DOM-SPOKE; (d) Remote engineering configuration services to support remote installation of Geo-Diversity secondary HUB site PS-DOM-GEO; (e) Annual Standard Maint & Support; Part Number CM-MS-STANDARD. This action is being taken under the statutory authority for other than full and open competition, 41 USC 3304 (a)(1) as implemented by FAR 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements, as CodeMettle is the only company that can provide the service required on its proprietary software. The North American Industry Classification Code (NAICS) for this acquisition is 511210, with a business size standard of $38.5 million. THIS NOTICE OF INTENT IS NOT A REQUEST FOR COMPETITIVE QUOTES. However, all responsible sources may submit a capability statement, which, if received within five (5) calendar days after the date of the publication of this synopsis, will be considered. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. A determination by the Government not to compete this requirement based upon responses received as a result of this notice is solely within the discretion of the Government.
