- PWS This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. This solicitation is issued as a request for quotes (RFQ) in accordance with FAR Parts 12 & 13. The provisions and clauses incorporated into this solicitation document are those in effect through Federal Acquisition Circular 2005-64 Effective on January 17, 2013. Provisions and clauses incorporated by reference has the same force and effect as if they were given in full text. The full text of the Federal Acquisition Regulation (FAR) and Defense Federal Acquisition Regulations supplement (DFARS) can be accessed on the internet at http://farsite.hill.af.mil/. The solicitation W912NR-17-R-0034 is issued as a Request for Proposal. This procurement is set aside for Small Business. The NAICS code for this acquisition is 332312. The small business size standard for this NAICS code is 500 employees. The Louisiana National Guard will be awarding a Firm- Fixed Price Supply Contract. This solicitation is for a firm fixed price contract and will be awarded to the lowest priced technically acceptable. Proposals must include a quote and a date that all deliverables could be delivered by. 1.1 General: 1.2 Scope: The contractor shall provide all personnel, equipment, tools, materials, supervision, and quality control necessary to provide Ballistic internal protection panels with a minimum rating of United Laboratories (UL) 752 Level 5 or National Institute of Justice (NIJ) Level III, as defined in this PWS. 1.3 Background: The Director of the Army National Guard, LTG Timothy J. Kadavy, has issued a supplementary update to the ARNG Base Operations Guide 08-17, requiring physical security improvements to storefront recruiting offices (SFROs) and standalone facilities (SAFs). In support of Secretary of Defense pose-Chattanooga initiatives to improve physical security, the requirements of this contract have been implemented as mandatory. 1.4 Period of Performance (PoP): The Period of Performance shall include enough time to manufacture, test, inspect, and deliver equipment to their required destination, not to exceed 6 months after receipt of order. 1.5 General Information: 1.5.1 Quality Control (QC): The contractor shall develop and maintain an effective QC Plan (QCP) to ensure equipment is manufactured in accordance with this PWS. The contractor shall develop and implement procedures to identify, prevent, and ensure non- recurrence of defective material. The contractor's QCP is the means by which it assures itself that its work complies with the requirements of the contract. As a minimum, the contractor shall develop QC procedures that address the areas identified in Technical Exhibit 1, Performance Requirements Summary. After acceptance of the QCP, the contractor shall obtain the Contracting Officer's (KO) acceptance in writing of any proposed changes to its QCP. 1.5.2 Quality Assurance (QA): The Government shall evaluate the contractor's performance under this contract in accordance with the Quality Assurance Surveillance Plan (QASP). This plan is primarily focused on what the Government must do to ensure that the contractor has performed in accordance with the performance standards. It defines how the performance standards will be applied, the frequency of surveillance, and acceptable quality level(s) (defect rate(s)). 1.4.4 Place and Performance of Services: The contractor shall provide deliveries between the hours of 0730-1630 on Tuesday through Friday, except on recognized US holidays or when the Government facility/installation is closed due to local or national emergencies, administrative closings, or similar Government-directed facility/installation closings. Performance of manufacturing shall be at manufacturer's warehouse or designated space. The contractor shall at all times maintain an adequate work force for the uninterrupted performance of all tasks defined within this PWS. 1.4.5 Special Qualifications: Must meet Underwriters Laboratories (UL) 752 Level 5 standard for Bullet-Resisting Equipment or National Institute of Justice (NIJ) Standard 0101.01, Ballistic Resistant Protective Materials. Minimum Level 5 UL Protection: 7.62mm Rifle Lead Core Full Metal Copper Jacket, Military Ball (.308 Caliber), 150 grains, 9.7 weight, 2750 in fps. 1.4.6 Post Award Conference/Periodic Progress Meetings: The contractor agrees to attend any post award conference convened by the KO in accordance with Federal Acquisition Regulations Subpart 42.5. The KO, Contracting Officer's Representative (COR), and other Government personnel, as appropriate, may meet periodically with the contractor to review the contactor's performance. At these meetings, the Contacting Officer will apprise the contractor of how the Government views the contractor's performance and the contractor shall apprise the Government of problems, if any, being experienced. The contractor shall resolve outstanding issues raised by the Government. Contractor attendance at these meetings shall be at no additional cost to the Government. 2.0 Definitions and Acronyms: 2.1.1 CONTRACTOR. A supplier or vendor awarded a contract to provide specific supplies or service to the government. The term used in this contract refers to the prime. 2.1.2 CONTRACTING OFFICER (KO). A person with authority to enter into, administer, and or terminate contracts, and make related determinations and findings on behalf of the government. Note: The only individual who can legally bind the government. 2.1.3 CONTRACTING OFFICER'S REPRESENTATIVE (COR). An employee of the U.S. Government designated by the KO to monitor contractor performance. Such appointment shall be in writing and shall state the scope of authority and limitations. This individual has authority to provide technical direction to the Contractor as long as that direction is within the scope of the contract, does not constitute a change, and has no funding implications. This individual does NOT have authority to change the terms and conditions of the contract. 2.1.4 DEFECTIVE SERVICE. A service output that does not meet the standard of performance associated with the Performance Work Statement. 2.1.5 DELIVERABLE. Anything that can be physically delivered and includes non- manufactured things such as meeting minutes or reports. 2.1.6 KEY PERSONNEL. Contractor personnel that are evaluated in a source selection process and that may be required to be used in the performance of a contract by the Key Personnel listed in the PWS. When key personnel are used as an evaluation factor in best value procurement, an offer can be rejected if it does not have a firm commitment from the persons that are listed in the proposal. 2.1.7 PHYSICAL SECURITY. Actions that prevent the loss or damage of Government property. 2.1.8 QUALITY ASSURANCE. The government procedures to verify that services being performed by the Contractor are performed according to acceptable standards. 2.1.9 QUALITY ASSURANCE SURVEILLANCE PLAN (QASP). An organized written document specifying the surveillance methodology to be used for surveillance of contractor performance. 2.1.10 QUALITY CONTROL. All necessary measures taken by the Contractor to assure that the quality of an end product or service shall meet contract requirements. 2.1.11 SUBCONTRACTOR. One that enters into a contract with a prime contractor. The Government does not have privity of contract with the subcontractor. 2.1.12 WORK DAY. The number of hours per day the Contractor provides services in accordance with the contract. 2.1.13 WORK WEEK. The LAARNG requires 192 Solid Ballistic Panels and 54 Full Glass Ballistic Panels delivered to 54 different locations in Louisiana. Four (4) Solid Ballistic Panels or Six (6) Full Glass Ballistic Panels will go to each address. The proposed delivery schedule will be negotiated with the vendor prior to finalization of the contract. Delivery addresses will be listed as Attachment 1 of the PWS. 5.1. Mobile Ballistic Shields. Supplier will provide delivered prices for CLIN 0001: 192 each Solid Ballistic Panels; CLIN 0002: 54 each Full Glass Ballistic Panels. 5.2. Ballistic shield minimum specifications: A) A maximum of 48" X 72" (4' wide X 6' height) with final height on casters of approx. 75"; B) Bullet Resistant Panel in solid, and Ballistic glass in the entire opening. C) Upholstered in grey acoustic fabric with a tackable surface; D) Aluminum framed; E) All material must meet Underwriters Laboratories (UL) 752 Level 5 standard for Bullet-Resisting Equipment or National Institute of Justice (NIJ) Standard 0101.01 Level 3, Ballistic Resistant Protective Materials; F) Must be in compliance with the Buy American Act; G) Minimum Level 5 UL Protection: 7.62mm Rifle Lead Core Full Metal Copper Jacket, Military Ball (.308 Caliber), 150 grains, 9.7 weight, 2750 in fps; H) Approximate weight: 550 pounds, palletized and crated with delivery to site. 5.3. Caster Specifications: Heavy duty four (4) inch steal lockable casters (four each per shield) to enable mobility and support for weight of the shield. 5.4. Unit Price Instructions: Unit price is to include one (1) each panel, four (4) each 4" steel lockable casters, detailed instructions on how to attach the casters and additional hardware to the panel, and shipping to the designated ship to location; per line item. TECHNICAL EXHIBIT 1 Performance Requirements Summary This Performance Requirements Summary includes performance standards. The Government will use these standards to determine contractor performance and will compare contractor performance to the Acceptable Quality Level (AQL).
