- NOTICE OF INTENT FOR PROPOSED CONTRACT ACTION The Department of Veterans Affairs, Network Contracting Office (NCO) 2, James J. Peters VA Medical Center, Bronx New York, intends to award a sole source contract under the authority of 41 U.S.C 253(c) (1) - FAR 6.302-1 Only one responsible source and no other supplies or services will satisfy agency requirements, to Nk Architects, 95 Washington Street, Floor2, Morristown, NJ, 07960-8607. NK Architects is to continue with the provision of construction period services (CPS) related to the constructing project designed by them. Place of performance: VA Hudson Valley Health Care System, FDR Montrose Campus, 2094 Albany Post Road Montrose, New York 10548-1454. Period of Performance: The period of performance is 240 calendar days from award notice. This notice of intent is not a request for proposals; interested parties may express their interest by providing a capabilities statement no later than Wednesday July 12, 2017 at 2:00 PM EST. The capabilities statement must provide clear and unambiguous evidence to substantiate the capability of the party to provide the required services. A determination not to compete this proposed contract upon responses to this notice is solely within the discretion of the Government. Verbal responses are not acceptable and will not be considered. If after Wednesday July 12, 2017 at 2:00 PM EST, no viable responses have been received in response to this announcement, Department of Veterans Affairs shall negotiate solely with NK Architects. The government believes that the below described services (please see the SOW) cannot be provided by another firm within a timely and practical manner. NK Architects has been preforming the AE services for this project, but the design funds expired as of 09/30/2017 due to the construction delay. The VA needs to continue with this project, and NK Architects has unique capabilities to provide the government s requirement within a timely and practical manner. The government believes that it would be highly unusual for another design professional to take on the aforementioned responsibilities, which are generally incidental to an overall agreement for preparation of plans and specification. This notice of intent to award a sole source contract is not a request for competitive proposal. There will be no solicitation available for competitive proposal. Phone calls will not be accepted. The point of contact for this action is Richard Adu, Contracting Officer at Richard.Adu@va.gov The Government anticipates awarding a firm-fixed- price contract. A determination as to compete this proposed requirement based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. Statement of Work: The contractor shall provide services to complete Construction Period Services and site visits not completed before funds expire by FY 2017. Work shall include, but not limited to the following tasks: Technical Services: The A/E shall review and check the Construction Contractor s submittals, which includes but is not limited to shop drawings, detail drawings, schedules, descriptive literature and samples, testing laboratory reports, field test data, for conformity with the design concept and construction documents. The A/E shall recommend approval, disapproval, or other suitable disposition of the Construction Contractor s submittals in a timely manner. The A/E shall assist the VA in the interpretation of the construction documents. The A/E shall respond to the Construction Contractor s request for information (RFI) pertaining to the design in detail and in a timely manner. The A/E shall prepare supporting documentation for contract modifications. The A/E shall prepare revised drawings, details, and detailed cost estimates for contractor s claims of additional work not shown on drawings due to both unforeseen site conditions or A/E error and omission (if any). Periodic inspection services. The A/E shall provide ten (10) site visits. The A/E Firm shall submit a detailed survey report with photographs summarizing the conditions found at the construction site as a result of the site visit. Each site visit shall be a total of eight (8) hours. As-Built Drawings: The A/E shall prepare as-built drawings based upon the contractor s marked up documents
